I got banned from ebay for selling ivory…that was carved into shapes for jewelry in the 40’s. I thought it was bone, not ivory from tusks. I do not condone killing elephants for their tusks, but now those elephants died to end up in the trash. I cant bring those elephants back. And i have POUNDS of ivory that i can’t do anything with (they’re all carved into cabochons for earrings and pendants) i cant do anything with (that i didn’t buy so its not a loss, i just see it as a waste). For those curious, i cleaned out an old jewelry store as part of a job i did and the new owner said we could keep anything we wanted (it looked like all trash, the equipment and heavy displays were already removed). But in the back we found a case of little drawers (like tool box drawers for nails and screws) filled with this stuff that wasn’t labeled with anything except stickers with dates like 3/1941. Like i said, i assumed it to be bone but a pair of earrings i had sold was reported as ivory. This was in the early 2000’s ebay. Maybe i wouldn’t have been banned now, i certainly stopped selling immediately, but i was banned completely back then. And for those not in the usa, there are federal laws against selling ivory but i do not know the exact rules. I was just kid who thought i hit the jackpot, free stuff to sell on ebay. Instead my fledgling ebay career of random stuff before this (at the time i had a 100% rating with a little under 500 sales) was completely ended. I never went back, not even to buy. I felt railroad and was treated like i had killed the elephants myself, mind you i was in my early 20’s, this was all new to me. So, LSS, im glad you got your business back, im sorry that you had to pay so much but all in all, a happy ending for you.

My account was hacked on ETSY and someone listed fake LV handbags. It was a mess to get them off. I had to minimize the photos so they wouldn’t be seen and I had to convince ETSY that they were not mine.

Going after the little guy instead of the big multinational company that was pushing them. There should be a law against this. They should have to prove malicious is tent and conspiracy. Anyone can pick up a counterfeit item and not know. Mom and pop resellers need to band together to get laws passed for protection from this kind of nonsense.

This woman seems like a very kind woman, and I am happy that this went smooth for her. But if you are in the business of selling things, you have the responsibility to know whether or not you are selling counterfeits. After all, this is their business. So if someone sells me a counterfeit but tells me it’s legit - I’m suing them directly. However, with that said, I fully support people like this woman going after those that sold her the counterfeit.

Years back I bought a kodak camera. Sold on ebay for about $50 or so. Back in the early 2000's. Turned out to be fake. I had no idea as it was a really good counterfeit. The buyer let me know. I paid return shipping and refunded. He was kind about it and understood. I've received counterfeit items before and handled the exact same way. You can usually tell if the person is trying to scam or if they really did not know. Why sue someone for not knowing???

Whether it’s a contractor that built your roof, a nurse that gave you the wrong pills, or an eBay seller that sole you a counterfeit - it!s their jobs to know. If the middleman sold me something fake, I’m seeing them. Then these sellers can go after the people whom they bought it from. That is the only reasonable expectations. @@ONLY-CARS-FANS Not really eBay is designed for a disaster. Sellers are forced to offer 30 day returns on used items if they need to protect themselves from negative feedback and scamming. Who gives 30 days warranty on used items on other retail stores? No one does but eBay. It encourages to make offers and negotiate which is often a disadvantage to sellers. Buyers can return item and scam you, all they have to do is say item not as described. They can send you empty boxes and get full refund from eBay and there is nothing you as a seller can do about it. And if nothing works, buyer can open a claim with their credit cards to say they don’t recognize this transaction. There are so many ways to scam people on eBay and eBay does nothing to help sellers or making their platform better. It is a paradise for scammers and yes there is tons of money for them

Amazon is notorious for selling and allowing their secondary sellers to sell counterfeit items. Bogus beauty products is a multi billion dollar business and Amazon sells a ton of them. I have personally bought several items that didn't even have a tag on it or a box so I know that it was not legit. I would really re-think buying any more Amazon bins. I think the best answers for resellers to stop buying Amazon bins. Or random bulk pallets. The same thing that Amazon will kick people off or they go and resell to other people. That’s just dishonest and I don’t wanna do business with that.

Companies can file copyright claims against you without any evidence. I won't get into details, but one of the big 3 auto makers tried filing bogus counterfeit claims against inventory I had because I was selling it for less than they were. I provided receipts showing the inventory was purchased directly from one of their dealerships and hired an IP lawyer to send them a cease and desist letter. They backed off this time, but I know my days are numbered, I even make mid 6 figure sales on ebay a year, but even I don't have the unlimited funds required to fight major US corporations.

I had a problem about 5 years ago? maybe 4..? Anyway, a Barefoot Dreams attorney contacted me through Ebay messages, all that, as did Ebay at the same time, just like with you... only i had new products, purchased from local retail, brand new. This happened to me last year, I totally get what you mean about the emotional roller coaster. The judge in my case told my lawyer that these are BS lawsuits and that he thinks they should be illegal. These are essentially legal sanctioned scams on small businesses in the US.

To clarify, the item I sold wasn’t even counterfeit. Apparently it infringed on the IP of another item because of words used in the listing. Total confidence tear down. A year later, I avoid most items I am not very familiar with. Also, about the LLC, if you are a single member LLC, your assets are not protected. I was confused about this as well. Having an LLC did not protect my personal bank account from being at risk.

You can not serve anyone by email. A letter can be sent via email. However, under the Court Rules, pleadings need to be sent via Regular & Certified Mail. This is done to confirm that the other party has received the documents.

Yes and that's what the attorney said. That he didn't serve me properly he did it very lazy but if I corrected him or called him out it would have just bought me a couple days for him to serve me the right way. I rather comply and move on.

Ultimately it costs money and time to serve someone how they are supposed to. Sending an email to over 200 people as a "heads up" along with locking their accounts is enough to get anyone's attention.

It would probably be wise for her or anyone else who sold this particular item to recall it and refund the buyer. Since the product is meant to be used to save a choking baby, heaven forbid it fail because it’s a fake. The implications and potential law suit that could generate is chilling.

Please be aware that you are now on their list of payers - you are ripe for further blackmail so expect another in 6 -8 weeks, different product same lawyers - Everyone needs to be on the DAILY PAYOUT and you should diversify - sell on other platforms etc - EBAY will throw you under the bus.

Resellers make a living doing this. It is a business, making profits. If they are selling counterfeits... it is reasonable that they be sued. As a consumer, I am reporting and/or suing the person who sold me the item, claiming it was “authentic”. There HAS to be some level of accountability for sellers. Otherwise sellers need to put the disclaimer on every single listing “this item could potentially be a counterfeit”. The only reasonable expectation is for buyers to sue the sellers. But that includes eBay sellers - they should then sue the companies they buy from.

Amazon did this and they likely knew they were getting rid of fakes and they sold them first to end users and then to resellers who are not trying to be dishonest in any way who were unaware. Will Amazon be held responsible? They did this maliciously and knowingly. They are the people who fully understand the law about this issue and knowingly and willingly make sure that people obey them regularly on their platform. But when they know something is fake and they resell it OK because they are passing it onto other sellers?

If the items you had are actually fake ( did they prove that ? ) they could simply vero your listing and ebay shuts it down and tells you not to list again. I am skeptical if what you had was actually fake. They could be bullying others, see it all the time.

I only shop from the original stores/brands online. I then ask them for the same pricing as Amazon with free shipping. They always match it. I have no desire to have “fake” products in my house! Tragic if someone tried to use something and was injured. I can’t imagine that lawsuit!

If Amazon is dumping a lot of something at the bins, LEAVE IT ALONE. The odds are too good that it's fake. That said, they should be making allies of small sellers and not suing them. I sold on eBay for 18 years and never dealt with this, but most of the items I sold were things Grandma stuffed in the back of a drawer or closet 40 years ago. Often the company wasn't around any more. I didn't touch Tiffany more than once or twice, and the first time was enough to run me off their jewelry.

so, I every once in awhile sell something on ebay but its always something I've had (like maybe an inherited Hummel for example) so does one need to be hesitant on everything? Like literally every item in the world unless homemade is under a brand name, this sounds scary.

I wish I knew the best advice. Just always be cautious. I never knew that so many things could be counterfeit but now I do. So just look carefully at labels and markings and quality and use your best judgement. Not everything will be fake, but everything will be real 🤷

At the bins if you find a large number of the same item, then stay way from them because Amazon had a reason to discard them all. I remember someone was buying up all of these earbuds. I guess he had 100 or more. He was going around and asking people to help find them. They were all knockoff Apple ear-pods. Water filters will also get you banned quickly. That's exactly my new rule when there is a large amount of something chances are it got pulled for a reason. Sometimes it could just be overstock like today was a bunch of laser tag games. I doubt they were fake but probably just not selling.

Not always the case one part of selling through amazon warehouse is that if you stuff don’t sell in a certain time frame it hits the bins. That is why you had all those sellers that would give their products away for reviews and then they would change the item that was listed. For example those times when you see a hair brush for sale in amazon but the reviews are for a curling iron. That hairbrush was in warehouse too long and was going to get pulled so it either got pulled or seller gave it away by selling it to somone in return when they got a 5 star review from them they give the person the money back. They buy ratings this way. But those sellers can get in trouble for it and get their stuff pulled and it all hits the bins and buyer will also lose their amazon account I know people that were doing it. So when you see many if something it’s not always fake but if it’s name brand yes it’s more then likely fake because big name companies would not fall under this and let their products sit too long to ever end up in the bins in large quantities. Can you find valid brand name stuff in bins yes but not multiples

I once toyed with the idea of selling on eBay but saw what sellers had to go through to realize even a small amount of cash. Now that you've raised the issue of potentially being sued, I think it takes an even tougher constitution than I imagined to make a go of it on eBay. I "love" eBay's holier than thou attitude. Remember when eBay had one of the biggest data breaches in history in 2014? The company only announced the cyber-attack 2 weeks after the breach! So, you are treated like a criminal for something you had little control over, but eBay remains relatively silent on an event that affected 145 million accounts.

99% of sellers go through taking pics, listing the item for free, selling the item and making money. If you're selling socks you probably won't have any buyer problems. If you're selling $500 record albums or hunting knives it might be a little more challenging but even so probably still profitable.

Those Illinois District courts are on pretty dubious grounds legally speaking - the Columbia law review has a great feature if you search 'A SAD SCHEME OF ABUSIVE INTELLECTUAL PROPERTY LITIGATION'. We just list everything we sell as USED even with tags and invoke the first sale doctrine, codified at 17 U.S.C. § 109. If eBay had categories - Unused with tags or Unworn I think most resellers would be better protected

Thanks so much for posting about this article. I think a lot of us are going to come up against these things in the future. Some companies are suing resellers for photographing their logo on an authentic item, and using that photo to sell on the resale market. They are saying that their logo is intellectual property and simply using a photo that YOU took yourself is a violation. This has to be stopped or there can be no reselling. Seems a good way to do this is to call out these companies for being “non green”. No quicker way to start a brand boycott.

eBay, Amazon don’t care if sellers sell knock off or trade marked bootleg items. As long as they make money from transaction: they really don’t care. eBay has the audacity to write in their terms of service that counterfeit items are not allowed but they sell them every day

I had etsy shop and ignorantly listed a Gucci handbag i did not know was counterfeit. A shopper notified me because no serial #. I did not know real Guccis have serial #s. I removed item and that was end. Etsy also scolded me for listing an elephant hair bracelet that i bought in 1970s. Elephant hair is taboo like ivory.

I was just accused on Poshmark and I was shocked. They reversed it and apologized. I was selling Bellagio Hotel Slippers and they thought It was counterfeit Balenciaga for $13. 😂 But they were ready to close my account . Very serious issue . Thanks I'm sorry you had to go through it.

I hope you get your confidence back because you’re a good person. You didn’t know that it was counterfeit. I came across something similar to the situation you’re going through and I no longer sell after that I said forget it. That’s how bad it hurt me as far as confidence, so good luck

You can still get sued with an LLC. You tuber Rockstar flipper was sued and he has an LLC. He just recently was talking about these companies sueing people in big sweeps, like what you just been through.

You can still get sued but they can't go after personal assets. That's the perk.

True. Unless you have ever, even once, combined your LLC funds and your personal funds. Your LLC has to operate as its own entity. If you want to get funds out of your LLC for your personal use, you have to write yourself a paycheck as an employee of the LLC. You can never pay a personal bill or buy anything for personal use directly with LLC funds. Even one time will cause the courts to consider LLC funds as personal assets therefore allowing all your personal property fair game in a lawsuit. This is very important! Be careful. If you’ve ever done this, dissolve your current LLC and start a new one. Not legal advice, I’m not an attorney. I just know someone this happened to. Consult your own legal council for laws in your state.

@@gdhxhshshhnzgz4864Not entirely accurate. You don't have to pay yourself as an employee (with associated W-2, payroll taxes, etc.). You can simply write yourself a check from the LLC account as an "owner draw" and the LLC remains separate from your personal assets. Like you said, you cannot pay personal bills using the LLC account. But you can pay business bills with your personal account and then have the LLC reimburse you as long as you keep records and receipts.

If so, then the outcome of this case was very reasonable compared to some of the horror stories I've seen of other accidental infractions online. Glad it all worked out for you. Id just ignore them, I have multiple accounts on multiple websites so if someone tries scamming me I just remove my payment method and if they try and take money from my bank I call them and say I didnt give them permission to have any of my money and the bank refunds it. And I keep no money in my bank in case they steal my money, and if they do, my account goes negative and I dont pay it and use one of my other banks.

My daughter bought a box of CDs and there was a counterfeit AC/DC cd in there. It was a pretty good looking fake apparently made in Russia. The way we found out was by trying to research it on discogs and they were like " This is not allowed to be sold here" So we were like hmmmm...and did more research

9:14 The reason you couldn't tell it was "counterfeit" MAY be because the manufacturer of the "real" Lifevac units and the counterfeit units are one and the same. This has happened with "private label" sellers on Amazon. Their Chinese manufacturer sees their customer's product is selling well and decides to market it themselves for less thus eliminating "you" the middleman and netting themselves more money. Since Covid China's economy has been in a tailspin and has only gotten worse so it would not surprise me if we start seeing more unscrupulous behavior from Chinese manufacturers. Also, the attorney didn't include a nondisclosure because he wanted the word to get out that selling a "new" Lifevac product obtained from an unlicensed third party can put your livelihood at risk.

Yup. I had an item I purchased directly from a brand for sale on a platform. I had purchased it for myself, decided I wouldn’t use it and decided to list it for sale. We’re talking about a rather inexpensive piece of clothing. Anyway, I get a message from the platform saying the brand flagged my listing as a counterfeit. (Again, I bought it from the brand website & we are talking about a $12 item) I wrote the platform & the brand. Asked the brand “is this authentic?” Brand says yes. Sent this info to the platform who immediately changed their tune saying “it’s not a fake, it’s just authorized for resale.” What. The. Hell?
