It’s the juries that provide the biggest concerns, I’d imagine. Even if you get a good judge, one MAGA juror could be a problem. And failure in this venue on the state’s part would strengthen rather than weaken his political position. And finding a jury that isn’t tainted at this juncture would be like encountering Bigfoot in the wild. Allegedly possible, but damned unlikely.

If he complies, there are two possibilities: 1) Private deposition: He'll just plead the fifth a few hundred more times like he did last time. 2) Publicly broadcast: He'll throw himself under the bus and then spend the next year proclaiming how "smart" he was when he's on TV, while claiming it was entrapment as soon as the feds show up to bust him for his essentially guaranteed perjury under oath. Both are bad looks for him - his best option to avoid putting himself in more trouble is of course just not showing up. Apparently you're immune to contempt charges if you claim to have enough zeroes on your bank statements (actual proof of wealth doesn't seem to be required - still waiting on those tax returns, Donald). His next best bet would be #1 of course, as pleading the fifth couldn't be used against him in any of the many ongoing criminal investigations. It _could_ be used against him in his multitude of civil investigations though, so its still not ideal (for him). That said, there's an argument for #2 over #1: Making that entrapment claim would cause yet more delays for the DoJ and hold up their investigations even longer. And given that Trump's main goal at the moment seems to be just delaying until 2024 when he thinks he'll both regain the presidency and that doing so would just wipe away all of his crimes, there is _some_ potential reason for him to take this route over #1 (not showing up at all is still by far the better choice though, as long as we keep ignoring those contempt charges for rich white dudes).

BTW I say this almost every night but kudos to Seth and his incredible team of writers for coming up with this 17 minute Closer Look segment, and doing it all after the hearings ended after 3:00 this afternoon. I watched the entire thing and they couldn't have had more than an hour to write this. Bravo and tip of the hat to everyone at Seth Meyers show, this is just a masterful segment that in a very short period of time, I hope they win an Emmy just for this! 👍😎 PS - the members of the January 6th hearing from the House of Representatives really represent the best of American politics, they and their team have done an amazing job of publicly indicting Trump for his many many crimes the worst of which being the attempted overthrow of the US government! #LOCKHIMUP

Even if he does not, Republicans are still poised to regain the majority in the House of Representatives (albeit a slim one). If that happens, they can disband the select committe. At best, this announcement was poorly timed and shouldv’e happened earlier. At worst, it’s a political stunt meant to fool the public into thinging the Democrats are actually going to follow through.

Some points about the graphics: The smiley face on Rudy was great. The white suit is too big for Seth and he needs a vest underneath. The Teams graphic says he's muted but the mic at the top isn't crossed out, so he's not muted.
