Somewhat misleading. Women may not be criminalized/penalized for abortions but the 13 states that have banned abortions penalize the provider that facilitates the abortion. So if you are encouraging pregnant women to get medical care, where are you going to find doctors in these states that want to risk their medical license, potential jail time, or fines (specific to Texas)?

I believe they are covered by EMTALA-the Emergency Medical Treatment and Labor Act. Under EMTALA, hospitals are required to provide emergency care to stabilize patients regardless of their ability to pay or other factors, and this includes pregnant women facing life-threatening conditions. So, if a woman has a pregnancy complication that poses a serious risk to her health, hospital are required to perform an abortion or other life-saving treatment under federal law. Including banned abortion state like Texas since EMTALA is a federal law

In the summer of 2022 when Roe vs Wade was overturned, the Biden administration through the US HHS, provided guidance that abortions in emergency scenarios are covered on EMTALA. However, states are pushing back on this. There are several examples. This is not reassuring to patients or providers involved in an emergency scenario. While you think "an emergency" scenario sounds clear cut, it is not. I'm a health care provider (not ob/gyn) that works in a state that bans abortions. I had a scenario with a young patient waiting for an organ transplant with end stage renal disease and severe type I diabetes that was hospitalized for complications related to both. She found out she was pregnant during the hospitalization. A pregnancy would have been extremely high risk for her but it did not put her in immediate "danger." In this scenario, I believe an abortion is appropriate (& what the patient & her partner wanted due to how sick she was). EMTALA could not be used as justification in this case because she too early in pregnancy for it to be medically affecting her. She would have had to wait until she was further along & it began affecting her organ systems. This just doesn't make sense to me. No ob/gyn in the above scenario should be fearful about losing their license, fines or jail time for making a decision that was best for the patient.

Her “no” answers are misleading. While no one has been charged for miscarriages distinctively, they have been charged and prosecuted for “child endangerment” “homocide” “child neglect” and “abuse of a corpse”. In most of the 200+ cases the prosecution used “fetal personhood” as the argument.

I just off the phone with Senator Lankford's office. They told me he is upset that people like Kamala Harris are claiming doctors are being arrested. I told them the problem is doctors ARE AFRAID they will be arrested... because language in the various state bills criminalizes behavior by doctors... and that such language makes them fearful of doing what they know needs to be done. I told them Senator Lankford needs to publicly state that women should ALWAYS get the care they need from doctors ... that doctors should not have to wait until a woman is about to die before giving her the care she needs! The problem is that healthcare professionals have become stifled and are concerned about legally doing the wrong thing for giving treatment. No doctor wants to lose their license. I believe treatment has been delayed. I believe women’s health has been compromised by possible legal ramifications. Abortion is often not to end the life of a fetus but to preserve the life of the mother. Having confusion and possibly legal consequences will cost women’s lives

Please link to examples of this happening. The only one someone would provide me is one case in texas that had nothing to do with abortion. The woman, who tragically died, did not want an abortion, but had a medical complication at around 6 months pregnant. She was misdiagnosed and died as a result, with her loved ones suing for malpractice. If you have geniuine examples of this happening I'm interested.

The criminalization of providers is the thing called out by media so much, and his questions are specificied to women, not providers. "News" has been spread and people are believing that woman can be prosecuted, and that miscarriages and the removal of ectopic pregnancies are abortions. His questions and their answers are addressing this misinformation.

There's more nuance to it than that. Simplistic dualities of abortion and miscarriage don't work because the laws don't often differentiate enough to have clear interpretations when applied to real world scenarios. You're right though, they've colluded to make these questions and answers as carefully misleading as possible. Women have faced and continue to face prosecution for abortion from zealous prosecutors who are testing the limits of these laws such as in the case of Lizelle Herrera who was arrested and charged with murder for self-inducing an abortion in Texas. Women face prosecution for miscarriages because they're being arrested for "mishandling" of the fetal tissue as in the case of Brittany Watts. Again, her answer might be technically correct, but it's intentionally leaving out that they're being prosecuted for other subsections of the same law. On lifesaving care, no the law often doesn't say that it prohibits lifesaving care of the mother, but it does stipulate it being a felony for anyone involved with providing abortion related services if the women isn't at risk of death for which there's no clear standard or definition. It's medical insanity asking the doctors to contrive on the spot what they each individually think they could defend to a judge or jury for each case. What happens when they guess wrong? It kills women like Amber Thurman and Neveah Crain.

Not ones that prevent from being able to parent. They gave very strict rules to even be considered. I take a medication for migraine management at Bedtime. Amitrptyline. It'd actually an antidepressant used for Migraine management. Doesn't matter why.. because it's an antidepressant medication..I don't qualify to foster or adopt. If you've ever been on antidepressants... disqualified.

That's more common than death by Covid and yet we Destroyed the Lives of Millions out of an abundance of caution. Ectopic Pregnancies are certainly concerning for the 1-2% of women who experience them, and they point here is that they are NOT being denied healthcare as the Democrat Party would have you think.

The point being if you hear these cases, you need to actually look into it.. there is the case in Texas where the mother died and the doctors claimed they faced prosecution if they helped. Turns out the doctors used that as an escape goat because they misdiagnosed her not once, but twice and that led to her death. Cite the sources and I will look into it if you want. When they want you to believe something, they will lie and mislead you to believe what they want you to believe. There is a reason police brutality and race were massive right before 2020 elections and then we go 4 years with practically no talk on the issue, because the party in control has the mainstream media and refuses to let you believe it's a problem, but in 2020 made you feel like you would die as a black American to the next cop you see if you dont go vote. Did they come in office and solve the problem with no policy changes over night? All cops just magically got 75% better in 30 days? Do the hard research yourself and it will shock you how much each party BLATANTLY lies to your face and you were brainwashed for years. @@JenniferLeandro-g2i The medical care they would receive is an abortion (suction D&C). Prior to the ban they were able to always get it. Post the ban however it’s not possible. States such as Alabama, Arkansas, Idaho, Indiana, Kentucky, Louisiana, Mississippi, Missouri, North Dakota, Oklahoma, South Dakota, Tennessee, Texas, and West Virginia require the patient to be in active danger for the procedure to happen. This makes it a timing issue. We have to wait for the patient to be in active danger as deemed appropriate before proceeding with the procedure. Otherwise medical practitioners risk their licenses. This is why there is a decrease in the number of doctors being trained in states with abortion bans. This has led to a Ob/Gyn desert.
