Dealing with State Farm now,have a cedar shake roof,which was completely destroyed by hail my claim was denied because they said we did not maintain the roof.I have paper work stating that two years the roof was cleaned and bad shingles were replaced. What they don't realize is im not going to back down...its just not who I am...and yes I'm older,but not stupid!

I'm a public adjuster and former insurance restoration contractor. Years ago State Farm was a top 5 insurance carrier for the way thru handled the claims process, approving additional supplements, etc. Now I would easily put them in the bottom 5 on all counts. I've had more clients file suit against State Farm this year all whom have been loyal customers for 20, 25, 35, and 50+ years!! As someone who battled State Farm constantly, I have stories.

any case files or docs I can use. They are screwing me badly. I do have attorneys involved. Its been insane. What their engineer wanted done, no contractors besides their sub contractor who has no choice would do the work. Then, mold started because of the delays and State Farm ignores it. Mold was reported from the mold remediation company they suggested. Not me ,but I mean its everywhere and obvious.

A conversation such as this interview is ABSOLUTE GOLD. Thank you much for bringing this type of conversation to us contractors. There needs to be more and more of these types of communication on KZbin as the more information out there, the better we as contractors can better prepare ourselves against Insurance companies.

I just spent 6 months in a legal battle with them over my roof claim for obvious and well-documented wind damage. I've never in my life been through such a hassle, with such shady slimy people. It was a total disaster. They denied everything, multiple times. Over 300+ pictures taken, emails exchanged, multiple games played, goal posts moved, rules invented, policy ignored. I got an attorney involved. It took him months of back & forth to get them to finally admit they were in breach of contract. So they came off their wallets and paid for about half the roof replacement. It was a total joke. I took the money on pure principle. I am in the process of switching to USAA now. Not that I think USAA is going to be the Cadillac insurance policy, but it has to be better than the hell State farm put me through. I could write a book on my experience. Every homeowner needs to go watch Dmitry's interview and pay close attention to what John Houghtaling says about insurance companies.

My battle is just starting - same thing Hurricane IAN dropped a tree on our house and 1 car and they only want to "patch up the roof" and we had water coming in during the storm. They aren't paying the claim for the crane that was approved by them to remove the tree!!! I'm stymied. Don't know who to trust anymore. Paid them 34 years and never made a claim - been thru several hurricanes too.

When our customers have StateFarm, we warn them in advance that the level of damage and or the non-repairability of the roof will not matter on the initial visit and that it’s going to be a multi step, multi month process but, as long as I see and know that the damage is legit, we will hang in with them and make it happen even if we need to bring in public adjusters and or attorneys.

Was just approached last week by a PA asking for all of our companies state farm denials. They are turning these over to a large law firm to form a patterning and practice case on denial from SF. We set up a process our company follows specifically to handle state farm denial claims. We have had good success getting a straight denial turned into full replacement, but it shouldn’t have to be such a fight. It would be so easy to set up a website to collect all the state farm denials across the country from contractors and homeowners. The way we document our files it blatantly obvious real damage was purposely overlooked and denied. It’s time someone takes Goliath down!

State Farm’s biggest game and goal is the three D’s! Deny Delay Defend What there mission is, wearing you out before the defend, or even when it gets to the defend. Delaying it when it gets to the defend part , anyway they can! In hopes you just walk away! Or give into a settlement that’s better then what they low balled you on or is. Closer to what you wanted. But the true goal is to wear you out mentally which will then effect you physically ! To where you may decide is this worth my health? What people really need to start doing is going to the watch dogs on news channels when these big insurers blatantly deny claims. Get info from others around your neighborhood who also have the same insurance company. Say like after a storm, hail, tornado etc. To see if there is a calculated system or pattern going on!!! Get it all together, call them out to the public on a media platform! Put a sign outside your house that reads who ever won’t pay my claim!!! This type of outright corruption has been going on for longer then people realize. Do your research on the history of insurance and the government and banks!!!!!

Allstate is really bad about this too. One of the problems is that you don’t know at the beginning of a case how much detail you will need because you don’t know insurance company is going to pull the rug out from under you. My basic stance now is; don’t believe anything an insurance or agency tells you about coverage. They’ll all stab you in the back.
@johnanderson37006 ай бұрын
The other issue is; why is it so difficult to find lawyers who are willing to take cases? I’m struggling with finding representation now; even when they feel I have a case; why is it so hard to find a lawyer who will take your case?

All of it is outta my hands but the LITERAL BAD FAITH OF THIS local insurance lady representing State Farm has undeniably targeted me conjuring up working classification status for one. < didn't know thst was a thing til I rabbit holed this mess. Two. Was never paid a single cent on wreck. 3. NEVER declared a total loss through their claim adjustment In turn. State of VA. Stupid unauthorized " insurance monitoring " and its supposed flawless system has me flagged as uninsured . This was 6 months AFTER the wreck. Car was a total loss for sure. Stopped both lanes of interstate traffic and hit a bridge. Anyway. As long as it has been. In the midst of dmv and their idiocy with making " appointments " during their strung out version of Ol/vid...leaving me to slip into some grey mattered digital abyss that not the previous and lovely agent has addressed. Might I add, her years in the insurance business CLEARLY shows she knew/ KNOWS exactly what she's doing. She will not call me, contact me or communicate with me directly . She continues to " leave msgs through State Farm reps ". I've called the customer service number and several hours in to each phone call, I get shoveled around from specialist to specialist....whatever. It IS always something. Then. Let's also throw in the multiple tickets I'm battling in court BC of all of this. And yes. License suspension so I cannot even be accepted for any insurance as of right now.

Dmitry, Auto claims are vastly under paid as well. Having settled approx 20,000 claims, conservatively. The worse headaches are with the same companies as with Home Owners policies. I literally laughed out loud when Chad Wilson suggested "don't use any with a national ad campaign" I've said the same for years. People have no idea their insurance agent is NOT employed by the insurance company and therefore has zero influence on helping during a claim...with very rare exceptions; agents with a large book of business, have been an agent for a long time, has a client with multiple big policies and knows someone directly in claims management might be able to help.

I was suggested by my State Farm Agent which contractor to use ‘ who is like an adjuster’ who happens to be his close friend and I’m now out of $50,000 paid to contractor for jobs that were done by immigrants learning how to mail Sheetrock on the ceiling etc. I’ve worked with Habitat for many years and Carpenter Hands also and did a lot of the work myself with friends helping me on some things. Our tools ending up missing and the work got worse and worse with not showing to work but maybe 1 person for 20-30 minutes a week. So work was ended though not even close to being finished. I’m 75 yrs old not unable but have lost sleep and health this last yrs of this horrid experience of indignities and destructive, threatening and harmful situations. I took many pictures and have friends that helped me and said I should sue. I’m a Christian and have been with State Farm since 1968 when I bought my first car. My parents had SF too. I have been with State Farm over 30 years. I just had an adjuster come to my house for multiple things going wrong. First our outside balcony in leaking it is topped with a roofing product called TPO. It has holes in cracks and water has come through the dry wall under the patio. Water has come through our door and we have water damage inside too. We also have hail damage to our roof. My roofer provided 88 pictures of the damage. This adjuster had an agenda to turn everything down. He never bent down and looked at the floor of the balcony. Only stepped inside to take a couple pictures. While he was outside he pointed out my cargo trailer has hail damage but tells me we aren't covering anything you have no hail damage on your roof. I said sorry I disagree with you I have had 4 roofers here and all said I have significant damage to my roof. I said I will contact my attorney. He also said with the balcony we did not maintain it. Oh and by the way I have always had a $1000 deductible. When I moved back to Arizona no one ever told me my deductible changed. My deductible is 1% of the value of my home. So my deductible is almost $6000!

American Water has Travelers Insurance and they says it is not American Waters fault. Well the Insurance Company and American Water is the only one who can say is at fault and it always not their fault . The sad thing is it happen again in July 2022 and the same story is not their fault. The first time forty homes were damage the second time over twelve homes damage. Travelers would send in cleaning crews to clean up but would not pay for Damages . You would think if they would pay for the clean up that would be admitting they were at fault for damages... One thing to note is that the individual adjuster often has no settlement authority. They are told what to do by their manager, or managers 3 or 4 levels up depending on the claim size and really have no say.
@soulfireonfire6423 Жыл бұрын
Well they may not have the last word, but people choose what they want yo be silent on! Claim representatives do have the authority to pagnout on claims without any interaction with their immediate and other levels of management! But you are correct whe you say depending on the amount! Not in the sense of needing approval because it’s over a certain amount . But most definitely because it’s hit that level of monetary value in payout that can start to have an impact on the bottom line concerning pay in and pay out! But that the only reason when it hits that mark it goes to a mgr. Weird how it’s so similar to the FIFTY. yr old mark in midlife crises right!

After hurricane hit, PA made a claim and they sent an adjustor that said damages were normal wear and tear (torn shingles ious areas of roof).So they initially denied the claim.we figured that they were being honest in their assessment and thus believed them. Sent the PA reviewed the report that was given to us 18 months prior and read it to adjustor. Said we are ready to go to court. They paid out in full. Chubbs will deny claims to any extent regardless

I have been in this industry for a long time on both sides. The fundental issue is. The materials of a home deteriorate over time and just because a storm comes and causes some damage that does not mean the entire cost of repair is to be paid by your policy. You have a roof that is 25 years old to being with your policy is to put you back where you were prior to the storm which would be with a 25 year old roof.

I’ve been a contractor for over 20 years. When making the first payment you do anywhere from 10% to 1/3 max. On a typical roof you do a third up front and third when the materials are on the ground and a final payment with the roof is done and everything is satisfied
@johnm34352 жыл бұрын
I tell everyone I come across to never do work with a contractor if they need ANY money before getting materials. Once materials are invoiced and delivered is when the first payment should be done. As a roofer I’ve seen so many homeowners pay roofers that first 1/3 before materials and then that roofer never answers their call again.

It’s also difficult to find attorneys who will really help when you need help with a case. I’m struggling with finding a lawyer to help me sue my insurance company for bad faith; the legal system tends to really protect insurance companies even when they act in good faith. Lawyers aren’t interested in helping the insured unless there is a massive profit in it for them. Where do we find a real advocate when insurer has acted in bad faith?
@getinthecar36242 жыл бұрын
That's to bad insurance companies don't have anyone with basic math skills. We're just paying for attorneys, which I'm sure is cheaper than paying the homeowner(eye roll).

3/4 PAs don’t know what they’re doing. They copy and paste or use macros and Triple up on the same line items, add items that literally aren’t covered under the policy, add O&P to everything even invoices for jobs already completed, and never even worked around roofs until becoming a PA. Some adjusters are the same. But being a roofer and now an IA I’ve seen more bad public adjusters than any other profession in this industry. Contractors and GCs are usually so much better at their jobs.

Any case files or docs I can use. Colorado case. Roof collapsed when roofer was working on it.

At the 30:00 mark. He’s not 100% correct at all. I know many independents that go out for re inspections and appraisals who end up adding much more to the initial estimates. I personally do this all the time. Hell, I’ve even added $30-50,000 to the initial estimates just from looking at the prior adjusters pictures. It’s just not true that on re inspections and appraisals that all insurance carriers do not add anything more. Maybe SF and Allstate type companies but that’s definitely not every insurance company.

Roofers should start recording the adjustment and inspectors from state farm while on the roof..if they say no then get the owner of the home to go up there lol..just to have proof of how crazy they are and the video evidence will shoot up a thousand fold and make headlines of rampant state farm shenanigans and hopefully state farm and it’s management will get dismantled and legal action takes places on the higher ups making those dumb decisions…they are supposed to help but it’s completely backwards and they do more harm then good from their inaction…I will even bet embezzlement of some sort is taking place in state farm and all that insure money is going into pockets making people millionaires or billionaires… I really hope it happens and those evil scumbags go to prison lol

In my opinion… this lawyer doesn’t understand WHY things have changed… nothing is as simple as it seems. State Farm was not created to be profitable, it was originally a mutual company. That means the customers own it. That’s why State Farm had such a good reputation for years. The problem is the employees and management started paying themselves a lot more than market rates for employment. I worked there twenty years ago and everyone except clerical was required to have a 4 year degree and the lowest paid person was making 75k. Ridiculously high pay for 2000. So the overhead of State Farm is huge. Also, the insurance policies and price increases must be approved by the states insurance commissioner. So the insurance commissioners have stopped approving price increases…. They need money in order to pay the employees and the high end corporate office space. Keep in mind, your local Agent has nothing to do with this. They decreased pay for the Agents offices and pushed more work on them while increasing their own salaries. Almost all of these problems are dependent upon what state you are filing a claim in because they have separate corporations for geographic regions. They separated the companies after hurricane katrina because the federal government wouldn’t allow flood insurance to be sold there and then the government told them they have to pay.

I have a really really strong feeling that this lawyer does understand EXACTLY, why things have changed . But he’s a LAWYER! So he knows exactly what to say, when to say it and most importantly WHEN NOT TO SAY things and when you NEVER say certain things! Especially on a world wide social media platform. Regardless of what State Farm was, when it’s original founder started the company, has absolutely no bearing when your in a court room , fighting a case with a multi billion (. x10 , if not more) dollar company. It also doesn’t have any significance on the subject matter at hand. Whatever they used to be decades ago, has been overshadowed in regards to what is being discussed in this video. Overshadowed by something that’s entirely the opposite of what the product, the core existence , and what their brand and logo all stands for. The opposite of what the insurance contract that the company is selling , that the customer pays for and specifically states , what you get in exchange for that money! There’s is definitely some things you stated that have just are glaringly irrelevant and it really throws up a red flag . Just the magnitude, of just how irrelevant they are , makes me question your motive! For someone who is pointing out the connection you have with insurance in order to reveal you’re somewhat knowledgeable in the industry, the excuses you keep giving for their inexcusable business practices, are at best , for me anyway, irritating Fir the simple fact if you are telling the truth, you have worked in the industry for decades! It’s mind boggling. BUT ONLY FOR A MINUSCULE of a sec then it’s nothing but this HUGE RED FLAG! What the company has paid their employees has zero to do with anything! And the employees don’t and never have , had any interaction whatsoever. regarding their pay. except their performance as an employee. That’s why an employee has meetings/reviews during the cycle of the year. Beginning, mid and end of the year! To go over expectations , new personal goals, and the companies country wide goals which all have an impact regarding your final performance review at the end of the year. But in no way whatsoever does an employee of SF, dictate and initiate and approve what they get paid. They don’t pay themselves. Or have anything to do with it and never did. currently have! Except in their performance it’s self! But even if what you said was remotely true, still doesn’t have any relevance, bearing, motive, reason or excuse on the subject matter being discussed! You are not getting it!!! Why is that? This is very simple to understand common sense wise but is even more blatantly connected integrally, ethically and morally! !

Let's be honest. 95% of contractors are looking for quick pay day to keep their wife off their back or to get out of debt. In their eyes everything is damage. The integrity in that industry is at an all time low and contractors would agree with me on that statement! It's to the point that I don't even acknowledge contractors when I inspect a loss. Nothing you say has any meaning to me. On the flip side, there's a boat load of incompetent adjusters. Companies don't pay their competent adjusters a fair wage for their skillset. Insurance companies do need train their staff yearly and pay a fair wage.
