Dates are just a play... SC should have seen if the party has paid the cheque or is ready to pay it on courts advice then only complain should be dropped... In most of the cases people are not able to get their rightful payment and courts are of no use in getting justice as the system is systematically toooo slow

no, this was the right decision. His conviction was illegal and had to be set aside. SC is not just deciding that particular dispute, but setting a precedent as well.

@@saumitra31 14 din me usne payment nahi kiya to kya 15 din me kiya nahi kya sc me usne kaha ki wo payment kar deta agarr use 15 din ka time milta. Veh voluntarily bhi payment kar sakta tha. ya vakil sahab ne puri baat nahi batayi isliye judgment logically galat lagta hai.

In Indian court, cheque bounce case is useless. Nothing happens to the cheque issuer. I will explain my case. I booked a plot in Gurgaon builder and paid about 60 laks as advance. He promised that either he will give me possession of a plot in 18 months or willl pay back my amount with 12 % yearly interest. He failed to give mevplot and gave me 6 cheque of next 6 month's to return my amount. I deposited those cheque in Banks and only 3 cheque cleared and 3 dishonoured. I filed the case in Tis hazari court, after few hearing where I was attending every time, he never came and send someone from his office with a lawyer. After sometimes we filed the case in high court as at that time amount was so big that we can take that case to high court. After about 6 months, parliament passed a bill and my case again transfeted to lower court. I don't remember it happened around 6 years ago. Before my case again started in lower court, my lawyer expired due yo heart attack. My original papers were either in court Or witht my lawyer. There were two option with me either to cry and fight again with stress or to leave it to God If indian judicial system is good, I should have received my money after 2 of 3 years What the court has taken action to finish this case Nothing Moral of the story is don't trust cheque in India. Ig cheque is dishonored, then you will loose your money and get stress in life. For your information the builder was Era infra having their registered office in Noida at that time

Very sad that the High Court passed a judgment without proper understanding of such a simple proviso. Are we allowing incompetent human beings to man highly respectable positions of high court judges. Selection process needs to be tightened.

in fact lower courts where complaints are filed should have a checklist. They should reject cases where rules are not followed. This should have saved the aggrieved parties interest. In any case, the fact is, he lost his money of 2.5 lacs because of lower courts negligence. In such cases (where lower courts fail to understand the rules), lower courts should be fined and appropriate provisions should be made to ensure compensation to the aggrievd party.

very good justice made. now you have to know and understand the foolish laws before doing anything otherwise you wont get your money no matter whether the other party is legally liable to make the payment or not. imo, the payment terms decided in the invoice or the written agreement must be enforced and not any artificially made 30-15-30 days law.

sbi se sbi me ak aadmi ko rupaya transfer huwa aur vo hame pnb ke 3 check diya jo ki bounce ho gaya to ham kaha se letter bhejwaye us party ko sir please bataye abhi 10 di huye hai....aur paisa transfer ka receiving bhi hai stamp par bhi likha hai to kya hoga, aur vo party ke accz me paisa nahi tha.

If he refuses to accept through Regd.Post,after the waiting period one can file the criminal complaint u/sec 138 of Negotiable Instruments act before the hon'ble special magistrate or magistrate of first class basing upon the jurisdiction , after filing the complaint the court will send summons to the accused ,if he refuses to accept twice ,then warrant can be issued by the magistrate

Now that respondent is acquitted, and all statutes of limitations are also over - what is the next recourse? Because the time period of 30 days to file case under Sec138 of NIA after 15 days period to respond to legal notice is also over right? Does this mean that the complainant has no remedy?

Technical mistake hua Hain lekin Us technical mistake ka istemal karte hue payment na dekar choot gaya, Bahut se criminal cases Main bhi technical mistake ko use karke criminals free ho jaate Hain.. Indian judicial system itna slow aur painful Hain ki aam insaan ki poori zindagi khatam ho jaati hain insaaf ke liye..Aur powerful log judicial system ko use karke kuch bhi kar sakte hain...

Me ek tractor dealer me as a manager 2013 saal se kaam karta tha. lock down ke baad business Kam ho gaya Aur dues bhi nehi uth rahe the. is company ne lock down ke time mere se sequrity ke behalf par blank cheque aur blank paper par sing manga. Me kisi bhi halat me kaam khona nehi chahata tha aur Isliye maine blank cheque aur paper me sign karke de diya. kaam ke douran karib 10lakh customer ke paas dues tha company ka. Maine is company ko Aug 2023 me chor Chuka hu. Abhi wo customer se paisa wasool nehi kar pa rahe he. Abhi wo company mujhe threat kar Raha hai ki mujhe customer se nehi mere se paisa lega, company ka kahena hai maine tumko paisa diya hai tum paisa doge mujhe. Maine wo paise customer se collection karke nehi diya to wo Mera blank cheque bounce karke case karega. Main bohot frustration me hu. Kiya Karu. Mera aukat nehi hai 10lakh Dene ka. Please kuch solution dijiye

The case is not maintainble, if case filed prior to days of limit. But what happens to the money owed to borrower. Would that money be lapsed or becomes not claimable?
