Worth noting that you should always carry any documentation outside the locked case (in your wallet or purse ideally). Reason is that if you are stopped and asked to produce it, under no circumstances can you open the storage case. The only places you can open it legally are at your home, an authorized range or gunsmith's or at a police station. Even if requested to open it by a police officer, you can't comply during a roadside stop. You'd have to request escort to the police station and open it there. .. So have your docs where you can easily access them.

I heard when I was taking my PAL course, of someone who got charged because he was carrying a non restricted firearms without trigger lock. Apparently it happened a few times other people also, lack of law knowledge by the officers. So, yes your day will be ruined and firearms taken and such, but No it will not hold in court and the charges will be dropped. so do yourself a favor and put a trigger lock on your firearms when transporting in case you run into an A-Hole of an officer.

yeh they just need to be cased now no trigger lock, but DNR and rcmp here are trying to tell people, they have to get a permit just to transport their bows, and can not shoot them in a grvel pit, and have to be a member of an archery club,,they reword the laws on how they want them to go, since most people think the police are right, if they are fined and just plead guilty..

That happened to friend a few years ago. Got handcuffed and taking down to the station. Then was released without charges. Although he wasn't charged because he did nothing wrong it was a horrible experience.

FYI the cop doesn't charge you they arrest you, and the Crown Prosecutors decides to charge you or not.

I love your videos as always, Rod. Informative and succinct. The other point I want to make is that, as mentioned in other comments on this thread, it’s true that the RCMP (and I’m guessing other police forces in Canada) do not always know the gun laws they are supposed to be enforcing. I’ve encountered this twice in my lifetime. I respect that the RCMP have a hard job to do and that they don’t always get the thanks that they deserve, but yeah, some of them who may be ignorant of the laws can cause some undue stress for legal gun owners.

Note that some ranges require all guns to come onto the range cased. So even a NR gun may need a case anyways.

@@stevemisfit1 You really should because as I am sure you know that NR's only requirement for storage or transport is that it be unloaded and out of view, if possible. That's it. There are always going to be guys that go full on ridiculous when given a bit of power, like the one who was dogging you over nothing, I bet he is in charge there right?

The one thing to add to this is that some provinces have additional requirements. NB,NS,PEI, and I believe NFLD have DNR laws that apply to transportation as well. In NB you cannot be in possession of a firearm in your vehicle unless. A.). It is a hunting season and you have a current license for that season, and the caliber is appropriate for the season(varmint season is .230 and under only) B.) You are a member of a gun range and going to and from. C.) You have a permit from DNR for a specific datre, time, and place. After sunset your firearm has to be cased and unloaded and locked.

It was asked before, but what if you dont have a vehicle, but are within walking distance of where you plan to shoot? Are you allowed to walk with a gun/gun case to you destination?

Could I carry a firearm by bicycle ? (unloaded, locked by cable or trigger) and in a bag that conceals them. This question is for both restricted and non-restricted firearms going to a range or gunsmith.

Your videos are awesome. I think some more useful content would be how to become a PAL/RPAL trainer, and gun range legislation specific to opening your own range indoor or outdoor. I’ve been going through all of that recently and it would be great for some of that content to be explained for others in the future

Pauline Weinberger they are not a result simply due to second amendment, it’s an issue of mental health. Otherwise we would see them in Canada as well because there are a lot of gun owners in Canada too.

Thank you very much for this video Rod, but I think we should mention that any Canadian that owns a handgun, restricted or prohibited knows everything that you have said here like the back of their hand. It is the non gun owners that don’t have a clue.

FYI, Folks these are the Federal laws enforced by the RCMP or local Police Dept. In New Brunswick, Non restricted firearms also fall under provincial law, which is enforced by DNR (Dept National Resources). In New Brunswick; without a range membership, you are only allowed to move your firearm with a valid hunting license, 48hrs before the season opens, to 48hrs after the season closes. It must also be unloaded, cased or in a locked compartment. So if you have a varmint or bird license, you are allowed to move a rifle under 22cal, 24hrs before the season opens, through the season, until 48hrs after the season closes. Any other movement of a firearm outside of hunting season; even buying a new gun from a dealer, will require an Authorization to Transport, which can be obtained from DNR.

Glad I am an American citizen. In Nevada my loaded handgun can be on my side almost anywhere I go open or concealed with my CCW permit. And my AR-15 can have a full magazine inserted on the front seat of my vehicle as long as there is not one in the chamber. Or one loaded in the chamber if not in my vehicle. With any size magazine I choose.

I have a couple questions and a comment. First, I love your videos! You should consider running for politics. We (Canadians and gun owners) need a guy like you to represent us. The question I have is, I own a Nissan Titan truck, it has a fiberglass cap on the box, however despite the window above the tailgate having two locks, a lock on the tailgate and locks on both side windows, I do not feel comfortable transporting my firearms in the box. I welded a half inch thick steel plate box that is attached under the back seats. When you lift the seats in the back, there is a complete steel box with a lock similar to a dead bolt, once that is unlocked, the lid lifts up in the same manner as the seats. Inside the box I have that foam insert stuff, the same as a gun case. When you open the back door and look in, there does not appear to be anything unusual there because I even put the same carpet on the outside of the box as the floor of the truck. Would this receptacle be considered sufficient for transporting restricted firearms? It is a completely sealed half inch thick steel box that is bolted to the floor of the truck from inside the box and it is pretty much hidden.

Hi, When you said "lockable" to the Pelican case you meant the 2 or 3 snaps being snapped shut right, or does the case holding the locked restricted firearm have to be "locked" with a keyed device too? Great Vids btw. Thanks and keep em coming.

Great video, good review for current PAL holders and valuable info for anybody looking to get a PAL. Just a quick question though, is it legal to have ammo ON your gun during storage or transport? (as in a side saddle on a non-restricted shotgun kept in a locked container)

If you have your gun in a locked case you have exceeded the law. You will be fine. Just no ammo inside the gun, then it would be legally loaded.

I had a guy tell me on the way to my shooting range I can not stop at cabelas for ammo I can only go from a to b then b to a so he was trying to tell me I can't stop for ammo... I thought that was pretty silly as its a gun store.

ATT's regulate the transport of Restricted firearms, however in some provinces such as NS, NB, NL, and QC, the provincial wild life acts stipulate further restrictions on NON RESTRICTED firearms such as when and where you can transport them, and state you need permission to transport from the province if you don't fall into pre set categories such as transporting while you have a hunting licence, with the caliber for the animal your hunting, going to the range, and or taking a gun home. There was a post on CGN about this in New Brunswick.

As a driver I'm pretty sure they can question you and search the vehicle as they see fit. As a passenger you have more rights. Technically, if it were a traffic stop as an example, you don't have to ID yourself. Speeding from a bank robbery is a different story.

Very informative video! You mentioned you can legally transport a borrowed restricted firearm with an LTATT to pretty much any certified range (with invitation). Is it possible for a friend (in Ontario) with an LTATT to transport a "borrowed" restricted firearm to a range while the owner (without any ATT) tags along with him?

I had a question re: transporting a shotgun. Both of my 12 gauge shotguns have side saddle shell holders. Is the shotgun considered loaded if shells are in the side saddle and trigger lock in place? Absolutely, if you have a car, lock it in the trunk. The doors have to be locked. No trunk, out of sight, doors have to be locked.

I'm not 100% sure on this but in Québec, if you were to be stopped while getting a pizza, the officer could consider it to be a non essential stop. What would be an essential stop? Let's say you are out of gas and can't make it home otherwise. But like I said, I'm not 100% sure. I know that we, over here in Qc, have Law 9 which makes transporting that much more complicated especially when it comes to public buildings (government or municipal) and schools. Which are complete no-nos for PALR owners when transporting firearms. I think a great rule of thumb when carrying any type of firearms but especially restricted ones, would be to carry them from your house to the range/hunting spot/gunsmith and back only and then after that you go back out to get that pizza.

Newfoundland firearms owners be reminded, lol... According to Wildlife Act 107(1) your firearms must be "wrapped and securely tied" in an "area known to be frequented by wild life", which in NL means the Trans Canada Highway, probably your back yard, and almost anywhere! Yes, moose have been known to visit downtown St. John's :-P

I am a US citizen and obtained my PAL and RPAL a few months ago in BC. Can I cross the Canadian border in Quebec with a secured and locked non-restricted shotgun on my motorcycle (it has a lockable box attached to the rear of the bike - and travel across Canada to BC with the firearm? Thanks.

Can you transport Non-restricted firearms temporarily through the US with just your PAL. For example, can you go through the Sault Ste Marie border, through the US, and go back into Canada through the Sarnia Blue Water Bridge.

What about a range back for restricted firearms. I got a range bag that has a spot for 2 handguns and the zipper has a loop big enough to for a lock. Is that completely legal? I also have a soft bag/case for my ar that I can put a lock on the zipper. Is that ok also or do they need to be hard cases?

A cop in Calgary decided to take his AR15 home to clean it, in his personal vehicle.He stopped at the bar on the way home and someone stole the gun. Nothing happened to him. He just got a couple weeks paid vacation out of it

i have a question i have been unable to find the answer for. I am taking a trip to Alberta and BC from Ontario. We will be passing through the US on the way, driving from Michigan to North Dakota, possibly spending a night or two along the way, I was thinking about bringing one of my restricted firearms, probably a pump shot gun for in the truck. I was wondering if its possible to legally transport if over the border? and which laws would need to be followed while in the US? If you could either let me know or point me in the right direction it would be much appreciated!

Hey Rod, I know you're a busy guy these days. How would you interpret this in relation to storing non-restricted firearms in an RV or trailer, say on a hunting trip? Is an out-of-sight firearm, stored in a trailer with a locked door lawful??

Great video Rod. One question I have , when I got my PAL for NR and R our instructor said that you can obtain a 24h 365days authorization to transport for RFA obviously not carrying after 11pm when all gun ranges are close. Is this true or you have to apply every time . Thanks

You need 3 layers of protection for restricted. Locked car, locking device, locked case, when transporting by car.

What exactly is the definition of "unloaded"? No round in the chamber? No rounds in the magazine? What if it's a detachable magazine? Can you have a loaded detachable magazine next to the rifle but not in the rifle?

unloaded means no ammo in the chamber, or in a magazine inside the gun. loaded mags are ok to have next to a rifle

hwy rod don't know if this is true but when I did my pal for my non restricted I was told by law cops are not allowed too touch your firearm without a warrant? is this true ? I believe they have too ask if u are transporting and then request rtoo see it. which u have too agree with and only you can touch it.

I don't plan to buy a restricted handgun anytime soon, but just curious as this info seems hard to find. If I did get a handgun sometime soon and do not own a vehicle... How do I legally transport it to the range? If I trigger/cable lock it, then lock it in a a hard case, then put it in a backpack and either walk or ride a bicycle, is that considered concealed carry and therefore illegal? Or would that be a legal way to transport it?

If you get pulled over just don’t say any thing you have the right to not say any thing you can say to the officer “ sir I do not answer question “ if they ask to search the car tell them “ sir I do not consent to any search” but this is where it gets trick if the tell you “ I’m searching the vehicle “ and give you a reason then you have to let them if they ask for the key or combination for your box don’t say any thing and let them break it “ lawyers love this “ if the break the case it shows that they never had consent to search. But most importantly do not lie the the officer when in doubt shut your mouth

Does the ammo need to be store separately? In theory I could store my non restricted rifles in some foam underneath we the spare tire cover in the trunk with the ammo next to it?

I have my pal and a range membership but I don't own a car. I emailed the city and they didn't know but can I transport a rifle on the public bus if it's unloaded and in a hard case? I'm confused and don't want to break the law

Sorry if this is a silly question but what is the exact definition of unloaded? Is a pump action with shells in the magazine tube but not in the chamber loaded or unloaded?

It would be considered loaded, even if shells are only in the magazine tube.

What if you are travelling from the point of registration in one province to a cabin in another and you intend to spend 3 months there?

Since you are travelling from your province of residence to a different province, you are required to contact your provincial firearms office and the other provincial firearms office to obtain an Authorization To Transport to transport that restricted firearm across a provincial border.

does ammo have to be stored separately with a non-restricted firearm? I have heard that it needs to be separate but I have also been on many trips where my friend stores the ammo next to the gun

Not valid, for Non-Restricted you need Lock on trigger now.

Great Video. To add regarding ATT's, on my LTATT (Long Term Authorization to Transport) and all of my friends who recently obtained one, the Ontario CFO has added conditions, stating to the effect that I can only transport restricted firearms that are registered to my house. Which means I CANNOT transport borrowed restricted firearms (sneaky bastards). Additionally, Chris Wyatt (Ontario CFO) has added another condition that you must produce a written invitation from the shooting club to which you are going to if you are not a member. This has prompted lots of clubs to issue an open invitation letter on their website for people to download and keep with them during transport. Gotta love CFOs.

Thanks for the video, Rod. I was wondering if when pulled over for a broken tail light or something like that. while transporting a firearm, restricted or non-restricted. Are we legally supposed to notify the officer who pulled us over?

Oh ok, I was just wondering because, you mentioned if you were pulled over, you had to be "on your way somewhere" gun-legal. I wonder if they search people in the system and find out if they're R-PAL holders, then ask. Thanks for the prompt reply!

If they asked, or if they see something, I'd be cooperative and not lie about anything. Best is to follow the law and regs.

TheEndlessVariables I was thinking about that the other day. My RPAL just came. I dont own anything yet. But i do not live in such a bad area. I would imagine that if the cop pulls you over for a taillight and ask for licence and registration only. Give that to him and take the ticket no issues, if they run your name and can see you are gun licenced and come back and as, then i would not lie as Rod said and explain to the cop where it is and its locked and keep my hands where he can see all times :-) common sense, gotta remember the officer's alertness will spike as soon as you say you have one in the car right so keep everything calm and friendly,

I find it really dumb (along with many other Canadian gun laws) that a NR gun needs to be locked up in some way when it's just sitting around your house (stored), but doesn't need to be locked when being transported somewhere outside of your house. Am I misunderstanding something, or is this stupidly correct?

You don't have to lock non restricted, even though strongly suggested, but keep ammo separated with the gun unless in a safe

Going for my PAL but I don't have a vehicle. How would I transport a non-restricted rifle without hassle? I live in Montreal, BMW is the way to go. (Bus, Metro, Walk.)

Then just do everything he said other than put it in the trunk, get a case, unload the gun, and you can take it any where on foot or public transportation (non restricted of course) other than the gun free zone like schools. And I also heard some people carry their guns in a guitar case, since sometime people might get freak out when they see a gun case. Check out Hazard 4 Battleaxe, it's a gun case that shape like a guitar case, and you can wear it like a back pack.

120216 - Rod, I realize someone has asked but the answer was not from you, want to confirm, if I go to the range (Ontario) with my handgun w/ trigger lock inside a locked case and ammo within the same case (not inside firearm) this is ok. What about if that ammo is preloaded into my magazines and stored in the same case but not within the firearm. Please respond.

Yes a pre-loadec magazine can be placed in the same locked case as the restricted firearm, as long as the pre-loaded magazine is not placed in the restricted firearm. He covered that topic in his video.

if a cop takes your property aka non restricted firearm from you at night for public safety concerns, he must prove it in front of a judge or face a defamation of character lawsuit and a theft of property recommendation by the judge to the crown. If one takes it from you, do not pick it up the next day when they call, have your lawyer bring this up in front of a judge. Being labeled a public safety concern is absolute nonsense unless they have reasonable probable grounds via an accusation by the public, and not their usual anonymous call which is complete garbage. If they want to lie let them lie in front of a judge and face perjury charges. There is no difference between 2 pm and 4 am in the law, cops do this shit all the time.

The only reason I have for getting a restricted PAL is to carry a handgun when I'm out in the bush gold prospecting. I am a member of a registered gun club, enjoy shooting there but that's not the main reason, so is it even worthwhile? I just worry I'll spend hundreds of dollars, waste hours and days, wait months and not be able to get a permit to carry it for wilderness defense.
