The federal government has been reluctant to use police to enforce a court injunction against blockades that are disrupting rail traffic across Canada because it fears a repeat of the Oka crisis.

Hey CBC, that “person” who was killed at Oka was an SQ police officer trying to enforce the law, that’s why things escalated to the army being brought in. Way to gloss over that with your ambiguity.

Coastal gas link gave them a lucrative deal they could profit from, the majority of the people want it, the elected council wants it the majority of the heriditary chiefs want it. So are we moving the goalposts so far that widespread consensus isn't good enough to get a project going? This country cannot function this way, something has to give.
@MB-rz4fx
@MB-rz4fx 4 жыл бұрын
They don't have a democracy, they have their own law. This has nothing to do with the project, CGL had their consent if they took an alternate route. This has everything to do with our government not having title to their territory. Just remember that these chiefs or people didn't take any bribe and stood by their property.

Michael Beal actually I believe you need to read the Delgamuukw case conclusions regarding the aboriginal land rights of this area (there is a treaty process that has been ongoing since). As well in regards to the alternative route that was proposed, it was turned down because of mainly the higher environmental impacts to the land and some communities, as well as the higher cost and further consultations would be needed with other clans. This was brought up in the Supreme Court injunction. There was also another alternative route proposed by cgl that went un answered from the hereditary chiefs
@MB-rz4fx
@MB-rz4fx 4 жыл бұрын
@@DC-jj4zj either way it is for them to decide as hereditary title holders. Not for some company to make our government launch an attack on their sovereignty. The amount of information and economic warfare going on is disgusting. If you pay attention to geopolitics these tactics are common.
@DC-jj4zj
@DC-jj4zj 4 жыл бұрын
Michael Beal actually in canada it is up the the people to decide. The hereditary chiefs have nothing to do with how canada sees this. The issue is the media and how they are twisting the narrative that 4 out of the 12 get to decide even though all elected chiefs (the democratic chiefs, I know one hereditary ran and didn’t win) and the bands have agreed. I do agree with the economic stuff that shouldn’t be happening and that the laws (which are supposed to be enforced on all) should apply

DO CANADIANS BELIEVE THAT THEY ARE LAW BIDING? "Section 25 guarantees that no rights protected under the Charter will be used to abrogate or derogate from right belonging to Aboriginal people (including land rights and rights under the Royal Proclamation), . ... This is an important step in amalgamating common law and Aboriginal law traditions." "Section 35 of the Constitution Act, 1982 provides: “35(1) The existing aboriginal and treaty rights of the aboriginal people in Canada are hereby recognized and affirmed. ... Existing Aboriginal land rights can no longer be extinguished without the consent of those Aboriginal Peoples holding interests in those lands.Sep 21, 2014" Section 25 guarantees that no rights protected under the Charter will be used to abrogate or derogate from right belonging to Aboriginal people (including land rights and rights under the Royal Proclamation), Section 35 provides distinct recognition and affirmation of existing Aboriginal and Treaty rights. This is an important step in amalgamating common law and Aboriginal law traditions. @@fridericusrex9812 correct me if I'm wrong: First, much of the B.C. is founded on unceded land, in the 1997 Delgamuukw v The Queen case (which I found hilarious honestly, the land owners had to go to the occupier's court to justify their claim to the land), the Canadian Supreme Court recognized the Hereditary Chiefs as the representative of the collective land rights holders. So the B.C. government's, heck or even the whole Canadian government's jurisdiction over B.C, especially the Wet'suwet'en land, is shaky at best. Second, the pipeline did not consult with the Hereditary Chiefs, and the deal was struck between CGL and the Band Council, or the "Elected Chiefs". The "Elected Chiefs" were elected by those who have "Indian Status" bestowed by the Canadian federal government, according to the Indian Act of 1876 (again, still quite hilarious to me considering the land is never ceded, who are the Canadian federal government to decide who is a real "Indian"). So essentially the Canadian federal government controls who get to vote for these "Elected Chiefs". As refered in the first point, these so called "Elected Chiefs" don't have the power to make the decisions in the first place, the Hereditary Chiefs do. So the legal basis for the injunction unilaterally issued by the Canadian Supreme Court is not so sound. As such, I think the blockade shouldn't be refered as "illegal".

@@eisenstein99 in short the reason for the Canadian government identifying who is Native, is to know whom the government is to provide 1st Nation services too. Otherwise everyone would be rolling up to get the benefits. Maybe that wouldnt be so bad.... I'm not sure what the logistics would say about that.

@@jeremygibbs7342 I don't know, I still find it quite hilarious for the CANADIAN government to recognization the INDIAN status. Shouldn't be the indigenous nations do the recognization? An analogy would be sometime ago someone has forcifully entered your house and took over. You have never given up your claim to your house. And now those who took over your house also decide who your family members are. It just doesn't feel that right.
