When I purchased my home in Mesa I put N/A in the line for joining the HOA, initialed it and had the builder initial too. This was before the development was completed and the HOA was set up so I was exempt from the HOA rule. They threatened to take me to court but after the HOA lawyer looked at my paperwork he told them they would lose and I wasn't subject to their rules. It really chapped their hide.

People have no choice. It is a way for city governments to tax the people through property taxes but then shift the burden of maintenance and services to the homeowners. Many cities force developers to set up an HOA before they are given permits to develop. Then the city is able to increase their property tax income without having tp provide more services.

As the reporter noted early in the segment, there are likely a lot of good HOA's out there. I avoid them myself. But if the issues are limited to 0.01% of the HOA's then I think outlawing them or even suggesting so seems rather extreme. I hope this situation turned out okay for the residents.

I unfortunately moved into an HOA in S.C.. we as homeowners are not allowed to participate in meetings. This appears to be an FFA (FREE FOR ALL) I was told that it was up to the developer when she wants to turn it over to the homeowners. Why are we paying association fees with no say so? Is the developer just padding her pockets? I came from a wonderful HOA. Never again down here!

@Scott M. I live in an area where that doesn't seem to be a problem (and does not have a local tyrants association). So, I don't see what your hypothetical problems have anything to do with HOA's. The more land I own, the less I care about what the neighbors are doing. Do you live in a town that has a junkyard? Is there a bus station nearby? Train station? Churches? Airport? Military base? Homeless shelter? School? All of these places can generate nuisances, even with an HOA.

I almost signed a deal on a winter home in Florida and when I was at the lawyers he mentioned HOA and I said “there is an HOA”? Lawyer said yes wasn't it on the listing, I said no, he looked it was under other. I didn't even see that but luckily I refused to sign and lawyer agreed. The owners said they would sue and my lawyer said “make his day” go right ahead, they will own the property for nothing. Of course they didn't.

The only deciding factor is if a government prosecutor decides to take up the case and file charges against a corrupt HOA Board member who committed a misuse of funds for their own personal gain. It's like your favorite sport, take football, if a "foul' happens and the Ref calls it then a penalty is applied. But if the Ref didn't see it or chooses to A) ignore it or B) thinks it doesn't rise to the level deserving a penalty... well then the perpetrator of a foul/infraction/fraud/crime gets away with it. It's still a crime, it's just that they may get away with it.

We had a problem with our HOA when the president hired her mother to be the secretary and was paying her over $30,000 a year and not really doing any work, and then hired her husband to be the handyman and paid him also over $30,000 for hardly any work. He did some wiring work in the clubhouse that was not up to code and had to be professionally redone. When things started to come to light the board used our own HOA fees to hire an attorney to defend the board.... We had enough and forced them out, but sadly the newly elected board offered amnesty to the previous board and let the president walk.... next time I'm buying a house without a damn HOA

Actually our HOA has been pretty decent. The fee is only around $100 per month and includes 100mb internet for free, access to a community center with a full workout center including classes for $5 each and free pool access (We have several HOA pools with free access for HOA only), and free watercraft rentals at our lake. It's a decent deal.

America is a wealthy country, and I did very well in private banking for 25 plus years. I worked 60 plus hours a week for many years.. well over 10 years before I took a proper vacation. This exact same scenario is why I ran to be on our HOA Board. Our board was buying booze, holding private parties, paying for new ink cartridges for personal computers even though we do not print our reports. I got every single one of the removed from the board. It took almost 5 years clearing up the books and paying off debts to get us back out of the red. Ultimately, we determined that that board had us 1 month from filing bankruptcy...

One of my best friends bought a Koreatown Apartment in 2013 and after less than 2 years of living there is he noticed nothing was being upkeeped, even though he was paying HOA fees, he found they had installed $4000.00 security system when less than $300.00 of security systems were in place. He eventually became the president of the HOA and kicked out everyone that was corrupt and had everything fixed. My friend was a career appraiser he knew everything about property and worked from home, so it was almost perfect for him to destroy the system.

+Pooper Scooper go to your property manager they should have a copy of the bylaws. As far as the bank statement at my HOA only board of directors are allowed to view it. You can request a copy of the accounting balance sheet they should show all financial expenses. If the property manager is refusing to release those documents than legal action would need to be taken.

+Vance Huynh KZbin always posts my comments twice, sorry about that. At the meeting, both the board and the property manager refused to give us the bylaws. And they have never recorded them with any state agency. We will have to hire a lawyer, I'm just hoping we can sue for our legal expenses as well. It's absolutely corrupt. They hold secret elections and pass down the presidency from friend to friend instead of a homeowner vote.

I owned a condo years ago, paid $300 a month in condo dues, but when the owners wanted answers about the spending; we were met with silence. I sold my condo recently, and I have vowed to never purchase another condo nor a home in an HOA community.

I used to live in a development with an hoa. The development was an old trailer court where they were buying out the land that the trailers sat on and building houses slowly. It was about twenty percent done when I moved in. The hoa got on me many times for small things like cutting my tree down that had damage from a storm , paint color of my door, putting rails on my deck. The people in the trailers had garbage all over the place , cardboard taped over windows all kinds of things. I was actually sent notices for fines . I ended up not paying the hoa for over a year and then I moved out of state.

When I had to move last year because the state DOT expanded the highway, my first statement to the realtor, when looking for a new house, was don't show me any properties that have an HOA. She hates them as much as I do.

Then you will always need to avoid condominiums or (in state's that have them) cooperative apartment complexes. Boards exist in all of them as a matter of logic, and common sense. There is no landlord, so if you have no maintenance fee the place becomes a vermin infested lawless run down wreck. With a monthly maintenance fee someone needs to be elected from the residents to administer it, hire the maintenance people and maintain the place. Single family homes are great for healthy younger people, and you have control of your castle but not always for seniors who don't want snow removal duty or lawn cutting duty or exterior repair responsibility. Would you want your gramps up on a ladder?

One reason is becuase it keeps a lot of people out if the HOA is setup fairly decent. My parents have lost property value from habitat for humanity houses being down the road another one of their properties had a guy that sat on his land for over 40 years only to give his son the property in his will and that land very fast without much warning turn into a trailer park so a very isolated area with 20 neighbors suddenly have 30 more neighbors and dropped the property value by a lot and they have been unable to sell the cabin due to the new neighbors. Another reason is the minorities that like to give a reason to be disliked avoid HOA’s. I’m not saying all minorities are bad just a fair amount trash outside the house. I’m just saying HOA’s if it’s done well keep the area more clean and not looking like a Arkansas Backyard.

I have a condo in a HOA community. They are very hands off with most things. They only meet once a month and all money taken and spent has to be transparent. There are good HOAs they just don't get noticed.

Also I careless if you have 5 cars on your driveway. Some families have kids that can drive now or if a guy got money and can afford all those cars. Dosent bother me. So long as they keep it on their property.

The problem with the concept of a homeowners association is the arbitrary nature of those who hold the power. There are no checks and balances and for the most part, the enterprise remains unregulated by the government. It is basically a free-for-all. There is no due process. Nobody is required to provide residents with checks and balances to show where the money goes. You are basically just trusting that those who control the flow of funds are using it for the stated purposes. Also, by initially agreeing to abide by the terms of the HOA, you are implicitly agreeing to abide by future rules and bylaws that are enacted. Any future ridiculous bylaw or rule can be enacted. Over time, as people come and go and personalities on the board shift, what was once the best HOA in the area can turn into Stalag 13 very quickly. IMO, if there is any organization or entity in need of regulation, this is it.

This is an old video just finally saw it. Lived in these Condos in 2010-2012 definitely was pretty shady HOA, I had a lot of violations for having a BBQ on my balcony. What was the craziest one was I caused some damage to the plaster on the outside of my garage. I quoted about $300 for myself to fix it on the high end. ( I worked with a contractor at the time) But I also had 3 other contractors come by to quote repairs, just to have everything in order for the HOA because the repairs were coming out of my pocket. Quotes come out to $800 - $2400 for the 3 contractors. The HOA refused all of the quote and said they have a contractor already. I was billed $12000 for Repairs. I ended up moving after that it definitely was not easy to leave because of how they tried putting a lien on the condo for $12000 because of refusal to pay that amount.

The government needs to step in and put restrictions around HOA's. There is very little law governing these crime families and its about time there was. The other thing to do is just not purchase a home that falls under an HOA. If the properties become abandoned and they can't sell - then there is no money coming into the HOA and it collapses. Once the HOA folds, buy the house.

I sold my condo in so Cal last year where my HOA fee was $536/month. When I re-located to WA state, one of the things I said to my realtor was, "if you show me anything with an HOA I will RUN in the opposite direction". Lessons learned and not to be repeated. I am now happily HOA and mortgage free.

95% of ALL HOA's are Horrible. With either Super High Fines issued, Horrible HOA board Members or Misspending HOA money. Only 5% of Hoa's are actually might be semi decent or Decent enough. If you Live in a HOA, Work Hard on getting them Disbanded. They are NOT WORTH IT AT ALL.

I really appreciate my HOA. They're very helpful and friendly, and very attentive to any and all reasonable requests. And they're very professional and courteous in asking me to maintain my property with very reasonable requests of their own. And if I don't do things exactly they way want, they just send a courtesy note thanking me for the effort and clarifying - they never, ever just send a terse SECOND NOTICE as if I just blew them off entirely. Said no one - ever.

Story time. In our old house my family had wild dill growing in our front yard for multiple years as it randomly appeared one summer. Right before we moved to our new place our HOA decided to attment to fine us for the "Weeds" in our yard. While our next door neighbor literally had a tire in his flower bed and regularly didnt mow his lawn. Now get this. After the dill appeared in our yard that first year my sister had actually taken seeds and thrown them on the ground for whatever reason. By definition this doesnt make them a weed after that as there had be effort put in to plant the dill. So my father repsonded to them with that information and we never heard from them again. Moved to a new place without a HOA. We also had other problems with that HOA but my father just ingored most of there BS

A true home owner is someone who can do as they choose to their home, as long as they are abiding by the codes and laws of the city. You can save money and do your own landscaping, maintenance, etc. Rather than throwing it away to a HOA. I live in an older subdivision with nice one story homes and thank God there is no HOA.

I also live in one of those vanishing one story homes of a development without a HOA and in the center of our city. We once had a conman soliciting people in our neighborhood to start a HOA for things we didn’t need like security, maintenance and landscape control and another monthly bill to pay him. Last I heard he is still riding that rail we sent him out of town on. What a scam. I wonder if this con has ever been played elsewhere. Sounds like an HOA after the fact would be as illegal as a protection racket.

I've only lived in one house where there was an HOA; we had to agree to all of their covenants before we could purchase the home. Rather than complain about something without trying to fix it I joined the HOA board and found that the group serving there was actually very dedicated and tried to be fair when there were any grievances or citations for violation of the covenants. In all I found it to be a very thankless job as homeowners would want to make changes to their property that were clearly not allowed in the covenants that they had signed and then they got very angry - and very personal - when the HOA held them accountable for it. I'll never buy a house where there is an HOA ever again. It is a no-win situation.

he can't, the jist is if your entrusted with money, it's a much higher bar to make it stealing. The thing is stealing is taking what clearly isn't yours, in this case, he was trusted to spend it wisely and he spent it less wisely, but he had the authority to spend the money. The failure was in doing so wisely basically. However they can now that they've replaced the board, hire an investigator/forensic accountant and pursue civil action against him. They can recoup the funds.

I worked to install Fences and Windows at peoples houses. A lot of HOA's in the areas where i worked. I heard some real horror stories. A lot ( Most ) had to do with getting permission on various items. The one thing that stood out was " Friend's " of the HOA board members. Who were allowed to do as they pleased . Where as other home owners would not be allowed to do something the " Friend's " would be allowed then everyone was allowed when it was pointed out that the " Friend's " got the all clear..... I live in an HOA now but i am moving out soon. Not that i have had trouble, just the fact i am not allowed to do a lot of things i want to do. Like a Garden.

@@MR..181 Actually the person in control is the one cutting the checks every month. That is the secret the holders of debt don't want borrowers to know. But if I owe you it is entirely up to me as to whether you get paid or you have to start foreclosure proceedings, which is a big money loser and you most def DON'T want to do. And I picked a place that I could afford. Too many try to buy at the max of their ability to pay, in the best of times, and run in to trouble when times get lean, as they always do. I'm a disabled Vet and my pension more than doubles my mortgage payment, so it's never an issue, the money is ALWAYS there, the mortgage ALWAYS gets paid- and the world can go f itself for another month!! I'm retired and both my wife and I have plenty of $ from SS. Nobody controls my stuff but ME, Bunky. Both me and wife have credit scores over 800. Creditors line up at my mailbox begging me to borrow money from them. But I don't need to and the only debt we have is the mortgage and a hospital debt we've made a settlement on that we can easily afford. The hospital was happy to work with us there on something that we could afford and didn't leave us short. It's a rather small payment, but the hospital is just happy we pay them something every month, which we do. Again, WE control whether they get paid or not and their only alternative is to get a settlement lien on our house and land and wait until we die and the property changes hands to collect. At which point I won't care! You are in control of your own destiny, not some creditor. You just have to learn how to negotiate how to get what you want/need and how to live within your means. Good luck! But for us, all we need to get paid every month is to just keep breathing!! To paraphrase the song- "That's the way you do it, money for nothing and your payments free!" :)

A group of accountants and money men ( purchasing, retail etc.) save my ass back in 1984 when the local management company tried to charge us twice for sewage charges. He got the maintenance and repair stuff done at less price by another company. We organised a way of getting the work done directly rather than "trust" a maintenance company.

Wish people would just stop buying any homes/properties that are subject to HOA rule. If these properties become unsellable due to being in HOAs, perhaps there would be less incentive to create them in the first place. Buying property for myself, an HOA is the biggest deal breaker there is. I refuse to buy a piece of property on which someone else has the authority to tell me what I can or can't do on that land. It should be illegal to bind a property's title to the control of an HOA, they should be completely optional.

our hoa is crazy. we got a letter for my sister being parked slightly in the sidewalk for just a few hours while she was visiting, as well as a letter when my dad had to bring his company car home overnight. let’s also not forget the letter we got for our HOSE being slightly in the driveway!
