It depends on the permit which that visa was issued on, and how it was issued (under which program). Look at the program requirements of what your work visa was issued on and go from there.

Quick question: You stated that it takes 5 minutes to get the offer approved... is the offer you are referring to, the Work Permit or the whole process? Basically, how long does it take from start to finish (to receive the work permit)? Also, will it be better to visit Canada and do the process while visiting? Or stay in my country (France) and do the process?

If you are a French Citizen, you just need an ETA to enter Canada, so you can apply for ETA online. It takes 5 minutes for the offer of employment to be approved. Work Permit online application from France can take 8 weeks. Application from within Canada can take 3-4 months. You may also apply at the port of entry (airport) on entering Canada as a French citizen (visa-exempt). You'll get the work permit on entry. Also, after entering Canada as a visitor, after being issued the offer of employment, flagpole at a land port of entry with the USA, and get your work permit same day too. www.canada.ca/en/immigration-refugees-citizenship/services/work-canada/permit/temporary/apply/poe.html

You can start working once your work permit is approved. Unless you are currently on a maintained status in Canada that enables you to work for this employer, or already on a valid work status enabling you to work for this employer, or you are allowed to work without a permit, you generally must wait until the work permit is approved.

If someone is at a CLB 5 level and start working temporarily under Francophone Mobility, I'd likely advise them to pull up all their French scores over the next year to CLB 7 to qualify for category specific Express Entry under Francophone category. After 1 year they could claim work experience (as long as the position is skilled), and potentially an additional 50 pts, after serving a year for work experience with the employer on the closed work permit. However, everyone's situation is different. Maybe they really can't get CLB 7, but are working as nurse or tradesperson, then they will have a good path in Express Entry or the PNP's that favour these occupations in demand.

Hey there, I'm in the middle of the process to apply for a work permit under this program and I'm worried that my employer won't apply the right way and therefore risk getting a refusal at the end, so do you think that the process for the employer is complicated to the point where I should consider immigration consultancy to take care of it? and based on your experience what would be a reasonable average cost to pay for the immigration consultants to take care of this process? @@scharani2001 I always recommend at least a review by a consultant, especially if your employer hasn’t submitted an offer before. I offer them starting at $125 USD by the hour over screenshare and by doing so, can keep it an affordable option with convenient online booking options. Additionally, I always recommend at least a review of your work permit application if it’s a type you’ve never submitted before. I charge $2000 CAD for this type of application for full representation, including meeting with your employer and submitting the application on your behalf and preparing all necessary documentation and updates to IRCC as required etc. Less experienced consultants you might be able to find for $1500. Some may charge up to $4000, but anything more than that would be too much for FMP in my opinion.

Of course, there is no restrictions on having a PGWP and a closed work permit simultaneously. In fact, it can be beneficial if it's skilled work as that work permit can count towards 50 pts of arranged employment if you've accumulated more than a year of work experience for that employer listed on your closed FMP work permit.

The LMIA process is one that is dependent on the employer. Once the LMIA is approved, you can apply for a work permit, and processing times from France are listed on the IRCC website, but usually under 3 months. Great question. What a lot of people don’t quite understand is that you can have multiple work permits, they don’t cancel out or impact one another. However, most work permits are issued based on full time work.

Hi, what if you did not study in French for eg as part of a degree but studied French at a language school and you have an evidence of TEF or TCF at the required CLB 5

If you have a TEF or TCF with a CLB 5 in the speaking and listening part, that is sufficient. To confirm, you do not need to have studied in French at all. The only requirement for proving French proficiency at a speaking and listening level is CLB 5 on a TEF or TCF. Of course, if you go to the port of entry for work permit approval, a bilingual officer may speak with you in French to determine if you can communicate.

LMIA-Exempt are work permits issued under the International Mobility Program (IMP) whereas LMIA-based work permits are issued under the Temporary Foreign Worker Program. Whether or not you need a permanent/full-time job is dependent on the specific LMIA exemption, however, for the most part, full time/permanent is mostly the case.

Depends. For Teer 0 and 1 from outside Canada, it qualifies under GSS and can be processed in under 2 weeks if all other conditions apply. They also prioritize essential occupations. If I have PGWP 3 years remaining, if I want the points that the job offer gives with the Francophone mkbility, my PGWP will be canceled and I would move to a closed work permit with my current employer that want to support me? It would be a trade of f 50 point but on the other hand move from 3 years PGWP to 1, correct?

Great question, and of course you can do this to qualify for 50 pts if you meet all the requirements (approved closed work permit naming the employer, 1 year of full time work for that employer, etc.). You can have multiple authorizations in Canada, many people fail to understand this. Issuance of a closed work permit will not cancel out an open work permit.

The employer is supposed to pay and not recover funds from the foreign worker. I’d recommend using the employers card, in case officer has reason to believe employer is charging applicant.

Thanks much for the detailed explanation. Much appreciated. One quick que. I am on PGWP expiring this July. Could my current employer issue me an Offer of employment number via submitting all the details as you mentioned in the video? I am working full time, and employer can help, but I am not sure if this case would work out. Either I show as I am quitting and getting new offer letter? Or employer can just fill out the form and I apply for francophone mobility work permit? in order to continue working.

You would have to submit your work permit with this employers offer before your status expires in July, and show you speak and listen CLB 5 french. As long as job offer is outside Quebec and not unskilled in primary agriculture, then it should be approved.

@@ketankadam9779 there’s no specific requirement for work permit, but officer needs to be convinced you can communicate in position. 62100 is technical and skilled, probably would be comfortable with a CLB 7 benchmark.

A70 is not an available exemption code in the employer portal. I noticed under A70 "open work permits may be issued" so it appears that this exemption, is one that doesn't require the employer portal usage. ie. Spousal Open Work Permit, Bridging Open Work Permit, Live-In Caregiver Class etc. Be sure you use the appropriate guidance for the LMIA exemption your work permit falls under, and if it's for an open work permit, you must include the $100 open work permit holder fee. www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/foreign-workers/applicants-canada.html

It's not necessary to submit an Invitation Letter as per the work permit checklist. When there is a field that makes no sense/hasn't been updated, you can just upload a Letter of Explanation, that no invitation is required, and reference their current website documentation, the checklist, and program requirements if you need too. It's all going to the same place, submissions through GC Key. Some LMIA-Exemptions and International Agreements require one, but not Francophone Mobility Program.
