2 things here. #1 Trump was allowed Due Process. He had ample opportunity to involve himself in the case and defend himself. But clearly he chose not to. And then 14th/Sec3 does not require someone to be criminally convicted of anything. For example, not everyone in the Confederacy was convicted of insurrection or seccesion, just the fact they fought against the US was enough to keep them from being elected.

There is literally no basis for SCOTUS to overturn this ruling. By the US Constitution, elections are run by each individual state. This is the reason why it took Constitutional Amendments to give even the most basic voting rights. It's why federal voting law has to be worded and limited so carefully. I know that this won't stop SCOTUS from coming up with some irrational excuse, but I hope CO simply ignores SCOTUS on this, in favor of "states rights".

The Colorado Supreme Court agreed to rule on whether Section 3 of the 14th amendment applied to Trump. These are highly qualified justices. You can look up their backgrounds. Because of his actions on/around Jan. 6, 2020, they ruled that it did apply, that it was an insurrection, and they all agreed that he participated. Because of that he's disqualified from the Colorado ballot, including write-ins.

That’s not actually what it says. You go read it or have someone educated in the Constitution read it and explain it to you. If you had watched the Colorado Supreme Court appeal trial, you would have learned a lot regarding the lack of clarity in the way the section is written. It’s not that I don’t agree that he should be barred from running, just saying that 14.3 is a little weak in explicitly confirming that or who makes the determination.

There’s a really easy out here for the US Supreme Court “Each ballot is determined by the State, therefor it is not the position of the US Supreme Court to determine who can and cannot appear on the ballot.” That way you pass it back down to the states and only have to deal with the issue of “serving” as President if he actually wins.

The definition of a judge is someone impartial. The fact that judges in this country are openly partisan is bizarre. It's an antiquated system that needs urgent reform.

What would you suggest that reform look like? Depending on the state, our country has situations where a judge can be appointed by the current Governor, can be elected by the people of the state, or appointed by the vote of a governing body. In each case, the failure of the system is the personal bias of the person or group doing the selecting. Someone needs to chose the judge. If that person is a bad faith or character - such as Mitch McConnell and his treatment of the last four of the last five judges to be nominated to the Supreme Court, not act of law or change of process will yield a better set of judges.
