If you have a good case in court there is no need for a precedent, it is the good case that makes the precedent.Decision and observation made i a judgment can't be treated as statute. Jurisprudentially speaking, law in the sence of command to do or not to do, must be a reflection of the communitie's cultural norms, not the State's regimentation of aesthetic expression or artistic creation.
