A lawsuit has been filed on behalf of family members of those who died in the 2021 Waverly flooding alleging CSX, a rail company, caused a "deadly tidal wave."

The deadly tidal wave was caused by record rainfall. The NWS issued a Flash Flood Watch the day before, then issued a Flash Flood Warning at 3:29 AM, then a rare & catastrophic Flash Flood Emergency at 7:47 am. The wall of water occurred around 10 am. Even purpose built levees can fail under such extreme conditions. The only sure way to survive catastrophic flooding is to pay attention to warnings and evacuate to higher ground immediately. Don't blindly rely on levees (let alone railroad embankments!) for your survival during catastrophic flood events.

Drainage under the railway prevents buildup simple fix no forethought to the situation with all the rain we have they should remap every railway in the country

Railway ballast bed ALREADY is designed to let water flow freely and drain through it. The water can easily flow through the rocks. This was in NO WAY CSX’s fault and anyone who thinks it is is an idiot. This lawsuit is a pile of crap

Seventeen inches of water feel in a short time - this is "An act of God". The railroad track which links many communities for goods throughout the United States held the water during which time people would have time to leave. Track ballast is not built as a "dam" or "levy". It is usually raised to provide sound level support for trains which are essential for the good of the nation. How about suing developers, the weather office, the nearby road builders... I feel for the people that were lost in this community but this was a flooding - not a man-made disaster! Think about this, who is to make money out of this - how much are the legal firms and lawyers going to get out of this lawsuit? So is America. Sooner or later a dam, power lines, a bridge, buildings, levies, sea ports, airplanes, ...etc... will suffer a failure during massive fires, storms, flooding, earth-quakes, tornadoes, landslide... Should we destroy them all? This is the philosophy in America - if anything bad happens to you... it is not your fault and someone else it to blame for which one should sue. And yes, I am American, and I am seeing my country self-destroying day by day. Over 39, 000 people died in car accidents in 2019, many more were injured/crippled for life - This is also man-made, may be we should remove cars from roads. "Punish CSX, really? How about using money in a constructive way to improve our RR network or if Americans want to sue so much, let us remove all railroad trackage from the country? How sad, lawsuit and legal greed is not the solution, Ciao, L (Veteran)

Not to mention, track ballast is designed as is to drain water freely. Water can easily flow through the rocks. This was in no way caused by CSX

I don't understand why people csx for the flood part of that is the town they a draining system if they don't that's the town what happens if it floods again who they going to blame my heart goes out to the families but to look at the town part of that is they fault if they don't have any draining system

First, yes something terrible happened However, by just chance (because past the 30s very few singletrack kilometers , or the unit of track, has been built or laid down)that LINE WOULDVE BEEN THERE the best part of 90 years, and only greedy landdevelopers are realy to blame, because if you would move in before a deich/floodwall and then crywolf , then the floodwall owner isnt to blame

Even if CSX came in afterwords, it still wouldn’t have been there fault at all! Railway ballast is designed for drainage, water can flow freely between the rocks of the ballast bed. This lawsuit is bullshit.
