I've been Researching for a video related to the insanity defence and the McNaghten case. You did an excellent job explaining the rule and how is applied in a courtroom. When it comes to insanity defence, my personal philosophy on criminal justice favors rehabilitation, so factors that influence a crime should at the very least be considered.

Hello! Thanks so much for your kind words regarding the video. I tend to agree that, for purposes of insanity, rehabilitation is the necessary goal. Granted, to have been found insane, punishment is wholly inappropriate as the individual charged was not guilty of any crime, so there would be nothing to punish. But, where medical intervention, of some sort, is available to restore the person, I'm all for it. Unfortunately, many people that are found not guilty as a result of insanity, are never able to be restored and released from their medical confinements. Often, the disease is intractable, and the person cannot be released. Hopefully, with time and improved understanding of how the brain works, more people can be rehabilitated and able to reenter society following such an event. Good luck with your video!!

What about influences under drugs or alcohol and killing someone and does insanity is important in this aspect ?

Hello, and thanks for the question. How various states deal with crime while intoxicated depends on that state; each tend to handle it slightly differently based on case law and whatever statutory language they have. But, a fairly common theme is that intoxication is not an 'excuse' or defense to a crime, generally with an exception for first degree murder, which often requires premeditation. In so far as how this concept interacts with insanity, that would be an interesting question to research. I could see an argument that, were a person to engage in substance use as a direct result of an underlying mental health disorder, the substance use could be argued to be a symptom, and insanity could still be on the table. But, again, it would depend on the state itself, and I would defer to licensed attorneys in those jurisdictions for expertise.

I assume you live in India So I will explain the provisions relating to the issue in India :- Defence will be given if the intoxication is involuntarily/forcefully or without the knowledge of the intoxicated person If the consumption was voluntarily - no defence will be given Whether it will amount to murder or culpable homicide not amounting to murder will depend on the facts & circumstances of the case
