I haven't seen anyone else do this type of interview so this was a real eye opener to how it all works. Here in Australia, as long as you have comprehensive insurance for your bike, it's up to the insurance company to claim against a person at fault, whether they have insurance or not. However, all the rest of what the lawyers suggest is food for thought particularly the keeping of records, photos etc. Brilliantly done.

Great interview Craig. One that should have appeared on line years ago. Keep thinking of these types presentations to present new information to your fellow riders. And, I think I'll go ahead and add the lights to my bike. Tires, I'm pretty good at keeping them up to snuff.

This was a good discussion of a topic that many don’t pay much attention to. It is particularly important to have the uninsured/underinsured coverage particularly given the millions of illegals who have come into the USA of late who very often are driving without even a license let alone insurance coverage.

The irony of lawyers criticizing insurance companies. I’ve had my share of experience with both and I’d have a hard time picking the lesser of the evils.

At age 63, I have now had to Insurance claims in my Life. I have now hit and killed two Deer with my Yamaha FZ-07. One in 2019 and one in 2024. DairyLand did pretty well to respond to my claims. They have the most competitive Premiums I have found.

I'm in NY State specifically in NYC. In early October 2024 I took my g/f for a short ride b/c she has not been up to riding b/c of back issues. We only went 30 mins out and 30 mins on return. While we were stopped at a traffic light waiting for the green light a driver bumped us from behind. My g/f started yelling, then she started to feel her back hurting. I was very angry b/c the driver had no reason to bump us b/c the traffic light has not turned green to go. I had my g/f dismount off the bike and stand on the sidewalk and I'll call an Ambulance. I and the driver pulled to the side of the road. I asked for his documents so I can take a photograph of them b/c Police don't show up to the scene anymore here but he refused to hand them to me. I told him he was required to hand them over for a quick exchange but he kept refusing. At this point while my g/f was in the back of the Ambulance getting her vitals done. I was speaking with the other EMT and we both notice the driver not standing straight and continuously repeating himself to me saying "These things happen and I don't want to be a pain" even touching me on the shoulder like he was my buddy. I asked the EMT if he appeared to be intoxicated and he agreed. At this point I requested that the EMT call for Officers on the scene b/s I wanted the driver to be checked for sobriety. The Officers asked me a few questions and walked over to the driver and they were questioning him. An Officer came back to me and said they were requesting a Supervisor on seen. They searched his car and a few minutes later I observed they were hand cuffing him and took him away. The Officers allowed me to leave and met my g/f at the Hospital where she was in a lot of back pain and given Morphine and muscle relaxant.. A couple of days later my g/f obtained a big named counsel. They were going through the motions of getting all documents and any information to proceed with a case against the driver. Two weeks later the firm decided to drop the case b/c there would only be a minimum compensation of approx. $25k but after paying all the Medical bills and the Lawyers cut there would be no money left to make it worth the outcome. They said b/c of the "No Fault Policies" in NY NJ. My Insurance was not willing to pay and damages b/c the accident was 100% the drivers fault. Supposedly the Lawyers were to go after his Insurance and the driver. She is still feeling back pain.

I guess the Yellow suit and equipment does matter , maybe not on stats but in case of insurance issues.......also a break free on the helmet increase visibility , type of passive protection that can matter .

I notice they didn't talk about damage to the bike - which would be a higher proportion of claims in countries where medical care is free.
