I mentioned this at least a month ago… Amber bought a home right before hiring attorneys for the defamation case. She paid approximately $500,000 for it. I thought this was a bit odd coming from someone who had been living in multi million dollar homes. Amber also had Johnny’s 7 million dollars (the same 7 million she lied about using to pay her legal fees instead of the donations she promised). Amber also had the 3 million from Aquaman 1 & 2, and a signed contract for 3 million for a third Aquaman. Right after purchasing this house, she took out a homeowners policy that included a clause that ultimately paid her 6-10 million dollar legal fees. At the same time that she took out the homeowners policy, she took out another policy with a different insurance company (I’m guessing this was an Umbrella policy). The policies were canceled a year after taking them out. Coincidently, this happened to be right after the trial ended. Amber sold the house (claiming she had to sell it to help pay off her debt). I don’t believe this is true. I believe she used the house to obtain the policies that paid her legal expenses. Amber also sold the house for 1.5 million dollars. It’s unbelievable that a homeowners policy will pay legal fee’s over the cost or value of the home. This really exposes them to all types of insurance fraud. Hence Amber and Elaine. I believe Elaine was very aware of Amber’s scheme. I believe this was the reason why Elaine intentionally left out the attorney approved by the insurance company. I hope Elaine retains a lawyer that will give her the same quality counsel that she gives to her clients.

I'm surprised they insurers didnt cap her amount and allowed the figure to get so high. The home was worth very little. I feel like all of these people jumped in because of the trial involving Johnny Depp, the celebrity clout behind the cause. Maybe they felt if she won it would look good on all of them. It didnt work out that way and now they are all eating the money and words. Can you imagine if the courts toss it all back into her lap because of the "malice" ? She will owe so much money.

Elaine has noone to blame but herself for not having help. Ny marines had representation there to represent amber. That lawyer was suppose to be lead counsel. Elaine froze them out, wouldn't share info ect. The lawyer quit and my marine in my opinion stopped being responsible. They provided lawyers and even told them to work with Elaine, but made it known their lawyer was lead counsel due to the arrangements made due to the contract with amber and ny marines

Wondering who on earth would insure AH at this point? Insurance hates to pay out, I can't imagine she's considered a low risk now. I agree with the insurance companies on this one. She was found to have done it with malice and it's not in the least bit acceptable IMO for an insurance company to pay it while she walks away without consequence. I didn't think I'd be interested in this because litigation between insurance companies sounded boring af but you're actually making it interesting and this is the first time I understood fully what's going on. So I'd love for you to keep covering this case and the appeal, too. My opinion so far: NY Marine shouldn't have to pay up if Bredehoft firm truly shut out their counsel and considering they have the actual malice clause. I'm also a petty b**ch, so I wouldn't mind Amber being saddled with a big chunk of the costs overall since she's the only one responsible for this trial happening in the first place, and money is the main consequence she'll ever face.

The insurance crap is so important. Ive been involved in something that the entity I was suing, their business insurance looked at the case and said “nope, can’t cover you on this”…I imagine it’s because they were so flagrantly negligent. then many months later they decided to just close their business. Like that gets them out of their responsibility. Ugh shady folks piss me off so bad!

No, she put up the 500 to say she's going to appeal. In order to appeal she has to put up 8.350 million in case she loses the appeal.

She actually doesn't have to put up the whole judgement. She would only have to put up the entire amount if she wanted to stop collection of it during the appeal process. If the entire judgement isn't put up, then Depp's team can start the collection process regardless if the appeal has been granted yet or not. But she still has to find all that money to pay other attorneys, and that's a lot of money to go through a trial that size

There was a statement from travelers saying they are covering the costs for appeal. Emily commented on it when she did the break down of the insurance companies sueing each other a couple months ago.

There is a difference between the judgement that the court awarded to Johnny that Amber must pay and the legal costs that will be incurred by Amber in appealing the judgement. Judge Penny stated in court that if Amber wanted to appeal the judgement then she would have to put up a bond of $10.35m plus annual interest of 6% to set aside the judgement. However Amber's lawyer Elaine told everyone that Amber was broke and did not have the funds to pay the judgement. So they went ahead with appealing the judgement but now Amber is in default of a court order as she has failed to pay JD $10.35m. Which sort of makes her appeal a bit of a waste of time. However Travellers appear to have agreed to fund Amber's legal costs in appealing the judgement and have appointed the 'best of the best' (i.e. the most expensive lawyers money can buy) to challenge the judgement. However I think that this was really a PR stunt and that even the lawyers are going to have a hard time making a case to overturn this judgement and may well advise their client just to give up as it is a fight not worth fighting with little prospect of success. I cannot see the shareholders of Travellers being very pleased to see that they are so willing to pour so much money down the drain by defending someone who has been found to have defamed someone with malicious intent. If Amber was innocent then yes her costs should be covered (but within limits).

Watching the one insurance attorney who sat next to Whitney ( blonde hair ) watching her face during the trial was priceless…she knew Amber was not telling the truth and her face couldn’t hide it. The insurance attorney was in utter disbelief that when she was caught in an outright lie…she wouldn’t give in and just would say “ I disagree with your interpretation. 😂

I watched the JD v AH trial too, so find all of the personal intrigue fascinating as well. Having represented penny pinching insurance companies, its especially interesting to hear about Travelers paying out huge sums of money in legal fees, etc. on behalf of an insured. Back in the late 80's through the 90's I don't recall such generosity!

I find it madness that someone found guilty of defamation with intent/actual malice is not automatically ordered to stop defaming as part of that verdict. Of course all should have a right to appeal… but until tried successful & as part of initially finding you guilty, how can you not be ordered to stop?! If you don’t, you’re bringing the entire trial, jury & judge into disrepute. And continue to be enabled to punish and abuse the victim of your malice. I get that Depp could have filed his own injunction & civil cases are more about damages/money. But I keep thinking the law surely needs to protect its own courtrooms from exact shenanigans that a defamer pulls to end up being found guilty in first place. AH is now, as a result of being found a defamer, just publicly defaming more people! Depp AND all involved in trial. So Johnny finally got rid of Amber, and tossed her off onto her lawyers, who are tossing their bill onto Travelers, who are tossing THEIR bill onto New York Marine, who is suing both Travelers and Amber Heard? Why don’t they all just agree to shove all the debt back into Heard’s lap, where it belongs. She is NOT worth any of this. She is so toxic, and she will bring down anyone she touches. I hope her car insurance and her job and everyone else just dumps her.

Whilst this is an argument between insurance companies it is the lawyers fees that remain unpaid. As I understand it the total legal fees up to and including the trial amounted to $8m. If the insurance companies are disputing who pays what share the legal firms could be out of pocket by about $4m. So it would be up to them to decide whether they go after their client? With hindsight it now explains why Elaine's firm handed the "baton" over to someone else as they knew that "Amber was broke" because Elaine told everyone. So they know that there is no chance of getting paid by her. Amber's new lawyers are probably hoping that Travellers will continue to fund the appeal but are probably waiting to see what the outcome of this legal fight ends up being before doing too much billable work.

@@jenjen462 Yes it does seem as if both parties are merely adding more fuel to a fire that is already out of control but if one side proves their case then they will probably be awarded the costs of fighting the case by the court. "To the victor goes the spoils" But it is a high risk game and requires deep pockets to fund the challenge all the way through to a conclusion & judgement. Then the other party could always appeal the verdict (and so it goes on). Have you ever read 'Bleak House' by Charles Dickens?

Maybe JD's legal team are just waiting for Elaine to make Amber bankrupt. Bankruptcy will not wipe the slate clean for Amber as far as owing the $10.35m judgement plus interest as it was based on "malice & intent". It is sort of ironic that Amber's chief defendant could be the one who brings her down. Elaine could make more than $4m just by writing a book about what it was like dealing with a client like Amber. After all if Amber is bankrupt she will not be able to sue her.
