Well, you should also make it crystal clear, that if the accused person is already on Bail, and during investigation if any new section(s) (offence, whether cognisable or non-cognisable) is/are added against the accused person, already on Bail, in the same FIR, then that accused person will have to apply for the Bail only against the freshly added sections, without going into the judicial custody. This use to be the settled & standard practice in the criminal law in India for very long now.

Read pardeep kumar case on this...yes police can file an application for cancellation of bail that has been granted before new section is added and if court after consideration cancel bail than yo have to file new bail application

सुप्रीम कोर्ट के इस फैसले से यह निम्न बातें स्पष्ट होती हैं: 1. अभी तक सुप्रीम कोर्ट को अभी तक ये बात समझ में नहीं आई है कि 51 प्रतिशत रेप केस झूठे होते हैं इसमें मर्दों जिंदगी बर्बाद हो जाती है। 2. किसी औरत के केवल कहने मात्र से कोई Consensus affair रेप कैसे हो जाता है? 3. आधे से अधिक रेप केस में acquittal हो जाता है लगभग 5-10 साल केस चलने के बाद तो अभी तक यह अपराध non bailable क्यों बना हुआ है? इंक्वायरी और मेडिकल एक्जामिनेशन के पहले गिरफ्तारी क्यों जरूरी है? 4. दिल्ली महिला आयोग के चीफ ने अपने मृत बाप के खिलाफ यौन शौषण का आरोप इन सभा में तालियां जीतने के लिए लगा दिया और कोई विवरण नही बताया। फिर वही दिल्ली में बैठा सुप्रीम कोर्ट ने संज्ञान क्यों नहीं लिया? 5. एक शादी शुदा औरत गैर मर्द से संबंध बनाकर उसे शादी का झांसा देकर रेप करने के केस में कैसे फंसा सकती है और पुलिस FIR कैसे कर सकती है और केस सीधे डिसमिस क्यों नहीं हो जाता? उस शादी शुदा औरत को महीनो या सालों के बाद क्यों यह दर्द अचानक उठता है कि उसके साथ रेप किया गया और वह भी बिना उसकी मर्जी के? फिर यही औरतें केस सेटल करने के लिए extortion कैसे कर पाती हैं? बिना तलाक लिए इन महिलाओं को गैर मर्दों से संबंध बनाने का अधिकार किसने दिया और अगर बना भी है तो उन्हें फंसाना क्यों है? 6. जबसे 498 A जरा ढीला पड़ गया है, तबसे शादी का झांसा देकर रेप करने के मुकदमे बढ़ते जा रहे हैं। इस new pattern पर सुप्रीम कोर्ट का ध्यान क्यों नहीं जाता? 7. क्या सुप्रीम कोर्ट के पास इतना वक्त है कि सेम सेक्स मैरिज जैसे Unnatural संबंधों पर आधारित शादी के केस पर इतना जोर देकर सुनवाई करे? नेचरल जस्टिस की बात करने वालों को क्या नेचरल सेक्स पैटर्न नहीं समझना चाहिए? कल कोई Homosapien अगर अपने related specie से शादी करने का petition लगा दे तो कोर्ट उसपर भी सुनावाई करने को तैयार हो जाएगा? परसों कोई incestuous relations पर आधारित शादी के लिए petition डाल दे तो क्या कोर्ट उसको भीं उतनी ही तवज्जो देगा क्योंकि कई सभ्यताओं में ऐसी परंपरा रही है? 8. बदले की भावना और extortion के इरादे से लगाए गए रेप के झूठे इल्जाम क्या इतना मुश्किल है समझना? 9. क्या कोई मर्द किसी औरत के खिलाफ शादी का झांसा देकर रेप का केस डाल सकता है?

Seeing the accused getting bail if supplementary section of 376 IS added how n why should the bail of an accused b cancel n sent bk to jail without any medical evidence n proof of victim being raped. Before conviction men is already treated as Guilty even before conviction. ...who knows in many cases arrogant women may missuse the legal power bestowed upon them....
