The disqualification can’t become effective with immediate effect when the statutory appeal is available and the period of appeal is significant in the issue .

Then you are not aware of law in this regard. There was an attempt by Manmohan Singh government to give three months respite to the accused . Then the congress government brought an ordinance to this effect. But Rahul Gandhi himself tore the ordinance copy in a press conference. Singh was trying to help Lalu yadav. But on the advice of his advisers to show before the public that he is a person of integrity Rahul tore the copy of ordinance in public. So the law stands as it was before the TEARING episode. That means according to the law a person convicted two years Jail will loose his parliament membership the next second the judgement is passed. Here there is no role of government or EC or speaker. It is applied automatically.

Rahul Gandhi was right in tearing off the Ordinance-the liitmus test in such cases in law should be - does the law provide a similar priviledge to the common man? If so, then the MLA or MP should also be provided with it, otherwise NOT! Since an MLA/MP [or Gov.official] holds a position of much greater responsibility & authority and is vested with much greater trust by the system/Constituition [vis-a-vis common man], the consequences of a faux pas [& conviction] must be that much greater and more serious!In other words, during the period of his absence the MLA/MP & his party & constituency be allowed to suffer becoz of his irresponsibilty in landing in that situation!

The Law is clear that an MP or MLA stand disqualified immediately as soon as they are convicted and sentenced for 2yrs or more. This is actually a perfect foil for RG to go back to people and tell what BGP was talking n no action was taken but vendetta politics is happening against opposition parties. The law should not be changed where MP should be given time before he is dis-qualified.

No , Only in 19 hours he was disqualified from parliament from the time order transcript handover . On 23rd March 2023 at 06:20 pm order given permission to transcript in English and on 24th March 2023 12 he was disqualified by parliament secretariat and letter copy was given to him around 2 pm.

Also order was in gujarati so to a lawyer needs a Hindi/English translation which only the court given order can pass the permission to transcribe. So by that there was less than 18 hours given to lawyers.
