In this landmark judgment Supreme Court stated that the dispute was concerning mutation entry in the revenue records. The bench added that it cannot be disputed that the right based on the will can be claimed only after the death of the executant of the will. Even the will itself has been disputed.
Settled Position of Law
Mutation entry does not confer any right, title, or interest in favor of the person and the mutation entry in the revenue record is only for the fiscal purpose. If there is any dispute for the title and more particularly when the mutation entry is sought to be made based on the will, the party who is claiming title/right based on will has to approach the appropriate civil court and get his rights crystalized and only thereafter based on the decision before the civil court necessary mutation entry can be made

Good information given in simple language. Which act makes it compulsory to change the name of deceased person. It is precautionary measure to remove name of deceased person and replace it with heirs.

क्या सेल डीड, म्यूटेशन और 15 साल तक कब्जा, तीनों होने के बाद भी कोई टाइटिल सूट करके कह सकता है कि जमीन का टुकड़ा किसी अन्य प्लॉट का हिस्सा है और मुझे जमीन खाली कर के हट जाना चाहिए? यदि हां तो इसका क्या बचाव है।

बेहतरीन जानकारी देने के लिए धन्यवाद। चार भाई बहन हैं, माता पिता की मृत्यु के बाद एक भाई ने म्यूटेशन अपने नाम करवा लिया, बाकी तीनो ने कुछ नहीं कहा और कोर्ट भी नहीं गए, तब तो एक भाई जिसने म्यूटेशन करवा लिया था अपने नाम, वो उस प्रॉपर्टी को चाहे तो बेच भी सकता है ? कृपया बताएं ।

जब तक संपति 4 भाई और बहनों में परस्पर न विभाजित कर दी जाए तब तक न बेचें। और आगे बेचना भी चाहते हैं तो विभाजन होने के बाद अपना हिस्सा बेच सकते हैं दूसरे का नही ।अन्यथा कन्नूनी करवाही होगी ।

2 साल तक की समय सीमा निर्धारित है।उससे पहले दोनो पक्षों के परस्पर सहयोग से या उनके द्वारा पेश किए गए दस्तावेजों से जो पहले साबित होजाएगा न्यायालय अपना आदेश पारित करेगा ।

Multiple cases based on contract on an agricultural land at different time sold that to a bonafied person lis pendence hit the case as decree is passed against seller in second contracted person while the first contract holder case is pending .in this situation can all the purchaser and contract person case can be clubbed to get a single solution for the seller is not going to refund the amount and litigation rtime will be too long .any remedy that u can suggest to get case solved by arbitration

Thanks for sharing! Very important information. I am about to buy a property and he has done mutations but also submitted No Objections certificate of his Mother and Sister. Should I buy this property? There is no sales deed in his name but only mutuation. I asked him to bring his Mother and Sister at the time of registry and make them a party or sehmtikarta in registry and provide their signature and he agree to it. Should I buy this property this way or there should be a different way? Also, I am making all payments to Son only and other two person are not getting any money but they will physically present to sign ..is that ok? I need to do this in next 3-4 days and your answer will help me

Will बनने के बाद लाभार्थी संपत्ती पर अपना नाम चढाती और सब वारस का नाम आता हे तो Will वाला 27 साल बाद बोलेगा मेरे पास will हे लेकिन ओ संबंधित कार्यालय मे दिखाकर नाम पर नही करेगा और बहार will दिखाते घुमेगा तो Muteation अमान्य होगा क्या
