सर नमस्कार हमारी कुटुंबीक जमीन हमारे दादाजी के दोनो भाईयोने मिलके धोके से प्राप्त कर लोगो को बेचकर दी, इस बात को और दादाजी को गुजरे ५० साल हो गये मेरे दादाजी का कुटुंब याने हम लोग शहर मे रहते हे इस बात का फायदा उठाकर दादाजी के भाईयोने हमारे हिस्से की जमीन बेच दी ये बात हमे चार साल पहले समझ आयी अब हम कया करे जो हमारे हिस्से की जमीन वापस मिल जाये? कृपया मदद करना 🙏

20 वर्ष से मकान बना कर रह रहा हूँ, जमीन के मालिक को पता है, और कोई फिर या कोर्ट केस नहीं है, मैंने कहा था कि आपकी जमीन है तो पटवारी से पैमाइश करवा लो, लेकिन उन्होंने पैमाइश तक भी नहीं करवाई।

Mere nanaji k bhai ne dhoka diya aur property khud k naam ke li hai. Jab hum ghr ka construction kr rhe the tab usne humko notice diya hai. Aur ab court case chal rha hai. Hum us zameen par 25 saal se jayda reh rahe hai. Hamre paas electric bill, Paani tax aur Ghar ka tax bhi hai, 20 saal purane se maintained hai. Aur ye jagah nazool ki hai, jo mere nanaji k bhai ne chupkese apne naam kr liya, jab mere nanaji k ek laute bete ki death hone k 8 saal baad. Wo jameen kisi X military officer se mere nanaji k bhai ne kharid thi but funds mere nanaji ne lagaya tha, baad me usne dhoke baaji kari, tab ye. Deal hue thi ki property aadhi kr denge baad me. But usne nhi kiya. Bhai tha to bharosa kiya tha. But ab Ye case adverse possession ka hai 25 saal se, usne 2022 me court case kiya hum par.. tab se ab tak hamara hi continuous possession hai bina kisi interruption k. Hum 1985 se reh rhe hai., bht usne case 20222 me kiya, Kya lagta hai apko Sir, kya case hum jeet skte hai.. ??? Please kuch apna Experience share kren. Hamara case already chal rha court me. Mai apki vichar aur raai janana chahta hu.

माननीय , हमारी दादी ने ६० वर्ष पहले गाँव में घर बनवाया था कच्चा, ज़मीन मालिक अब पक्का बनाने नहीं दे रहा, उसमे कभी ज़मीन पर दावा नहीं किया ना ही हमे निकालने के लिए आज तक कोई नोटिस दिया। पूरा गाँव ये बात जानता है । क्या हमे प्रतिकूल क़ब्ज़े का दावा करना चाइए ? कब तक कच्चे मकान में रहेगे, बारिश में बहुत दिक़्क़त होती है । कृपया मार्गदर्शन करे।

सर, एक जमीन के खसरे में किसी और का नाम लंबे समय से दर्ज है और वो जमीन उनकी ही थी.. लेकिन वो जमीन पवाईदार (राजा ठाकुर जो पहले हुआ करते थे) ने उनसे ले लिया था, ठाकुरों ने कैसे लिया था मुझे नहीं पता.. फिर ठाकुरों ने 1960 में कब्जा हमे दे दिया और खसरे में मेरे बब्बा का कब्जा दर्ज करा दिया था तब से हम उस जमीन पर काबिज हैं..नाम उनका अभी भी है और वो नाम के आधार पर जमीन बेंच रहे हैं.. 1990 में खसरे से मेरे बब्बा का कब्जे से नाम कट गया और हमें कोई सूचना नहीं मिली.. अब हमें क्या करना चाहिए

Sir sarkari canal department k jameen par mera ghar 110 saal se hain 1973 mein jab canal department torne aya mera ghar to.mere dada ji high court se stay liye. High court bola ki agar canal department ko lagta hai ki encroachment hai to fresh case file kre. But tab se aaj tak canal department koi action nahi liya. Kya mai adverse possession ka daba kr sakta hoon

2001 से अभी तक 2024 हम मकान बना k रह रहे है। मेरा जमीन 6 डिसमिल है। कुछ दिन पहले 3 मार्च 2024 मेरे मकान के बगल का जमीन नापी हुआ तब मुझे बताया जा रहा है कि 0 .5 डिसमिल आपने ले लिया है। इससे पहले कभी भी कुछ भी नही बोला गया अभी खाली कीजिए बोलता है मुझे क्या करना चाहिए। मदद कीजिए सर

सर जी हमारे मकान के कागज में माप 3600q fit का है ओर घर 6440q फिट में बना हुआ है 45 साल हो गया है दादा जी के द्वारा बनवाया गया था पर आज जिस से जमीन ली है वो कह रहा की हमने इतनी जमीन बेची थी आपका इस पर दुगने पर मकान बना है उनके पूर्वजों को कोई आपत्ती नही थी उनके बारिश अब कोर्ट केस की धमकी दे रहे हैं हम इस पर क्या कर सकते है

Sir hamara ek plot hain jis par kireyadaro ka kabja hain 1994 se unhone farzi vasiyat or mukhytarnama se plot apne naam kar liya hain or hamare pass registry hain ab jis ne registry karwayi vo bhi mar gayi hain abhi permanent injunction ka case oppoaite party ne kar rakha hain hum kya kare ham jyada kanoon samjhte nhi they to bedhakli ka vakeel saheb ne case nhi lagata

सर हमारी 6बीघा karshi जमीन है इसके 1हिस्से पर मकान बन रखा है जिसमे मेरे चचेरा भाई और उसकी फैमिली7-8ईयर से रह रहा हैं और उसके नेम से लाइट कनेक्शन है 7-8 से और अब वो खाली नही कर रहा और मकान के पास वाली 2बीघा जमीन के आस पास पर हमको घुसने नही देता ।और पुलिस मै कंपलेन करते है तो पुलिस दोनो पक्ष को पाबंद कर रही है और कोर्ट के निर्णय का वेट करने का बोल रही है और कोर्ट मै वो अपना कब्जा 50ईयर से बता रहा हैं

Kisi property pr hum kabje me the.1978 se ,phir us property ka souda hua 1998 jameen ke owner se2 lac 90000me humny.50,000 advance de diye Phir vo advance lekr souda nhi kr rha tha.abhi 2024 tk vo property kabje me h hmare. Ab ky ho skta h sir ji. Pls btay.

Sir humare sath 5 points milte hai but papa ne 72 mein kharida tha aour tab se possession me hoon lekin kharid ne ka koi document nahi, paisa de k possession liya tha. Ye kya adverse possession me aayega

Sirji hm 1940 se rent mai reh rahe hai hmara land lord k sath kuch case chal raha hai 70 years se hum rent court mai jama kar rahe hai please thora bataiye humare pass koi adhikar hai ya nahi land lord nahi bhada uthate nahi humse bat karte are we safe in such situations

Sir My father was a tenant from 1945 to 1:59 till his death in 1964.I as a 12 year being the eldest continued his business .I have been in possession from 1964 to as on date.I have been continuously paying rent without fail.Now the present landlord(Daughter in law of landlord as she recd the property lawfully)I have been paying rent to her regularly since she became landlord ie almost 20 years.Now she is asking me to vacate or purchase at her price which is double the present market price.Does she has the right to evict me as I have been enjoying peaceful possession since 1964.

Sir if gpa 16 yrs tak time hogaya ho , or gpa holder ki death ho gayi ho , 16 yrs mai koi dispute nahi hai and land pe gpa holder ka possion hai , yaha bhi adverse mana jaiga. Jpa 2000 mai haui thi and 2016 ko gpa holder ki death ho gai .

Jab aap hi kisi ko apni property par bina license, rent etc ke rakhte hai aur koi virodh 12 years tak nahi karte tab kanoon lagu hoga, aur ise sansad me banaya gaya hai aap hi ke vote se elected neta dwara court to uska palan karati hai

सर मेरे पिताजी तीन भाई थे पापा से बड़े व बिच वाले भाई की शादी के कुछ दिन बाद मोत् हो गई पर उनकी पत्नी अभी भी बिना शादी किये हुए अपने पीहर मे रहती ह यहा पर जमीन तीनो के नाम है मेरे पापा के मेरे ताऊजी के और जिन ताऊजी की मोत् हुई थी उनकी पत्नी के । जब मेरे ताऊजी की मोत् हुई थी तब जमीनी तोर पर जमीन के 2 टुकड़े हुए और मेरी ताईजी ने हीं करवाए तब से अब तक मेरे पापा और मेरे बड़े ताऊजी हीं उस जमीन को आधा आधा काम मे ले रहे है कम से कम 20 साल से अब ताईजी उसकी जमीन वापस लेना चाहती है

Sir, मैने 1989 मे एक मकान खरीदा था, उसकी आधे भाग की रजिस्ट्री करवाई थी आधे भाग की रजिस्ट्री नही करवाई, मकान का कब्जा पुरे का मेरे पास है, मेने पुरे मकान का भुगतान के रुपये दे दिया था मौखिक करार अनुसार, लेकिन 25 साल बाद मकान मालिक ने आधे भाग की रजिस्ट्री दूसरे के नाम करदी, जबकि मकान के दो भाग नही है, बगेर कब्जे के रजिस्ट्री कर दी, क्या बगेर कब्जे के कराई रजिस्ट्री शून्य होगी या नहीं, मैने कोर्ट मे केस कर दिया है, deekleration सूट कब्जे का एवं रजिस्ट्री शून्य करने का दावा किया है, क्या रजिस्ट्री शून्य हो जाए गी, मार्ग दर्शन करने का अनुरोध करता हूँ

Pranam Sir Kareeb 24 saal phle mere dada ji ne jameen registry karwai thi. Jameen abaadi bhumi me sathi Hui thi aur dono ka gata no(179) ik hi tha aur jameen ka koi alag se naksha nhi tha. 4-5 saal tak hum logo ne jameen par kabja paane ki kosis ki par naksha na hone ke karan kabja nhi mila. Beech beech me lekhpal aate jaate rehte the jameen ki naap ke liye par kabja nhi dila paaye. Aaj Kareeb 2 saal phle humne Section 30(2) of UP Revenue code 2006 me case kiya aur apne jameen ko gata no 179 se alag karwaya jo ki ab 179क hai. Uske baad humne UP Revenue code Section 24 ke tehat SDM Court me case kiya aur SDM Court ke aadesh par 07.11.2023 ko jameen ko chinnhit karke upar patthar Nasab kiya gya. Ab samne wali party jiske khet me jameen ja raha hai usne ispar agle aadesh tak stay order le liya ki med bandhi ka aadesh abhi na diya jaaye. Stay ab hatt chuka hai. Humn punasthapana ke liye application lgai aur fir usne aapatti laga di thi jiski jaanch hui aur uske daav galat paaye Gaye. Iskarn se matter abhi bhi final aadesh ke liye SDM Court me lambit hai. Kya ye banda future me adverse possession claim kar sakta hai court me jaake. Jameen mere dada ji ne likhwai thi apne naam par, par paise mere papa ne diye the. Aur wo Indian Airforce me abhi bhi service me hai. To kya adverse possession humare upar applicable hoga agar samne wali party future me case kare ki main iss jameen par 50 saal se kheti kar Raha hu. Please suggest sir.

1968 से कब्जा है..7/12 पर मूळ मलिक नागय्या का नाम है.. उससे रेवान्थ 1959 मे खरीदी ..उसके बाद हमारे दादा ने 1968 मे खरीदी लेकिन फेरफार नही हुआ..7/12 पर हमारा कब्जा लिखा है..सिंचाई विभाग मे पाणी पट्टी 1968 से भर है..खेती मे चावलं हम ही उपाजते है... भोगवत वर्ग 2 की जमीन है..तहसीलदार ने लीगल कब्जा करा कोर्ट से..या मालिकांना हक्क ..मिलेगा क्या..

If a man enters in the property by way of attorney in his favour and real owner has died.he is still in peacefull possession for 20 years.can he claim adverse possession .there is no claim for heirs of owner
