Trainloads of Hindus were being massacred and many were too scared to cross the border as news of violence in West Bengal was equally bad. Also, as in Sindh some were too poor to even attempt to walk across the land and cross the border. But Sibal is deliberately muddling the facts by saying that Bangladesh became an independent country in 1971 and therefore was part of united India before that. During this period we did get a large influx of migrants from East Pakistan who were escaping the Pakistan army and they got assimilated among the "minority" community in India.

As such, people of other regions of India move into a state, thus gaining a stake in the say in the state's politics and policies. This also conflicts with the predominant culture in those states, as immigrants bring in their own culture. And we Indians are tought in 7th or 8th grade, about the right to migration within the country... Some north eastern states do have 6th Schedule, but several others don't. Even States like Ladakh, J&K, Uttarakhand, Himanchal don't have any such safeguard. And thus Sibal's right in saying that there's no legal grounds for a state (most states) or its community to plead to court about preventing influx of migrants from any part of India (though he's pretty wrong when saying that Bangladeshis have a right to migrate within India+Bangladesh, its pretty funny😂)

Although I am with you on the broader issue, I have to point out that your suggestion is absolutely undemocratic. In a fair justice system, everyone is entitled to be heard, which means both the right and the wrong and a judgment must be passed declaring one side or the other triumphant and founded on reasoning. What would be the point of a system wherein only those whom you think are right get to speak and not the ones who are wrong? Then there would not remain any distinction before the eyes of the public, "usko bolne mat do" is not justice.

CJI Chandrachud is not a regular person. He is one of the finest justices in india. Sibal is trying to get an upper hand by taking the battle from the ambit of legality/constitution to the stage of concocted history. Because he knows that CJI is well versed with judicial procedures and law, but not expected to challenge Sibal on matters that relate to "history", especially if the history is a creation of Sibal himself. However what he forgets is that The CJI is not someone who would take decisions in haste and will go back to study the matter in detail, including history and give a judgement that finally befits the legal outline of morality and justice, not history of Sibal!
