With reference to the subject matter, for Bank deceased claim requirements, without nomination, Claim amount approx.. 12 lakhs rupees, Need your suggestion on the following, Can a signatory of Affidavit Annexure “B” can also be a signatory to Letter of Indemnity Annexure “C” i.e. same person signing letter of Indemnity and Affidavit.

Sir, couple of Questions 1. Can the deceased person's son be a surety if he is not a claimant? The form instructions say relatives of the deceased may be accepted, provided that they are not claimants. 2. What can be shown as surety? Can Equity and Mutual Fund holdings be shown as the amount from Surety and balance in Savings Account? 3. What is the process if one of the heirs who are disclaimer lives abroad? 4. In the disclaimer letter, if the deceased had multiple accounts (like FD, SA, and PPF), does the disclaimer need to create various disclaimers for each account or mention them all in one? 5. Can a surety(unrelated to the deceased in any manner) also give an affidavit?

I have a succession certificate / COURT ORDER in my favour. Do I still need a sureity? It is the money lying idle in SAVINGS ACCOUNT ( WITHOUT NOMINEE) )of a deceased member of a family. Bank is not giving any advance/credit facility or their own money. It is the hard earned money of the deceased member. Now the other legal heirs claiming the money through succession certificate. I FEEL SUREITY IS ONE TYPE OF GUARANTEE IN THE FORM OF LIQUID ASSETS COVERING THE MONEY LYING IDLE IN BANK. ACCOUNT.

Sir will these same documentation work in case of claim for property documents after closure of loan? My husband expired on 2nd Feb 2021 and idbi bank is asking for legal hier certificate to hand over documents to me. In our case only I and my 4 year old daughter are legal hier under Indian succession act for Christians.. My mother in law is the Co-applicant of the loan and she does not have any objections in handing over the documents to me.. But the Idbi bank is refusing to give without a legal hier certificate..
