It's really just a technicality of the law. They can't let them free because they still committed the murder. Setting them free is more along the lines of "let's exonerate them, they didn't do it." But they did do it, so they have to serve something. A re-sentencing however would reduce the amount of time they have to serve by ruling their crime manslaughter rather than murder. And obviously if their sentence gets reduced then the time they have served would fulfill whatever length of time they get re-sentenced to.
