Yes, and it's been confirmed that the US was at Defcon 2 during the Cuban Missile Crisis, allegedly the only time it's ever been Defcon 2. I sometimes wonder, however, if we were at Defcon 2 also during the Able Archer/Autum Forge '83 incident in 1983, when we came perilously close to WWIII, due to Soviet misapprehension of a NATO exercise. Much of that incident has been declassified, and after the dissolution of the Soviet Union, we were also able to acquire some of the Soviet documentation related to that incident (much of which has even been translated into English and is public source now). It's always possible that there have been other times we've been at 2, but they haven't yet been declassified.

How ever, as an attorney, they should realise when the fight is lost and switch gears to limit the damage for their client. In Nick’s case, all he has achieved is demonstrate that he isn’t taking responsibility for his actions and this could increase his sentence.

The thing is, even if it WERE a good argument, the judge has to overcome the urge to rule in favor of where the evidence ended up being. Any judge is going to WANT to keep the warrant valid since cocaine was in fact found. All of the human elements were working against him. If all of the claims of his motion were true, which they weren't, I would still have bet against his case.
