I want to add two more points to check along with the 10 doc mentioned 1. Check/ Certificate for the local authorities saying NO Temple land 2. Check for any river or lake or pond or big water body near by , if yes then the land should have buffer zone as prescribed by authorities. (Buffer zone is gap between the any water body and the land ) Thank you

Will like to add few more points. 1. Get the last paid electric meter receipt to check no dues their . 2. Always give a news paper notification in local popular news paper by a lawyer before registration additional to encumbrance certificate. 3. Always personally verify weather the property is in possession of the seller..or no other dispute. 4. Try to enquiry personally from local and neighborhood for any dispute if any. 5.Take a enquiry about water logging situation and any extreme conditions during monsoon. 6.Look and verify physical the land if soil has been cut and sold from the land converting it to pond and low lying. And check flat if any damp and cracks in the structure not their.

A life hack: Buy properties through banks. Apply for a small loan, the Banks check all the paperwork work for you, and you don't have to much.

No. It is not fool proof. Bank will just care for loan recovery & emi - even if you actually never got the propert from builder. Personal experience.

This is the sole reason why I never owned or will ever own any single property. Plz also include this in next video, Seller says to mention property price as 20 lacs(as per gov land price) in the transfer deed and pay another 20 lac under the table, which they call market price. Why on earth I would want to involve in illegal transaction. Hence I stayed away from buying any property. Excellent informative video!

1. Never Buy Property from Power of Attorney (Bcz it can be revoked by the first owner) 2. Title Document (Sale Deed, Gift Deed, Will Deed). Sale Deed Registry me hota hai 3. Society Patte pe nhi milta hai loan 4. Registration aur Stamp Duty pakka Krna hai. 5. Strata k through investment kar sakte hain. 6. Channel Document (Pure History of that Property like eg X ne Y ko becha aur Z ne X ko becha. Get it Checked through Lawyer) 7. Encumbrance certificate from Registry Form No 22 bharo udhar ja k with details of the property. Registrar will tell u any issue of tax or loan in that property (Property kahi girwi to nahi). U can do it online also. 8. Occupancy Certificate (To be given by builders after paying all tax by him and is in total compliance . Issued by MC to Builder. 9. Allotment letter - For resale by one owner to other owner. It is for those who are buying it from other person who purchased from Builder.It is given by builder to the first owner. 10. Tax Receipt eg Urban Devp Tax (UDT) to be given by the builder or 1st owner to govt or MC. It should be paid every year by the owner. Take tac receipt from owner. Not applicable for Plot. This will also clear title bcz it will verify that tax payee person in true owner of that property. 11. Car Allotment Letter to be given by 1st owner to other owner for Parking Space. 12. NOC (Maint Charge to be paid to Resident Welfare Society for cleaning, light, security) from 1st owner to 2nd owner) 13. Mutation Document (Jamabandi, Daakhil Kharij) . Isko ja k Karo in Registrar office. Registrar k sale deed le k Concerned authority like Urban Authority or Registry office k paas jaao taaki owner k name change ho in govt records. 14. Conversion certificate (CLU). 15. Meet real owner of the plot or land before purchase 16. Study the behaviour of saamne wala person whether he is forcing u to buy or pay early or if he is charging high token amount.

Main problem is with the government forms, acts and laws. 1st: They are way too complex. 2nd: 95% people are not aware to these loop holes. Government should provide a stream line portal where people can get all the information and execution for free.

Superb content. We have faced absolute harassment because of property issues, so much so that it brought us on the brink of suicide. The guy sold our land without letting us know and on top of that continuously lied when we asked for our money. It was beyond distressing. After a lot of running from pillar to post, and us circulating videos of my father falling ill because of this tension, the guy came to our home to apologise. After 3 years of agony, he has paid 70% of the money and will return the rest soon at the current market value. Please be careful while buying properties in Sonepat, Noida, and other NCR areas. Many are agricultural lands. Plus, not all but a significant number of government officials are a part of this nexus. If you get into trouble, getting help would be very difficult unless you have high profile contacts. This is as per my experience.

You don't need Urban Development Tax in plot but you need to pay Land Tax(Also known as Lagaan). Lagaan receipts can be used to verify ownership of plot along with Mutation Receit.

Two main problems that come out of this video: - Property management has to be digitised. This will solve all the problems mentioned: (Title document, Channel documents, Form 22) - Video Editing has to be outsourced. In an age and time, where quality of the video is highly important, this is a limiting factor for creators

You missed one more. The promotional vdo of strata is too long almost 9min and Naman is insisting to hire a lawyer and check documents where mandeep is promoting strata insted of lawyer. He is promoting is okay but check in complaint board or consumer how many complaints registered with strata.

Excellent video. This video also highlights the complications in buying a new property. State governments should make the process of buying a property easier to enable growth in real estate. This is why younger generation now stays away from buying a new property and would rather rent out an apartment which is easier 😂

Another very important point to be highlighted. if land is converted into non-agri and if declared purpose of conversion in not completed in 1 year then said (NA) permission gets revoked autimatically

Bro, I really loved the video. Being a CS student and learning all of this feels great. I would love to learn more from the Part-2 of this video[ ghar karidne ke bad kya kya dhyan rhkna chahiye]. and the line "Ignorance of law is no excuse" hit hard. Hii Mandeep sir . I am from Buxar Bihar, My father has bought a land. In 2012 and now my father is dead. My mother has a small job. that supports our household. This is the only land we have now. And we don't know what to do. Father did it all by himself and we have no idea from whom it was bought. Many people say that this land belongs to the Bihar government. And there is a man who says that this birth is ours. But at the moment we are living here since 2014. Sir please reply me

One more point....Obtaining certified copies of all last sale deeds from the registrar office and collecting(take physical possession) all previously made original sale deeds from the previous owner of the property. Please match the serial number of stamp papers used in previous sale deeds with the certified copies of sale deeds. Regards

Completion Certificate - is granted to housing projects after authorities make a physical visit to the property and perform checks to ensure that the project follows all applicable municipal laws for buildings. It assures that the building is safe to live in, and will also get water and electricity supply. A building without a completion certificate can invite penalties and even eviction from municipal authorities if it is deemed unsafe to live in.

In property sale/purchase you should go only by papers, friendship, relationship etc sub kinaare. Isme koi sharmane ki zaroorat nahi hai. And no hurry, people who try to sell in hurry, showing fear of loss, ki property haath se nikal jayegi... Never say yes to it. Take time to check all papers and visit the property.

As Mandeep mentioned, I still think all property issues can be solved by a distributed ledger- Blockchain that stores all the details of the property. How? The property can be listed as an NFT-non fungible token. Arrey ruko sir, suno!!! The property can be a token. That token would have a wallet address associated to it and since it is a public ledger all property buy sell can be tracked on the chain. And maybe in that blockchain, wallet can be created only using your aadhar card-Digital India zindabad!!!.

Thanks for the detailed information. This really helps a lot. Just one question: If a person obtained a property in inheritance after death of a parent (original owner), but parent didn't document a will, How can I ensure that the person claiming to be the current owner (one of the parent's children) has legal right on the property? Basically, which document should I check to make sure that the seller alone rightfully owns the property and that none of his/her siblings object?

They must obtain a survival or succession certificate. Survival certificate is issued by local SDM court in 21 days and succession certificate is issued by a district court in approx. 9-12 months. Purpose and validity of both the certificates is the same.

Very informative!! Although I have some Questions. Do reply as per your convenience: 1. Considering I am the buyer, what can I do if the owner is not able to provide tax receipts? 2. What to do if he/she have not paid the taxes and further not ready to pay the same? 3. Do individual flat owners (in residential society) also have to pay UD tax? 4. Where can I check if the land is Agricultural land or Non Agricultural land? 5. Can farmhouse be built on an Agricultural land? 6. If certain plot is not defined by MCs (from "plots divided and sold by societies" @5:30 section) can we still determine if its is agir or non agri land? Other than this, some small addons from my field: 1. Consent to Establish (CTE) NOC: It is an NOC granted by Pollution Control Board of the state. It gives the outline to the project from an Environmental Angle. Like: a. Water consumption b. waste water generation c. treatment facility in premises/ other arrangement d. sources of air pollution. (DG Set is most common) e. Conditions to be complied during its construction This is to be obtained before development of the project begins. CPCB categorizes projects in 4 categories i.e Red, Orange, Green and White. White category projects don't require this NOC, but requires to intimate the State PCB. It has a validity as per state laws Non compliance to its condition or not having valid CTE, can attract serious penalties. 2. Consent to Operate NOC: This is similar to OC document from MC. It gives the consent from State PCB, that the project is ready for use. It has a validity as per category, and have to be renewed before 90 days of expiry (most states). It has got similar components like that of CTE, but with conditions of Operation. Non compliance to its condition or not possessing valid NOC can cause serious penalties, which is at times paid by RWA, thus falls indirectly onto tenants. So make sure your society has a CTO NOC. Bonus: Brief about Environment Clearance Letter: This is also called EC letter. Applicable on range of industries (given in EIA notification 2006 and amendments), but for Building Construction projects it is applicable on projects where BUA is more than 20,000 sqm. It is granted by MoEF&CC or its subsidiary bodies (SEIAA/UTEIAA). Application Process It takes normally about 6 months for complete application to process and grant of EC. You need a complete accredited team for this and cannot do without consultants (mandatory). Operational Phase It has conditions to be complied from Construction phase to operation phase throughout its life. So if you reside in a residential society or have a store in a complex. Do check the conditions and make sure these are being complied, else it can cause severe penalties on the project. Also, the project have to submit a 6 monthly compliance report, failing which can attract closure orders or penalties. Would be waiting for a reply.... :D

You can go for advocate, he will charge around 3k-5k for search report and will give you all the details of property. N one thing to remember do not hurry in any transiaction. If you r giving token amount make sure token is refundable.
