Great info about Social Security. I’m a CS with them and you guys hit the nail on the head. Remember vets, unlike VA, SSA’s definition for disability is havingan injury or illness that is expected to last 12 months or more or end in death AND keeps your from earning over the SGA limit.

Also, they mentioned the “Date last insured”. The more recent work history you have the further out a workers DLI will be. When filing for benefits if your DLI is in the future then you’re I. Good shape. If it is in the past, however, you’ll have to show your condition kept your from working before that date as miss Carol pointed out. Good luck all!

According to the IRS website, disabled veterans who receive an increase in their disability percentage from the Department of Veterans Affairs can claim a federal tax refund by filing Form 1040-X to amend their previous tax return. Is this something you can talk about for another video? Thanks for all you do!

I didn’t get to watch live but with all the questions on OSA let me state that I got it SC at 50% on the first try. Secondary to sinusitis. I explained to the examiner that my ENT doc suggested a sleep study because he asked if I snored and my throat was sore and I said yes. Should be easy to connect if you put it that way dependent on the examiner. Hope that helps.

Congratulations! I filed for OSA, secondary to rhinitis, and sinusitis in 2012, and my C&P examiner changed my claim to OSA, secondary to rhinitis. Thank God, Chris Attig, a veteran and VA attorney, for providing the free knowledge online. Veterans think it is harder to find someone to write and sign nexus letters now, try 12 years ago. By the way, my C&P examiner wrote my nexus statement and rationale. 😅

What happens if I receive a favorable appeal decision that would entitled me to 3 plus years in back pay on a TDIU claim - if I pass away will my dependents be entitled to the back pay sum ? Also to future survivor benefits ? Thanks. Tom

I just got 100 P&T plus i was award SMC-S put i havent got my SNC back pay. I have requested an audit into why I havent received my SMC and back pay. Was i correct to ask for an audit

There seems to be conflicting statements in this and other H&P videos. Do you need 1) 100% scheduler\combined or 2) 100% for a single rating to get SMC?

SMC-S requires that a veteran be 100% disabled for one single condition and rated 60% for their other combined conditions.
