Here's a bit of info: the way copyright law actually works is; as soon as someone creates a work, it is copyrighted to them and they own it. You DO NOT need to register anything anywhere to have a copyright of your material, you automatically have it. Its best to keep some evidence you developed the idea first, but this guy is completely wrong when he says the original owner's character is not copyrighted

While that is correct to have any teeth registration would be advised. Sadly with this I dont think any actual court would find that this is infringement even if it were registered. There isnt any exact percentage a thing or design needs to be different from another but generally speaking when things are designs of things that actually exist like a Dalmatian dog its even harder to win in court as they do have a certain look. So differences are even more limited as if you go too far astray it is no longer recognizable as the species. Then there is the question of the makers TOS. When they create the suit to the ref...who drew the ref? Who has rights to the ref. Was the transference of rights from the artist if different than the suit owner done properly? If the owner drew and designed the ref was the ref modified from the original drawings by the maker and is there proof that that intelectual property belonged to the ref maker suit owner etc etc. It would be a fools errand to even try and take this to court.

Especially in the art world cr can be a two blade sword. Much of the art that is produced in fandoms is influenced quite notably by strongly owned business copyrights like Pokemon and Disney. Sometimes its just a simple name that can be the difference between Disney suing your pants off and the court dismissing the whole case. Like heres a cartoon lion its name is Boof it looks an awful lot like Simba from the LK. But many lions look a like and you can only stray so far without it no longer being a lion cartoon or not. The fact its named Boof could be the difference you need to keep your home lol

Matthew clearly copied Patch's character and color/pallet swapped it taking the Heterochromia away and adding 3 random spots on one ear, it's basically Patch. If he truly wanted an original Dalmatian character, there are so many possibilities for originality with that particular dog species. Dalmatian spots appear randomly, no 2 Dalmatians are alike and it leaves a lot room for creativity. Unless you're Matthew who doesn't appear to have an original thought in his head or creativity. Also why does he sound drunk in every one of his messages? If he isn't drunk, then he's high on something.

Last comment I left I made a mention of how he clearly sounded intoxicated during the first voice message, and he yet again sounds drunk on the second one, and it made me think: I honestly think this dude might make all these decisions while heavily drunk and that's probably the reason why he keeps acting like a lunatic and nobody can understand why. As of recently a lot of fursuit heads have slitted eyes, "Being removable." A lot of them tend to have tufts of fluffs on the top of the head, Most fursuit companies tend to charge more depending on the complexity of the fursona, Having all black ears makes the most sense. Black Nose that's the fursuit norm. Tongue and Inner ear are of the same color likely of the same material again to save costs. I don't see Patches have eyebrows. I don't see patches having extra cheek fur, the jawline is different compared to the two. The snoot itself is also different in shape. Lips of a Dalmatian are well you guessed it black. To follow a canon appearance, the spots on the cheeks are different in placement and size. DHC is more ON the cheek, whereas patch is a bit above the cheeks. Lets not forget that this is a Dalmatian, chances are that you have limited changes, tweeks and options you can do if your fursuit is a canon Dalmatian. Most Dalmatians I've seen actually have the largest black spot dead center on one of the eyes. Speaking of the eyes, they're different in color and in style. No one owns the rights to Dalmatians, not even Disney. LOL. You can whine, complain, defend, blame, and or smear each other into the dirt. But deep down, when two furries are arguing over something and put each other on blast, it just makes you both look dumb and honestly it's not going to bring anyone to your side. Most furries in the fandom would rather not get involved in drama or any affairs of any variety. . If you start to act out and throw tantrums it'll just detour anyone from wanting to even be remotely associated with either side. If Mathew or Patches were to take this situation to Court, here is what'll happen, Probs 80% certain that Mathew would win the case. Why, Because the judge would look at the two heads and say yeah they're Dalmatians and yeah they may be somewhat identical. But they're not the same. And it is likely that either are not tagged with any form of DMCA copyright. So I mean yeah Impersonating is not right. Waving a C&D can actually backfire. Harassing and Slander on a public site regardless of who did it first can also backfire when in court. Mathew says this Patches says that. Both of you can face problems when in court because you both want to make a scene which can make evidence hard to sift and take into account as something useful. TLDR: Yall both acting like children when you're both adults. Get over it move on. Learn from it. Copyright your stuff. And Lawyer up for future projects.

I just gotta say, as a new maker trying to get my TOS in order, DHC is horrible. Not only the reviews of poor quality I've seen, and of course the allegations, but as a maker, most makers check to make sure characters are owned by the people commissioning a suit, that's why so many makers don't make video game character suits, because you can get in trouble for copyright... Especially where DHC made the other suit, how would they not see that's too close! I've had someone steal my design and just colour swap her (blue and yellow ears instead of pink and green), and I got them taken off a site for it, I offered to help them make a new OC, but they never said anything and I reported them for theft as all their "art" was just re-coloured base fills they claimed they made. Yandex is a great search engine for finding if art is stolen, but characters are a little harder.
