If the document is not registered, will it be as good as a registered document after i pay the stamp duty under this scheme?

No it wont be considered a registered document But atleast your document will have legal validation and can act as an evidence in court

Registration cannot be done under the scheme and post 8 months of date of execution, registration is not possible

if you have allotment letter with you, then you are eligible for the scheme

Hi sir namaskar, 😊mere dada ko 1968 me gift did me proparty di gai he document rajistard nahi he 60 ke bond pe he. Ab dene wala bhi nahi he or dada bhi nahi he, pr hm wo proparty pe 70 sall se rehete he, or muzhe ye janana he ke stamp duty or penalty done ped kiya to ,proparti card pe mere dada ka naam lag sakta he kya? I have paid stamp duty and it is notarised but it is not rehistered with registrar . So do i need to avail and regilarise title in amnesty scheme

We are staying in Bhayander East and our original agreement (1991) of the flat and shop are in the Thane Talao Pali registration office. A pending mark is noted on both agreements. Stamp duty registration fees are below 2000 rupees. How to collect our original agreement as so far more than 15 times we visited the registration office but still getting a response that it will take time. We are eligible for the amnesty scheme.

Yes, gift deed is covered in the scheme and benefit can be taken provided the gift deed is executed between 1st jan 1980 - 31st dec 2020

Given the Scheme is applicable from 1980 till date, is it safe to assume that stamp duty is not payable on agreements before 1980 ?

Agreements before 1980 also have stamp duty applicable on them and stamp duty has to be paid However, currently benefit under the scheme cannot be availed on such agreements as agreements before 1980 are not covered.

I have a query - please correct me - Share Certificate is an instrument and it is exempted from Stampduty as per stampduty act. So is there any change in the Act? This question will be for all who had purchased a plot in 1980's and 1990's and have build a society with involving builder and by appointinf Architect and labour basis work and by adding members. They will have only a share certificate as an instrument because they have contributed and build their own house.

As of now these allotment letters cannot be stamped. MahaSeWA has represented to the government and we are awaiting their response. Will inform the public at large when the government approval is available

The current owner will have to bear any consequences of less/no stamp duty paid by previous owner If you have paid stamp duty on your agreement, it is recommended to pay for the previous owner too so as to ensure clear title of property

Society NOC is not required to pay stamp duty, however confirmation letter from Society will be helpful
