If you use social media influencers to advertise your business or brand, you’ll need to comply with some legal requirements.
The requirements vary by jurisdiction, but here are 4 general guidelines that will help you use this lucrative advertising method compliantly.
1. Disclose material connections - The public needs to know that some form of compensation is given to the influencer by your business in exchange for the promotion of your business. Every separate post or promotion that’s done in exchange for compensation must disclose this.
Note that compensation can be anything of value, from money to free products and discounts.
2. Use clear and prominent disclosures - When disclosing the material connection, do so in a way that’s very clear and easy to notice. A common way to do this is to use hashtags at the beginning of a post, or add a disclaimer screen to the beginning of a promotional video.
3. Ensure endorsements are honest - Make sure that anything an influencer says about your business is accurate and honest. Sweeping or misleading claims or statements must be avoided.
4. Create a Social Media Policy - Having one of these policies in place will help ensure any influencers you work with will do the previous 3 points. You can use this policy to spell out your requirements, and have influencers agree to follow them.
