Sir, what about the applicability of emergency award under arbitration and conciliation act, 1996?

Woow I'm glad your so much updated. Emergency award is a concept of International parlance. It was recommended to be brought in India aswell but failed to do so as a separate provision. Emergency Award operate under sec9 and 17 of Arbitration & Conciliation act 1996. Recently Amazon procured that outside India and it started picking up in news however In Raffles Design International India Pvt. Ltd.& Anr. v. Educomp Professional Education Ltd.& Ors. It was held that an emergency award in a foreign seated arbitration cannot be enforced in India under the Act.

Very lucidly explained. Kindly also include the effect of Commercial Courts Act, 2015. Now, all the case have been transferred to Commercial Courts from the District Courts. Also, there's a concept of Original Civil Jurisdiction of HCs in 5 cities, namely Delhi, Bombay, Madras, Calcutta and Shimla. Here, there are no Commercial Courts but Commercial Divisions of HC and appeal goes to the Commercial Appellate Divisions of HC (in case of Domestic Arbitration.) Secondly, in Delhi pecuniary jurisdiction is also instrumental. Thus, S. 34 applications, which generally moved to Dist courts are moved to HC if the value of the award is over 2 cr. Hope it helps.
