The biggest concern in POCSO is "The Age of Consent".. The whole purpose of this wonderful, well-formed, strict and prudent Act is defeated if it becomes act to decide and criminalize Love and Romantic affairs, which i strongly believe was not the makers of POCSO Act had in mind but rather the small, innocent children who hardly have sense to complaint against wrong doers.. The very fact that we find more and more POCSO cases in love affairs is not a good sign for Judiciary or general masses..Also Judiciary placing lovers and children rapists at the same podium and announcing same judgement is a great concern..Because its becoming more of a tool to separate a boy and a girl in love in every district of India.. Having said that, its a great Act and a great step to prevent and punish children molesters and rapists.. Just that lovers should be separately dealt with, not in this POCSO Act..

Yes, most concern is about romance. Concent or w ithout concent, agreed. But what about love matters? Concept of concent differs from love. Love is not discussed in the act. Why lover young boys should be put behind bar under this act? A girl short of 3 days in completing her 18 years of age elopes with a boy of 20 years and had twice she forcefully had sex with him. Now the boy is put under POCSO act. When the trial of the case takesplace and if the liar girl adduces before court that she was abducted by the boy and had 2 times sex with her, the punishment is upto death u/s 6. Is it justifiable? Is it a meaaningful act in this respect? There is a great contradiction between s-4 and s-6 of this act. Court should be very careful in framing charge when the girl is between the age of 16to18. 2019 amendment is confusing the age of 16 to 18 whether to frame charge u/s 4 or 6. In Tamil Nadu DGP has given direction to all police that no love matters should be immediately brought under POCSO Act. Instead parties should be summoned first for investigation and then there will be a case if the need arise. It is a welcome step. So many innocent young boys are convicted more than 20 years in this case because of these cheating lover girls. There must be an end for this.

*Age of consent & marriage both must be decreased* लड़कियों के लिए 15 साल और लडके के लिए 17 साल कर देनी चाहिए. 14-15 मे ही आजकल की लड़की सेक्सयुली मेच्योर्ड और एक्टिव दोनों हो रही है. लड़का लड़की स्वेच्छा से शारीरिक संबध रख अपने प्राकृतिक अधिकार का उपयोग करते है. लड़की के माँ बाप लडके पर रेप का आरोप लगवा देते है क्योंकि लड़की से 18 से कम की है. लड़की की सुनी नहीं जाती क्योंकि वो 18 से कम है और क़ानून के अनुसार 18 से कम उम्र की लड़की की कंसेंट से भी सेक्स हो तब भी लड़का बलात्कारी माना जाता है. राज्यों को इस क़ानून की आजादी देनी चाहिए. क्योकि पंजाब, हरियाणा, राजस्थान, हिमाचल, कश्मीर की नस्ल अलग है. वहाँ की लड़की लडके जल्दी हट्टे कट्टे, मेच्योरड जवान हो जाते है. सेक्स के लिए पूरी तरह परिपक्व. इसी प्रकार दक्षिण भारत ख़ासकर तमिलनाडु केरल की लड़की लडके भी शारीरिक मानसिक रूप से 14+ साल के बाद परिपक्व हो जाते है. अतः राज्य अपने अपने आधार पर *सोशल* क़ानून बनाये वो बेहतर होगा जैसा की अमरीका मे है. शारीरिक संबंध की इच्छा एक विषेश उम्र मे ही आती है जिसका अर्थ ही है कि लडके लड़की मे वो परिपक्वाता आ गई है. कुदरत ने शरीर मे वो रसायन या हार्मोन एक्टिवेट कर दिये. हालंकी मे MP हाईकोर्ट ने केंद्र सरकार से भी इस पर पहल करने के लिए तलब किया है जो सही कदम है. सेक्स एज्यूयुकेशन मे अगर सिस्टम और सरकार fail हो इसका मतलब ये नहीं की लड़का लड़की उनके प्राकृतिक अधिकार से समाज और क़ानून के नाम से वँचित रहें. डर के रहें. अतः चुनाव मे पार्टियों ko इसके साथ ही विवाह की उम्र भी लड़की के लिए 16 कर देनी और लडके के लिए समान या 19 करना चाहिए. जिससे पुनः स्ट्रांग फेमिली सिस्टम को restore किया जा सके जो धीरे धीरे फालतू आधुनिकता के चलते बर्बाद हो रहा है.. अतः काले क़ानून IPC 375 को बदलना या संशोधित करना जरुरी है. 18 साल का फंडा तो 90 के दशक मे राजीव गाँधी कि देन है. उसके पहले बालिग़ होने कि उम्र 21 थी.. ज़ब 21 से 18 करने मे कोई आसमान नहीं फटा तो 18 को 16 करने मे क्या होगा. ज़ब 18 साल का लड़का लड़की ड्राईविग लाइसेंस, PAN कार्ड, बैंक अकाउंट, कमर्षीयल पाइलेट लाइसेंस, शराब सिगरेट सेवन और मतदान का अधिकार रख सकता है और MLA, MP, PM, CM चुन सकते है.....दो शादी क्यों नहीं कर सकते...माँ बाप के लिए उनके youngs तो 55 साल कि उम्र मे भी बच्चे रहेंगे (उदाहरण :पप्पू ), इसका मतलब ये नहीं कि वाकई वो बच्चे है.. हमारे जमाने मे ही 9-10th क्लास के बाद ही हम सब लोग full fledged योनि शिष्न कि सोच मे सक्षम हो चुके थे.. जिसे मौका मिला उसने उस जमाने मे ही परिपक्वता दिखा दी. तो आजकल के बच्चे तो क्या नहीं सुन देख रहें. सेक्स को ले उनकी परिपक्वता उस जमाने के बच्चों से कहीं ज्यादा है.. कम उम्र मे यौन संतुष्टि व्यक्ति को अपने कॅरियर गोल्स और ऑब्जेक्टिव के प्रति ज्यादा एक्टिवेट कर देता है. रिस्ट्रक्शन कि अंदरूनी कुंठा मे बहुत से बच्चे जलते है और इच्छा दबा बहुत से वो काम शुरू कर नहीं कर पाते जो देश के भविष्य को स्ट्रांग करते है. आप को पानी कि प्यास लगी है और कोई कहे कि अमुक जगह कंसनस्ट्रेशन रखो ,, ये सम्भव नहीं.. जाहिर है यौन इच्छा भी एक प्रकृति प्रदत्त प्यास है. अगर वो अधूरी रहेगी तो हम इंसान नहीं सिर्फ कॅरियर मशीन तैयार कर रहें है.. ये कहकर कि अच्छा कॅरियर बना कमाओ और फिर प्यास बुझाओ.. 21 कि उम्र कॅरियर पीक होता है. इस उम्र के आसपास रिलेशन बाजी ध्यान भटका देती है. सम्हलना मुश्किल होता है.. पर अगर यही कम उम्र मे या शुरुवात मे ही हो जाए तो आगे सम्हलना और जीतना ही है.. जैसे अगर विकेट गिरना हो तो शुरू मे गिर जाए. पर जीतने और आखिरी पावर प्ले के समय जमे हुए खिलाडी का भी विकेट जीत को हार मे बदल देता है. - NJ
