Correction !!! IN EACH AND EVERY CASE OF LETTER OF CREDIT:- The payment to seller will be made as soon as the documents enlisted in LC are submitted to the advising bank. The job of the advising bank is just to check the documents enlisted in LC are received in the manner prescribed and if all conditions of LC are fulfilled, the bank makes payment to Seller. forwarding those documents back to buyer is done in the next step. That is why Documentary credit system is considered a little favourable to the Seller because he doesn’t have to wait for his payment after shipping of goods.

Imagine i have a letter of credit that states negotiating banks must confirm on the remittance letter/covering schedule that the amount of the drawing has been endorsed on the reverse of the credit. However, some banks present documents to the issuing bank with no notification whatsoever regarding the endorsement of the amount drawn on the reverse of the credit. On TOP of that, no response is received to enquirers sent to the presenting bank by the issuing bank. 1) How should an issuing bank proceed with the documents presented, provided they constitute a complying presentation except for the missing notification of endorsement? 2) What when the issuing bank has reimbursed the negotiating bank for the value of documents and later receives the same documents from another negotiating bank? Is the issuing bank obliged to honour? If not, on what grounds can the documents be rejected and reimbursement refused? 3) what’s the liability or responsibility of the negotiating bank and the step to be taken by the issuing bank, when the presenting bank gives no response to enquiries and in the meantime the goods have already arrived in the port of unloading? Should issuing bank release the documents to the applicant, to avoid demurrage and detention costs, indicating to the applicant the implication of the missing notification on the endorsement of the amount drawn, or should it proceed in another way, and if so, what is the action to be taken and on what legal grounds?
