This monthly inspection junk is total harrassment but when you sign a month to month rental agreement you agree that you will move with a 30 day notice.

This is tripping me out. What landlord does a monthly inspection? That’s harassment and she came in with her phone video recording! I don’t know the laws or the rules but this is highly suspect and I would not allow someone to video inside my domicile every month I don’t care what reason she is giving. That landlord is lucky it wasn’t me she was trying to mess with.

@MegaSkilla What blatant misinformation am I spreading? The tenant was there. However, even if the tenant was not there inspection records are needed for insurance company and records. Particularly security and damages. The owner has a right and a legal obligation to maintain safety and health and legal standards of their property. Inspections can be done. The rules are a bit different in different places but as far as I can find, generally 24 hours notice unless emergency. Not excessive. Monthly is not excessive. However, many will not even bother beyond as needed and required for legal reasons. It should be appreciated when an owner tries to have careful upkeep. Only if you have something to hide will it likely be upsetting. Drugs, extra people, animals, hoarding, filth etc. The other tenants have a right to safety as well such as preventing leaking, mold, bugs, firehazards. This is standard in most lease agreements. If you actually did own property you would know this quite well. Find the regulation that disagrees. Good luck. Recording the landlord is likely not illegal but not a great way to interact. However, posting it worldwide showing identity is questionable at best.

Isn't that what "month to month" means? That neither you nor the landlord is bound to either pay or to lease for more than a month's time? So that she is free to give you notice and evict you, and you are free to give her notice that you are vacating. If this is a month to month situation, then I have to side with the landlady. If she gives you notice in accordance with the agreement you made, then you've got to abide by the contract. It doesn't matter why she wants to evict you. It is within her rights to do so- it's her property. Even though the inspection is odd to me, if she has done this before, she is polite. I don't get the point of filming this to post online. I cannot sympathize with anyone trying to get out of an agreed upon contract because they don't think the other party has a good enough reason to ask you to leave. She doesn't have to give a reason.

The owner expected to move in when her house she lived in sold. Tenant, even though unhappy, claimed she wanted to stay. She filed dispute after owner gave 60 day notice. 30 day is usual, I think. Retained a free lawyer. Likely mediation. 60 day was upheld, last month generous settlement of free. Not sure if security was used on final month before. Usually goes that way. The friend was a witness, there was no real harassment. My impression anyway.

Nah, it's worse than that. The landlord decided to sell the property she was in. She could have moved in to the apartment upstairs but decided to rent it to someone else. Then she goes and tries to kick out the current tenet from the main floor saying it's because of her knee. If it was her knee then she could have offered that upstairs unit to the current tenet, but instead she screwed her and is trying to make her homeless and showing up with friends to harass her.

@@cccc8643 she was on a month to month lease. The landlord can inspect once each month until the tenant moves out or until the tenant signs a longer lease. Owners have the right to protect their property and go through the steps it takes to remove tenants who violate their lease agreements. Tenants must remember that although they have rights, they DO NOT OWN the property. As far as slumlords go, I’m pretty sure you can tell a property is owned by a slumlord so don’t rent from one. Landlords can do inspections on a monthly basis with 24 hour notice. Landlord brought her friend for safety (whom you shut the doorvon causing anxiety for them both.) You are month to month, all she is required to give you is a 30 day notice. Check your legal and binding lease agreement! I see no issues here.

@@jonathancarrillo6379 Because as a former office manager for an apartment complex it was my job to also do inspections during the 6 month mark and when clients were requesting assistance with repairs etc. Until you have been cornered in an apartment by a crazy person who likes to cook directly on the stove burner instead of using a pot/pan... you don't know the fear and anxiety that goes through you each time after that you are required to go into an apartment with someone who can easily become aggitated or dangerous. I used to have the maintenance guy go with me for the exact same reasons. As to your opinion of me, I would have to value it first... *I don't.* Enjoy your triggered state in a muted existence. 🙂

From my understanding , the landlord sold the house she was currently living at and is deciding to move into the house she is letting tenants rent. The video uploader is renting month to month so the landlord wants her to leave so she can move in which the landlord has every right to do so. Landlord gave notice. Inspection is probably on the rent contract. So I'm not seeing anything wrong with this video. Might be unfair for the renter since she'll have to move but that's just the downside to not having a long term lease.

This surprise inspection coupled with her taping days after she started hassling her tenant could easily be judged as obvious harassment, especially if she wasn’t conducting monthly inspections before. If she wasn't doing these "monthly inspections" before, then they're being used as an obvious harassment tool against a tenant with a legal lease- that's illegal. I've never lived anywhere that required monthly inspections. I wouldn't stick around in a place that did.

A landlord can increase rent from month to month, and must give at least the same notice. A landlord can't boot a tenant in good standing out in the middle of a lease term, and must have a legally allowed reason for ending such an agreement. A month to month lease does NOT make a landlord God here.

The 60 day notice the owner had given her was kept in place. She says now she was not happy there, it was disgusting....so why else try to stay? To get free rent sounds like.🤔

So it looks like the landlord knew she was selling her property and instead of informing the tenant that her home was on the market and that she would like to move into the rented property once the sale goes through, she decided to wait until her property was sold then wants to harrass the tenant. Landlord seems to have done this purposely because she didn't want tenant to move out which would mean landlord loses money so she decides to now harass the landlord and brings her friend to add the pressure. You being homeless is not the tenant's problem (even tho its your property) and there are proper ways to go about things without being underhand. No way I would want to stay there after that.

Huh. I keep going back and forth. Ur right though, the right conscientious thing to have done was tell the tenant beforehand. That way things could have been smoother. The tenant could have just said no to moving in. Because she probably would have thought it out that she didn't want to move again so soon. But everyone is saying the landlord is in the right because it's just business. 🤨🙃 Navigating in the adult world, I find that it does u no good to be honest and kind all the time. Listen, if someone asks me to vacate their property and I do not have a current lease, I would move out as soon as I could. Granted if you have a lease, you have every right to stay until your lease is up. Otherwise, move out. Follow your state law and do not complicate it.

How is this harrassment??? The landlord seemed pretty nice and polite to me, and if she wants to sell the property she's within her rights to do that unless the tenant has a lease. All she has to do is give that tenant a 30 day notice. The tenant seemed much more rude to me, especially with the paranoid questions about the landlord being sick. I'm assuming this tenant is not a doctor.

Where I live, the Residential Tenancy Act states that you can stay after your fixed term lease on a month to month basis. Renters' leases are automatically renewed on a month to month basis unless the landlord or their spouse wants to move in for at least 6 months. Some landlords kick renters out so they could raise the rent at a higher rate by renting to someone else. This would be illegal. The rate of rental increase is controlled by laws per year for the same renter otherwise. The landlord tried to say that she needed to move into the ground floor suite I was living in because she had an "injured knee" but her knee was fine. There are two suites on the ground floor but she only gave me notice and not the other suite.

Her rent is paid, the apartment is spotless, and the tenet has a legal right to be there. If you feel so bad for the landlord then take her into your house. If the landlord has money to pay the mortgage, then she has money to rent an apartment herself. If she owns it outright, then she can use the tenets money to go rent herself a place like she was already doing. The landlord knew she was selling the other home, so like the tenet said "Why would you move NEW tenets in upstairs giving yourself nowhere to go". She could have let the current tenet have that place upstairs instead of renting to someone new and then kicking her out for no reason when she's done nothing wrong, but pretending like it was her knee. Shady, shady, shady. I'll bet you know her. There's no way someone is sticking up for the landlord on this one.

Coming from someone with a bad knee, you can’t tell just by watching me walk around that my knee could go out at any moment. Stop making excuses and know that regardless of your so called laws, you should accommodate the property owner since she gave you notice and needs to take possession of her property. I am guessing the owner expected to move into this apartment which is why she gave a short-term lease. She knew her house was on the market. Most likely did not hold as high a requirement for long term. End of June2021 to Sept. month to month. The tenant decided she did not want to go, though says unhappy there. Filed dispute. The 60 day notice was upheld. 30 day being required, I think. But she generously got the last month free with the help of a free lawyer. Probably mediation. Not sure about a security deposit but if she had one, likely used that for the final month before free month. The owner may also have been looking for issues to present in court regarding any damage. Or her own reference as well. The friend was there as a witness is my guess. Remember, this tenant would now be a neighbor if she rented the upstairs. Lower floor needed for herself. Would you want this kind of tenant above you? Did she even qualify? Not that the owner is obligated. The upstairs people also had signed years lease. Likely rented on the idea this tenant was leaving.

She cannot legally enter the unit without the tenant permission (unless is an emergency situation), which should be asked at least 24h before the time of the visit. Even in this scenario the landlord can ask to enter the unit only for reasons that involve maintenance of the property. Not just to video around. On the other hand the tenant (given 60 days notice) must empty the unit if required as primary residence for the landlord and/or her family.

This is not the law so the tenant could say that these “inspections” violate her privacy beyond her expectations so the agreement could be considered void by the judge. It is true that law often (and likely for a reason) protect tenants rights more than landlords’. However, when renting a property, owners should take into account all of these unfortunate situations.

Renting never gives you the feeling of being secure in your home. The landlord can do this because she is the owner and you did not sign a lease.. But if she doesnt pay her taxes the goverment can put her out too. It's better to have a pleasant conversation so that she will give you a good reference for your next apartment. I think her friend came with her to help her with language not to harass you. They were polite and soft spoken, they did not threaten you but explained her need of the apartment. I am sorry you need to move, it is a major inconvenience and costly. But she said you kept it clean so no doubt she will return your security deposit. Good luck to you and I'll keep you in my thoughts and prayers.

THIS IS why I DO NOT rent from private landlords!...I rent from Companies!...But I also do my research on them prior to renting from them And check out the area and neighborhood at various times!..But, I love my small apartment complex, in the county, surrounded by homeowners, affordable, slight yearly increase, but worth it!... well maintained, quaint, quiet, clean, diverse, ...only 6 units in a building...have tenants that has resided here from 5 to 30 years!...I've been here for 12 years now!...that was not the plan, but NO regrets...

The landlord is allowed to ask you to leave with letter if month-to-month. There are other valid reasons as well. Inspection every month is allowed if you signed on the agreement. 24-hour notice, at least. Or agreed date. If not, a few times as necessary. Emergencies always allowed in. No notice. The landlord must also have state and county and city inspections. The extra person is needed for her safety. You appear here ...well, kinda unstable. Or maybe she is there to show her apt. Which she is allowed to do when ending a tenancy. At least in US. If she moves in for six months according to your interpretation she is allowed? I personally think she was respectful. Do you pay the taxes, insurance, repairs, maintenance? Have the responsibilities? Worries? No? Then she is the owner. Better to be cooperative, get your security back, references. Sorry for your discomfort. Good luck. Hope you found an even better place. If she is not there 6 months, there is complaint validity most likely according to your definition. Probably not going to win anything, though. I think it is 30 - 60 days. Anyone can move in. Air can move in. Reference the section if you are able?

Not at all when a land lord makes up its own laws. a judge would through out any lease and faver a tenant. a lease made by land lord that is not legal by any state of the nation or country's. may not be a valid lease.

@@trafficjon400 The law there allows inspections. I went to the rules mentioned. The lease designates the times. In the USA the requirements for commercial buildings actually requires inspections whether the owners want them or not. smoke, zone, repairs, insurance, tenant change some places, section 8, etc. Maintenance inspections are usually standard. 30 to 60 days notice is standard. Leases with agreements, amendments are legal and binding. No candles, garbage rules, animals, visitors, etc. It would have to be unreasonable to get a lease thrown out. Not sure what that would even be.

If you cannot or do not pay rent, how does the owner pay mortgage, taxes, oil, water, insurance, fees, repairs, advertising costs, their time, court costs, attorney fees, accountant time if they use one? They are obligated to provide safety and health, pay their own bills yet the tenant is not obligated for any responsibilities? Nonsense. Absolute uneducated nonsense. Tell me, how does the owner protect the other tenants without background check? Meagan's law, drug sellers and parties, assaults, thieves, previous evictions, etc...You will not find people willing to own property to rent if that was made the rule. She is trying to get her to comply with the short- term month to month agreement from end of June 2021 to Sept. 2021. The owner expected to move in after her house sold. The tenant does not want to go, supposedly. She filed a dispute, obtained a free lawyer and ended up with the original 60 day notice (30 is usual, probably) upheld but generous offer of last month free.

Had a landlord told me I couldn't keep my oxygen tank in my unit. Was told welding in apartment was illegal. The tank is for my breathing, I have emphysema. Was given a 30 day notice to vacate. Landlord still harassed me for the 30 days until I moved out. Never had such ridiculous trouble for my medical equipment.

If she just sold her home, she should have plenty of money to move. It's a house, so I'm certain she got more than $50 from the sale of it. However, a month to month lease is not good for you as a tenant unless you are a short-term only tenant. So after a month they can refuse to renew your month to month tenancy.

She's probably not the actual Property Owner, just a Property Manager despite what it may say on the Papers. Real owners probably one of those 'Real Estate Management' companies that hire Property Managers FOR their lack of English Fluency, to create situations like this. Wonder how much Affordable Housing there'd be in the US overnight if Cities or Counties just Eminent Domain'd all these Corporate Owned Rental Properties and set Rent at something the average Full-time Laborer in the area can afford.

I'm going through something very similar. The landlord want me to move because I asked him to repair the ceiling in the bedroom because a portion of it caved in due to water damage from an upstairs unit

First of all, by law it is supposed to be a annual inspection. Not a monthly inspection.

i think the landlord was very nice and polite as she’ said she will be homeless she needs her house back renting month to month is very stressful with covid loss of jobs no money things are tough i think people will be renting rooms the way the economy is going the landlord i don’t think was in the wrong you could’ve had a abusive landlord yelling at you that’s what i’d be angry at peace ☮️ in the world 🌎 hope you found a new place to live cheers australia 🇦🇺

Does the tenant still have a lease? If not, the tenant is legally required to move out according to law, regardless of an eviction notice or not. "Month to month" means the tenant is paying rent every month. If the tenant hasn't paid for the next coming month, they are legally required to vacate according to law.

tenant isn't crazy lol. landlords are out of control. Literally the only thing a landlord needs from you is proof of income. Because they're providing a basic necessity of life, they do NOT HAVE THE RIGHT to economically discriminate, which is what a credit score and the application process does. The homelessness situation is linked DIRECTLY to the corrupted and predatory economics/state of middle class people.
