It's funny because when we watched this as kids we were siding with Jim Carrey's character but now that we watch it again we sympathize with the poor man who loses half his estate.

@Thomas Buchovecky No arguments there... I just said it’s heartbreaking to watch someone lose both their money and also their children especially when that person is good... This case is about the good losing against the bad... I guess reality is harsh, need to accept and move on... I am not sure...

@Thomas Buchoveckythat still hard, it's not like he have 22 mill $ in cash, it's all he worth. probably will have to sell a lot of property, cars, house, shares. Selling shares could make lose the control over company. Could even potentially bankrupt him, is that money were invested someone risky and he had to pull it off suddenly.

From imdb: Contracts with a minor are considered voidable, not void ab initio. A minor who enters into a contract can choose to avoid it, but if she turns 18, she only has a limited window in which to declare the intention to avoid the contract. This window is usually six months; for marriage in California, it is two years; past this window, the contract is considered ratified and must be executed. Given Samantha Cole's age at the time of the divorce hearing, both her marriage AND the prenup should have been considered ratified. However, even if the marriage were valid but the prenup not, her husband clearly states that he "didn't know she was a minor!" At this point he could probably get an annulment on the grounds of fraud, reverting Samantha to status quo ante matrimonium - i.e., legally in possession of none of his wealth.

Maybe, but thats a different case. This specific case only covers whether or not the prenup should be considered valid going forward. They'll have to set another court date to argue the fraudulence of the marriage itself.

@@nickpapageorgio926 Did you not read AxelFive's comment? The point is, these are two separate issues that must be decided by two separate legal briefs. So, the husband definitely has an avenue to "appeal" the decision to forfeit half his fortune to that skank.

@@heinzkitzvelvet They are 2 separate issues but the trial judge would have to address both of them at this stage. He wouldn’t have made the ruling like he did in real life without giving the other side a chance to make their argument or time to file a brief.

As a kid I never realized how ridiculous this plotline is to suggest a team of competent lawyers wouldn't have caught on that the entire prenup was void when they had the birth certificate.

Like Jim Carry later says, it’s a technicality. Outside of her birth certificate and driver’s license, no one had a clue she changed her age. Even the husband didn’t know. I know from experience that once a lawyer has a good lead on where they want the case to go, they become so blind to other possibilities.

@@jsmith-u5i I get what you are saying but the prenup was still invalid because she signed it when she was under 18. As a result, the prenup and very likely the marriage license were invalid and they would have had to enter into a new one once she turned 18. Think of it like this. The prenup and the marriage license were invalid so the terms of the settlement were decided by California common wealth law. Also, I should note, that given she was born in 1965, she likely would have been married in the 80s when divorce law was in its infancy.

@Kristoffer Pettersson Minimum age without parental consent is 18..... however, most states, including California, allows marriage under 18 with parental consent. Some states have age restrictions even with Parental consent but California is not one of them. "Every state except Delaware, Pennsylvania, Minnesota, and New Jersey allows a person under 18 years old to marry: If one or more of the following apply: consent of the parents or legal guardians of the minor consent of a court clerk or judge if the minor is emancipated." Or you could just go to California Family code 300 and find the actual wording: (a) An unmarried person under 18 years of age may be issued a marriage license upon obtaining a court order granting permission to the underage person or persons to marry, in accordance with the requirements described in Section 304 . (b) The court order and written consent of at least one of the parents or the guardian of each underage person shall be filed with the clerk of the court, and a certified copy of the order shall be presented to the county clerk at the time the marriage license is issued.

@@Lakillika I've had two personal family experiences with common law marriage in Oklahoma and Washington. Both were legal and binding. If you have sort of groundbreaking national law that overrides state law that started in the 70s, please share. Here are the quick facts for the states that still allow common law: Colorado: Common law marriage contracted on or after Sept. 1, 2006, is valid if, at the time the marriage was entered into, both parties are 18 years or older, and the marriage is not prohibited by other law (Colo. Stat. §14-2-109.5) Iowa: Common law marriage for purposes of the Support of Dependents Chapter (Iowa Code §252A.3) Otherwise it is not explicitly prohibited (Iowa Code §595.1A) Kansas: Common law marriage will be recognized if the parties are 18 or older and for purposes of the Divorce and Maintenance Article, proof of common law marriage is allowed as evidence of marriage of the parties (Kan. Stat. §23-2502; Kan. Stat. §23-2714) Montana: Not strictly prohibited, they are not invalidated by the Marriage Chapter (Mont. @@warrensteel9954 And it makes perfect sense. Prenup was signed once and probably put aside. Marriage was referred to several time even after she became 18 and other documents were signed. By acknowledgement and validation with repeat and probably celebration of anniversaries cemented the marriage even after she was of age repeatedly hence it can be validated by that. However, prenap is invalidated because of the one time and probably due to the fact that maybe they had never reviewed it. If they had reviewed it and dates changed, that's a difference case altogether. She won by default because she could also plead for coercion at that time due to her being a minor...... There is more weight to that statement than the simplicity that is shown in a few minutes of a movie. There is also alot that comes with the fact that she is a minor that could also cause the dude to drop that case so fast........ The argument is very plausible

From what I can find, if you're married before the age of 17, when you turn 18, if you continue the with the marriage it becomes legally binding unless you choose to void it. Something along those lines. If that doesn't hold up, common law would take effect given that they had children and were together for as many years as they were

When dealing with contracts of this type, a minor cannot be bound. In California, each spouse or partner owns one-half of the community property. In other words, she gets HALF.

It becomes a de facto marriage afterwards. Plus the marriage itself is not within the dispute of mutual assent. It is the prenuptial agreement that is. All in all this is pure drama, can't believe the husband's lawyer failes to know the basic facts of her lying on the age. Normally both sides would have known this fact and wouldn't be brought up on court with great surprise. That is a smoking gun which will end your case in minutes...

@@Reynolds69er There is no common law in California, or in fact most (43) states of the USA. People who have lived together a long time can attempt to assert some of the rights of spouses, but its by no means guaranteed.

If the prenuptial agreement is invalid due to her being under 18 when she signed it, then so would the marriage license. The marriage legally never happened, therefore she is entitled to nothing.

Maybe he gave the explanation too fast for you to catch. But the law in California is that under circumstances like this it is a de facto "common law" marriage (considered married by the state without there being an official wedding due to cohabitation and living as a married couple.) In California without a prenup everything is community property.

For everyone saying it doesnt make sense that her marriage contract is a void, but she still gets the money. It probably has something to do with the fact that she wasn't of age to make the prenuptual agreements, but she is now of proper age to get her half as a divorced woman

No. The prenuptial agreement is a contract and thereby void. The marriage is not a contract, but a license, and she is still married. Her being 17 at the time invalidates the prenup, not the marriage.

I can expand my point if you want to know why I think that. Even more, we can talk about social promotion, something that has been happening for the last 200 years, being extreme poverty in the world from 95% in the 1700s to 10% nowadays. Again, if you think you're right, you prove your point. If you show yourself agressive, perhaps you don't have a point, it's more like you don't have de capacity to dialogue.

His lawyer would have 2 strategies. 1. Seek an annulment to the marriage based on fraudulent pretenses (lying about her age). 2. Having the prenup deemed enforceable since she constructively consented to the prenup having failed to void it after reaching adulthood.

Never been married so I don't quite understand. If the marriage contract was void, then since they're technically not married, how can she be entitled to half the assets? Even if she WAS a Common Law wife, then she STILL signed the prenups, so then wouldn't the contract be ruled valid anyway. She shouldn't win anything. I'd have sued for fraud. Even if the contract was invalid because of her age, the fraud was ongoing, and she's definitely old enough now.

BUT - "Minors (those under the age of 18, in most states) lack the capacity to make a contract. So a minor who signs a contract can either honor the deal or void the contract. ... If it's not enforceable how is it binding which means you signed a worthless piece of paper. My 5 yr old neice can sign her name...but it's not a contract. Contract is enforceable by law or it's not a contract just a agreement

Whether she intended to fleece him in a divorce or just intended to be financially supported by him, either way it's intent to commit theft by fraud, in the sense of acquiring money or items of value under false pretenses. Here's the thing they glossed over or ignored: while bizarrely there is no minimum age to get married in California *with parental consent* (said consent must be in writing and witnessed by the court), the minimum age to get married *without parental consent* in California is 18. So, at 17, she was not legally able to enter into the marriage either. Therefore, not only is the prenuptial agreement null and void, so is the marriage. She could argue common-law marriage (if you live together and present yourself as married long enough, you are considered married for purposes of law), but since she entered into the marriage fraudulently and the husband presented them as married due to that deceit, he could challenge that. She'd also have a harder time getting custody (and thereby child support).

@@woodrobin No. The mens rea element in California requires specific intent to defraud. It also is not "theft by fraud" because at the time of the misrepresentation she didn't intend to permantly deprive any lawful owner of his property, which is a necessary element of a theft or larceny. Ironically, if she'd known ahead of time that she could use the fact she was underage to defeat the prenuptial agreement, you might be able to persuade a jury that this was her specific intent all along. The fact that Jim Carey had to figure it out while he was sitting at counsel's table suggests she lacked the necessary criminal intent.

Meaning that the marriage was real. But the prenup was void. And after the divorce she gets his money. A lot of it has to do with how the justice system works in our country. Like "She's used to a certain lifestyle" or "she needs all that money to help her with the kids" it's not right but that's just how it is. .

Adding on to what Figs said, California is a “no-fault state” when it comes to divorce, no matter what happens, the assets are split 50/50, unless one party claims domestic violence.

The thing is the husband could still technically win the case if he appeals having learned that she was under the age of 18 means that she committed fraud when she signed the contract. This would in fact open her up to a whole new list of lawsuits, worst thing that happened to this guy is that he lost the kids for a week.

Wait.....but marriage is also a contract which means that if she was 17 when she married and cannot enter a contract without parental consent, that means the marriage was null and void. So she isn't entitled to anything in the prenuptial because under California Law, her marriage was illegal thus making the pre nup invalid.

I believe if I remember right, he actually realizes this moments after this when his client decides to go after the children too so she can use them to squeeze more money out of the guy. I big part of this story was the character realizing what a jackass he was and the damage his behavior caused.

@@brynphillips9957 Yes he is jubilant at pulling off winning at first, but when she shortly after tells him that she is going for full custody of the kids ( whom she is awful to and doesn't really want ) just to get more money out of her ex his bubble quickly bursts as he realizes that his victory is really wrong and hollow as it is going to destroy this man and his children's lives. This really breaks him up and he feels absolutely horrible about it. He then desperately tries to change her mind but it only makes him feel so much worse when she then throws back at him the ridiculous she's the victim spiel he gave her earlier as her excuse for continuing to go after the ex's money.
