Sir ,can auction purchaser file case in drt for issuance of sale certificate, sale deed and possession of the auction purchased property beacuse bank is delaying the process ? If yes than under which section?

Sir my father took a loan of 23 lack from SBI for business he is unable to repay the loan he just paid 8 lack and 8lack subsidy is there ,now my father receive a notice from DRT, please do reply sir what procedure we have to do know ?my father ready to repay by selling businessproperty now it's 49lac including interest,bcz he don't have any other source to repay loan

Hi I had personally dealt with a matter - 1) Sit accross with the bank restructure the loan where the Emi can be reduce and tenure increased , 2) RBI has issued a "one time settlement scheme " to settle bad loans you can look into that . You can take benefit of that scheme. 3) Sit and carefully go through the banks calculations to arrive at such an amount and method of computing Let me shred some light on banks strategy - 1) Put mental stress and pressure 2)Obtain order from DRT and appoint recovery officer who will immediately freeze all bank account s , then moveable property etc. 3) They can take police assistance to obtain control Having said that let me let you your strategy - 1) The above action will take lot of time 8-10years to enforce court orders . Matter just goes on and on . 2) Try to bring one time settlement and negotiate hard because even bank know process of recovery is a long one. 3) Dispute the amount many a time the amount is astronomical 4) Try keeping lesser asset in dad's name esp in bank account since that will be the first one to be freezed 5) They charge int on int which many a times is not as per contractual terms. 23lakhs loan , 8 lakhs already paid up and still outstanding is 49lakhs court itself should grant some relief. If you need assistance let me know will surely help you out and don't worry process for recovery is a slow one you have time to find a safe way out. 👍
