I don't know enough about this particular case to comment, but the U.S. military and intelligence agencies train, arm and fund foreign criminals and criminal organizations all the time. Often those "trainees" then later turn their weapons back on U.S. forces. They also sell weapons to foreign countries who then openly re-sell them to our enemies. What right does our government have to get upset with an individual when they are guilty of this much and far worse? Don't like the competition, perhaps? Do you think the Chinese pilots were completely incapable of landing aircraft on carriers before this American showed them how to do it? Did he commit treason or is he just one of thousands of former soldiers, turned private mercenaries, who continue to train nefarious characters around the globe? Maybe this guy is guilty of something terrible, but one would never know by the scant facts in this report.

So, the UK wouldn’t be able to extradite someone from Germany for consensual adult in’cest because, even though it’s objectively sick, and an indictable offence in the UK, it’s totally legal in Germany. (Make of that what you will.) Likewise, Uganda couldn’t extradite someone from the UK for gay things as it isn’t a crime in the UK. (Quite why the UK has an extradition treaty with Uganda is somewhat worrying, but I suppose African SAers can’t just high tail it to Uganda to escape justice which is obviously a good thing. That being said, if the person in question was accused of SAing their wife, then Uganda could refuse to render the offender to the UK as SAIng your wife is totally permitted in Uganda. Basically, the crime has to actually be a crime in both countries. The amount of people who feel free to comment and put out misinformation without thinking twice is really worrying

This should be a crime in Australia but I guess the Australian military does not really have any special capability that China is interested in. If anything this will bankrupt him even if he does not spend any time in prison which is the ultimate punishment for someone who will sell out his country in such an obvious and blatant way for only $60K. The law is indeed the law, and it’s a basic feature of pretty much any (if not all) extradition treaties that an offence must be a crime in both the extraditing nation and the (potential) rendering country. (Obviously American allies have been known to engage in so-called “extraordinary rendition” but that is extrajudicial and illegal. Just because the guy moved to Australia and married an Australian Woman and had a family there doesn’t mean he’s free to violate the laws of his home country and the Oath of the Military who put substantial resources into training him, the US Military is always going to consider him theirs. Now if he had done nothing with his skills after getting out of the military they wouldn’t have cared but if you use the skills they invested time and money into you to then turn around and “Train Our Adversaries” then you’re a fool and they’re definitely coming after you. Former Military can be reactivated for disciplinary reasons depending on the severity of the offense, it’s actually in the fine print of the contracts for Enlisted and Commissioned Personnel although it’s rarely used.

Sure it probably would be a boring transition but the money is good and the hours are far more predictable. Some people can't wait that long and leave the military early and forgo some retirement benefits but they more than make up for it as they accumulate seniority at an airline.

If any citizen, of any country with which Australia has an extradition treaty is guilty of committing a crime in their home country, that person is extradited without any fanfare. Recently, the Australian Government applied to have a man living in Italy extradited for a murder committed by him on Australian soil. He's charged with a crime in Australia and the Italian government/legal system has complied with Australian requests to have him sent here to face trial. If this guy is being charged with a crime, there's no reason he shouldn't be treated any differently.

Yeah, cos (as the other commenter alluded to) murder is a crime in Italy as well as Australia. You can’t just extradite people for an offence if it’s not a crime in their own country. The UK has an extradition treaty with Uganda, but we don’t extradite (technically it’s called rendering) people to Uganda for gay acts, because it’s not a crime in the UK. I find it so irritating but worse, worrying, that people are so quick to post opinions on matters they know nothing about, thereby spreading misinformation which other people believe, contributing to general ignorance. If he did take money from Chinese sources to train Chinese pilots it’s an act that’s dangerous to both Australia and the U.S. If the extradition is ruled legal then all the Americans have to do is “follow the money” and display the spreadsheets in court. Sure, I feel sorry if he has put his family in jeopardy and that’s one of the bad things that’ll come out of this. It doesn't matter if he knew (that may form part of his defence or sentencing mitigation if found gulty). According Reuters he renounced his US citizenship in 2016 (backdated it to an earlier date) which would mean he was still a US citizen at the time of the alleged offences. He can argue he wasn't a US citizen at the time because he back dated his renouncement date to years before he signed the docs in 2016 but that seems a pretty thin argument. From Reuters "He renounced his U.S. citizenship in 2016 at the U.S. embassy in Beijing, backdated to 2012 on a certificate, after "overt intelligence contact by U.S. authorities that may have compromised his family safety", his lawyer wrote. His lawyers oppose extradition, arguing there is no evidence the Chinese pilots he trained were military and that he became an Australian citizen in January 2012, before the alleged offences. The United States government has argued Duggan did not lose his U.S. citizenship until 2016."

So let's say this Marine decided to move to North Korea and got citizenship there and then trained North Korean pilots. While NK wouldn't extradite him, he still would be guilty of breaking USA laws.
