اسلام علیکم سر! جیسا کہ گریجوئٹی، سالانہ چھٹیاں، سالانہ تنخواہ میں اضافہ ہر پرائیویٹ ملازم کا حق ہے جو کہ "payment of wages act" کے ذریعے تعینات کمشنر معاوضاجات کو درخواست دے کر لیا جا سکتا ہے لیکن اگر کوئی کمرشل ادارہ خود کو کسی nonprofit organization کی ملکیت ظاہر کرکے یہ کہے کہ ہم پر تو یہ قانون لاگو نہیں ہوتا جبکہ shops and commercial establishment act کے تحت وہ ادارہ کمرشل ادارے کی تعریف میں آتا ہو تو اس صورت میں ہائیکورٹ میں 199 کے تحت ریٹ کے علاؤہ کوئی حل ہے؟

Sir please explain statutory rules and non statutory rules. How to know if given set of rules is statutory or not?

I hav been working in nespak since many years but we still working as daily wages after that i have filed a writ against nespak for regularisation wher company take stance that they have non statutory rules and would you believe who is the council from nespak ? His name is Hafiz tariq naseem i was shocked when i listen from hafiz sab that every can file writ against non statutory rules can we say it is double standard ?

@@MohammadAhmad-wu7xp no problem dear brother. It is duty of advocate to protect interest of client. He furnishes such opinion of law and facts before the court as helps his client. There is nothing wrong in it.

AOA, Sir what about promotion during pending enquiry. As the cases of promotions are deffered during pending enquires. whereas the promotion is vested right.
