Yeah there are laws in the US that prevent setting traps that use lethal or maiming force. The idea is that you're not protecting the lives of the occupants if it's rigged somehow. You can defend yourself with lethal force against an intruder, but not when you have no idea what it's firing at. So that anti-theft system from robocop 2 that immolates a car jacker....totally illegal (not sure why anyone would want to smell burning flesh anyway) The big question is what chemical is being used and what it can do to the human body.

This is exactly my line of thinking. It's not a trap when the object clearly states - with a standardized warning icon - that it is pressurized and cutting it will cause an explosion. The same label and icon is on a can of spray paint, and that's not illegal

(Sans sarcasm: your spray paint can example isn't being used as a boobtrap. The issue is that it's illegal to boobytrap unattended things in many jurisdictions, which is why this could be a problem. So if you took that can of spray paint, and rigged it to explode of an intruder opened your door, you're committing a crime)

Which law supercedes the label I think would be the argument at least for attempted theft. There's also the fact that the bike could be in an area local or federal Gov't officials need to be cleared like firefighters or is off limits so cutting the lock as many legally do would probably result in a lawsuit or even a claim of it being an attack. Lots of variables here.

It depends on the standards of liability that end up applying. It was a while back, but in my engineering courses we went over legal liability and engineering ethics. If you get held to strict liability (being responsible for any way that customers use your products), a warning label is not sufficient to say that it is not your fault. Recently very few companies have been held to strict liability (see: Tesla autopilot crashes), but it may come back in style for the courts to use that standard. It used to get applied when people were using lawnmowers wrong and being seriously injured. A company could get in trouble if their product was conducive to being used in a dangerous manner, even if they had a warning not to use it that way.

It's not the marking it's if it is a "trap" a fence is not a trap, even electrified (although sign or no sign a kid walks up and hurts himself prepared to get sued on that one too). These laws weren't passed to protect criminals, they were to protect innocent people who may accidentally trigger them and get injured. The laws apply to everyone though so they also end up protecting criminals.

Rather than a presurized chemical, I'd rather see some word of fouling material like Kevlar strands to bind up the grinder. I'd also like to see some conductors running through it. If any get cut, it breaks a circuit that sets off an LRAD type of deffense.

There was a case in Virginia where a man set a shotgun trap to stop thieves who had been breaking into his barn and stealing antiques that were stored there. A thief breaking into the barn tripped the shotgun and was so severely wounded that his leg had to be amputated. The thief sued. The guy who set the trap had to sell his farm to pay the thief for damages.

a) Lock the bike to a pole b) Owner comes, turns out it's an emergency c) Call emergency services, lock has to go d) Lock explodes, injures emergency worker, he's out of commission, takes too long, whoever had to be driven to the hospital doesn't make it. e) You come back. Turns out, little mistake on your part, you didn't see the sign saying "no not block exit". You are now up to you goddamn neck in trouble. And if you think "that'd never happen" consider this: how many car alarms you heard/saw that were actually being stolen. Unless you live in [insert bad place here] you are more likely to cut it in an emergency or because you lost your key than it is to be cut by an angle grinding thief without any questions

It’s not legal to steal bikes either, but the paperwork makes police disinterested in enforcement. I’d suggest the same paperwork deterrent would stop a thief from being taken seriously about a lock that fought back during a theft. Let’s not let perfection be the enemy of good. I say let’s use the skunk lock and other active defence locks and put thieves out of business until police up their game.

Rather than thinking up lame "slippery slope" arguments against ideas, why don't you try on a new hat and apply the same energy to thinking of arguments for MORE justice instead of less? Allow me: - Betsy Williams is walking past. The thief is crouched at the lock. So the range of the lock only needs to be under 6 feet to be effective. She's 3-4 times further away. If the thief suffers no permanent damage, then she's fine in all scenarios. - If I'm wrong about that, then the specific mixture, pressure and quantities can be adjusted, to evaporate within the proximity of the thief and not passersby. And finally, in your scenario, how fucking likely, even with perfect wind, for Betsy to get a dosage any stronger than smelling marijuana? The key word there is LIKELY. Remember, car crashes occur frequently and we don't ban cars. Police make mistakes in the name of Justice all the time and medicine makes mistakes in the name of health. They are still awesome pursuits and we keep trying. We don't just think of excuses to give up.

"your honor, due to this incident my client now has a severe stress disorder where they cannot even leave the house for fear of seeing a bicycle and the mental anguish that it causes to the point he requires full time care as well as ongoing psychiatric treatment. we're seeking $10M in damages."

I also love the idea of this lock. But i have to wonder about it's longevity. I once had a can of mace explode in my face because the young lady's purse it was in was left in direct sunlight. (Several of us heard a slight hissing in class and followed it back to the purse. Soon as i went to hand it to her the can popped) Over time I'd worry about something similar with this being left wherever and degrading.

i’m assuming that the significantly thicker steel of this compared to a thin spray can will allow it to withstand significantly higher pressure. but the risk on the other hand is that when it finally explodes it will do so with a much higher force. so the question is what temperature is needed to raise the pressure enough to overcome the steel

These punks know they are going to get off and so just keep offending . for a lot of people their bike is their primary form of transportation , so the law should reflect that. i had a bike stolen many years ago and saw it for sale in a newspaper ( no computers in those days ) i called the guy and asked him if he could deliver the bike and i would pay him cash . he brought up to my second story apartment . i took the bike and then threw his ass down a flight of stairs .

Both of these solutions assume that the warning lable is noticed, which is iffy at best considering how often people notice signs. Cutting the bike frame - while a solution I thematically prefer - is likely to cause PR issues (as is seen when fire departments break car windows to access hydrants) Side note: I would also be concerned about how long the pressurized container is safe for use and how generally durable it is. How likely is it to break from rough handling when it gets a bit rusty?

That's actually related to one of the reasons why booby traps are often illegal They are a threat to children, and more importantly emergency responders as much as they are a threat to thieves. Imagine a fireman cut into one of these not knowing what it was. Trying to save a life, and gets skunked, now possibly blinded, in pain, or about to vomit, while holding a saw

Imagine locking your bike at a train station. The maintenance personnel comes to remove the bike after being left for two weeks unattended and gets hit with chemicals like this. Would be a lawsuit waiting to happen. Also I wish you would break the lock to see what it would look like.

Alright, this video is old but I have some things to point out. Now, a booby trap is most commonly defined as, "A camouflaged or concealed device designed to cause bodily injury when triggered by any unsuspecting persons making contact with the device." A few things right off the bat: One (1), this lock comes with a clear warning label explaining the contents of the shackle, what they do, what they are capable of, instructions on how to safely remove if required by an official, and to not remove the label (LPL appears to have removed it for reasons unknown). Two (2), the release of the chemicals is not triggered by anyone coming into contact. The shackle wall is 24mm thick, and made of a sturdy metal. It is highly improbable that it will be punctured by accident, even in any sort of crash. Three (3), on the aforementioned label, remember I mentioned it had instructions on removal by an official? It clearly states that if the removal of the lock is required (for reason such as abandonment), to call a locksmith to come pick the lock, contact the company to obtain a spare key, or contact the owner to come remove it. Now, what about bystanders? Well, the nature of the chemicals is that while they may be unpleasant to passersby, it will only induce vomiting to those in a close range. What about the pressurization? While they are under sufficient pressure, seeing as the most probable method to puncture the wall of the shackle is with an angle grinder, I highly doubt that the perpetrator's face will be close enough to cause injury. It's common sense (not to mention basic safety) to not put your face up close to any sort of power tool, and if they are close enough to sustain injury, then they were not following proper safety for the tool that they were using anyways. If for whatever reason you were taken to court over this, it would be civil court - not criminal - but I very much doubt that the perpetrator would win the case seeing as it is very clearly stated on the warning label that, "Hey, bad things will happen to you if you try to cut this lock." If anyone such as a janitor or firefighter is made to vomit by this lock, it would also be against the label, which clearly says how to safely remove it. Also if someone attempting to steal your bike did take you to civil court, you would then have a counterclaim because there would be either an admission of trying to steal the bike, or at least it would be very suspicious on how they just ~happened~ to release the chemicals from a 24mm-thick-walled metal tube that can only be punctured through extraneous effort or use of a power tool.

Heavily depends on the juristiction. In many states, the definition is a lot broader, concealment is not necesarrily a factor, nor is the way to trigger it. In many states or countries, a trap is anything designed to harm someone who triggers it. However that may be. Boobytraps are also a felony. Also no there wouldn't need to be a counterclaim. One crime does not make another crime ok. It's likely the thief would also get in trouble yes, but that wouldn't clear you from having commited a pretty severe felony.

another relevant question is that if you lock your bike to a place where it’s not allowed or bike-racks which will need to be temporarily cleared for an event, then the locks will be removed by government employees rather than thieves. does this change your liability status? it certainly changes the morality of it at least, since the poor employee is completely undeserving of the skunk spray! edit: sorry i saw that you mentioned the situation of an official needing to remove it. i guess the remaining question there is who’s liable if they don’t see the warning label

@@WolfgangDoW If it was too dark to read, then they were working in insufficient light. And if they are using an angle grinder, as was suggested, they may as well use a flashlight as well. They are not stealthy anyway. And they should have enough light to clearly see what they are cutting, so that they do not accidentally damage the bike being locked. About the label, I am working with the definition of booby trap, which requires it to be hidden of disguised. As it is labeled in a way which can be easily discovered without triggering it, I would not consider it disguised either. If the local definition does not require it, then anything that can potentially harm someone is a booby trap. Including windows. If you break one and try to climb through, the shards may cut you.

There's a way around that. Those signs say "Will be removed at the owner's expense". They don't say a thing about the locks getting cut or the bike remaining in one piece. Just cut the bike and leave the lock in place. Malicious compliance is fun like that.

If instead of 10 atmospheres it was only 2 or 3, to spread the chemics around instead of spray it out violently, and if instead of inducing vomit it just smelled really bad and made you want to leave, it'd probably still work and definitely not cause actual bodily harm.

Aside from LPL's point of what happens when someone suddenly let's go of an angle grinder and the severe damage that can cause, there is the fact that 10 atmospheres released suddenly in a narrow jet could easily cut through flesh. So we now have someone who has gashed his arm, hand, face from an angle grinder then is essentially injected with god knows what chemical. As ridiculous, absurd, and insane as it sounds, you are likely to be sued and lose. Most people will see it as overkill, especially for property like a bike. But then the one thing LPL did not include when he said the grinder can cause harm if suddenly let go of, is that if it kicks back just right, it will kill if it hits the thief's neck. Ahh, now we are looking at manslaughter, you aren't going to skate on that. The concept feels so satisfying and can get you into so much trouble.... for a bike. Think the risk is worth it? Risk - Benefit analysis 1: one out of every 10,000 causes great bodily harm to the tune of $200,000+. Are you willing to lose everything you have to preserve your bike? Risk - Benefit 2: one out of every 500,00 causes death resulting in you losing 5 years of your life in prison, AND losing everything you have to the family suing you for wrongful death, your criminal defense lawyer, and your civil defense lawyer...... For a bike? Yes the odds are very low and most of us like to think it won't happen to them. But unfortunately it can and it does to many people in similar circumstances. I actually like a combination of the suggested lower pressure and, from another comment, the dye used in a dye pack.

That's a stupid comparision. A furnace has a intended use, and the explosion occurs through mishandlement. This bike lock was specifically build to cause harm to someone, yes it is upon destruction, but it was specifically build to do that. A furnace isn't MENT to explode, this lock is. And yes, it is still a trap. A trap is anything that is supposed to cause harm to someone upon a specific intended action. If you get a lock that attacks someone trying to steal it, it's easy to argue that you wanted someone to try to steal it. You didn't buy the safest option, you bought the option that hurts someone. And there's a reason they say that. If a Lawyer gives legal advice to a person, that creates a Duty between the Lawyer and the Advised. If the Advised takes the info he got from the Lawyer and does something stupid because of it, then the Lawyer legally shares the responsibility for the stupid act, to what level tends to vary from state to state, and the mitigating circumstances, but it's never a good thing for the lawyer. There's also a potential for that Duty to exist if a non-lawyer gives legal advice, which is why you see a lot of educated people prefixing their opinions on something with I Am Not A Lawyer (IANAL). By the way, I Am Not A Lawyer, I am just a layperson repeating partial information I've gleaned from hearing lawyers talk online.

And as fast as word of mouth travels, bike thieves would know about this lock and cut it at their own risk. BUT, now that you've shown how easy it is to defeat this lock, it probably won't be on the market very long. And too bad for those who already use one.

That's what I'm thinking. It reminds me of using an electric fence for security purposes, which I believe are legal in many places, and aren't considered booby traps afaik.

Putting a "shotgun trap inside" sign on a door doesn't make having a shotgun trap inside any less illegal. The legality of using this lock is definitely questionable.

@@jonc4403 Guns tend to be lethal. Compare it to an electric fence. Would you sue a land-owner if you got electrocuted while attempting to trespass? Electric fences are established though and this is a new product, so I can see that being an issue though.

This reminds me of that old video where a guy sticks a stun gun into a bicycle seat and zaps would be bicycle thieves from a distance while he recorded them. There's also another video of a bicycle that was tied to a light post, and the thief either didn't care or didn't see it, pedaled down a hill, and then got launched onto the ground as the bicycle was yoinked out from under him.

Blinding may also cause issues, especially considering the use of power tools. Dye packs are used for money because they generally won't put the thief at risk of serious injury.

Swanlia, I have a $7,000 bicycle. The spray on the Skunklock is designed to stick to skin and clothing, not to bicycles. But, even if it had to be cleaned off, I'd ALWAYS rather have my bicycle in my possession than have it stolen.

The Reason for prohibiting boobytraps to defend property is simple: *They also work on emergency services* If someone on a Medical, Fire or Police emergency has to move you locked up bike (or is called onto your booby trapped property) they could be affected as well as any thief. And that is before we consider the issue that this is: a) Only property b) The severity of the impact can not be adjusted, nor is someone there to call emergency services if the severity is excessive. The person might be allergic or astmathic at wich point it becomes a deadly danger. c) Your property being legally transfered (inlcuding you abandoning it) does not disable any traps.

The only reason we consider, for example, chopping off someone's arm a crime is because it harms their person - which is their property - without their consent. It doesn't necessarily endanger their life and if done in a medical scenario may actually be the way to save their life. If we go to the logical conclusions of your "life over property" statement, a starving cannibal eating your leg to live is in fact in the right because his life is more important than your property. Even if we go to a less direct route like one that fits in the scope of this video, why can a thief steal the car/BIKE/horse/etc. that I use to go to work and thus feed my family? Don't I have a right to life - and thus my property - too? Don't my family?

An even larger issue is when this trap goes off, it is likely that the person removing the lock is doing so legally, for example an employee of the city removing an abandoned bike or a property owner.

Presumably one would need to seek medical attention for the effects of being hit by pressurized liquid that strong and/or would be caught because of it, leading to legal proceedings where the owner of the bike would be involved or at least named.

@@amythystmiriel Bikes don't have serial numbers or registration. The owner would basically have to come forward or be identified through a police investigation. Why would the owner come forward and identify themselves to subject themselves to liability greater than the value of the bike? And in a city where this is likely to be used, I think you're overestimating how much the police would care. If anything they'd probably just mark it as a statistic unless the guy dies. It would be such a low priority that by the time the guy got something moving there probably wouldn't be any way for him to find the owner

The bike owner would likely call the cops if they found their expensive bike lock cut off, if the police aren't there first. Gotta remember that someone using this lock isn't going to be thinking of the liability involved in using a booby trap to protect their property. They're going to want the thief arrested.

@@BodenM I'm not convinced it would, automatically, become dangerous. Depending on the failure mode it might rupture from the steel softening, but at that point the softened metal wouldn't crack and fragment so much as kinda moosh out of the way. This is entirely speculation on my part, of course.

@TheMrarrie18 I’ve hauled a lot of scrap over the years. I seen a lot of old bikes tossed out / junked with the old lock stored around the frame or handle bar crossbar (bmx bikes with those bars). So this very well could end up in a local scrap yard shredder, eventually. People throw out bikes that have sat for years, eviction clean outs, people die and stuff often gets thrown away, so yeah, don’t count on it not ending up as scrap metal. Not every thing gets disposed of properly / safely, and some people simply do not know any better.

I live in Bronx NY and just bought a Polarna ebike. I am going to use this lock. If a thief is "injured" committing a felony crime (bike cost more than $1,000) so be it. I will figure out the legality later in court.

nope, in the instance that all warnings are clearly identified, responsibility befalls the one performing the actions the warnings speak of. therefore they can not sue or gain benefits as it's deemed insurance fraud or willful self harm.

Potentially, or rather, it may not be a trap, but someone may still be liable for creating or using an unreasonably dangerous device. High pressure fluids are no joke, at short distances those can easily cut through your flesh.

That technicality would get you off in some jurisdictions, as a key feature of a "booby trap" in legal definitions can be concealment. Clear labels on the device act against concealment, but if it got that far it would be up to a judge to determine whether or not the label constituted sufficient warning. I would argue that its not much different than the use of explosive dye packs in cash bundles, or the stinky dye found in some school fire alarms, or other similar devices in use across state buildings and commercial properties.

My thinking is.. as long as it's very clearly labeled as a possible 'injury' the criminal at that point has accepted the risk and 9/10 times a judge will side that way. Assuming the criminal was dumb enough to admit to trying to commit a crime in the first place, which is probably 99% what isn't going to happen. Now on the flip side.. if some unattended young child with a hacksaw willy nilly cuts into it and gets hurt or for some reason there is a fault in the design and a bystander gets hit.. then you likely are in some legal trouble.

If it's very clearly labelled as a container of a potentially hazardous gas and to be handled with care, then it should be no problem, because at that point it's not a booby trap, it's a gaseous container that is the private property if one party, and the offending party ignored all warning signs, the fault lands on them.
