When I was practicing law, when someone successfully argued for an 'insanity defence', that person would be sent to the state hospital but when he or she is adjudged to be sane, they would go to prison.

My goodness, Josh! I just watched your Podcast on your KZbin Channel Courtroom Confidential and now you are here with Luis! Of course I love Ana, but, I know she deserves some time off. ❤ Listening to you and Luis showing concern for the future of the child in the first case is heartwarming. I hope he goes on to live an amazing life. Thank goodness they caught Rachel’s killer and the person that assaulted the Mom and Daughter. The Mom and Daughter were brave to report their crime right away. I just wonder how many other victims he has. - Have a wonderful week!

How many "prophecies" is this guy going to carry out before he is finally properly punished for his crimes? I'm sick of mental health being an excuse to get away with murder and other crimes. It may be the reason but is no excuse to go light. Now we're going to have so many more others using that excuse and even knowing how to present themselves as insane with just a few searches on google.

Can someone from this state/the US please explain to me whether this man waited until the temporary restraining order had expired to kill his wife and if not what difference having a permanent one in place would make? The insanity issue is difficult because you have to prove psychosis/insanity in the exact moment that the crime was committed. Psychosis can and often does cycle in and out. It can be that someone is completely lucid at some times and completely "crazy" at others. This can actually be detrimental to both prosecution and defence which is why insanity defences very, very rarely work. It's also hit or miss whether getting a sentence in a mental health facility is a motive for faking an insanity defence because there is usually no fixed sentence. It's up to psychologists and professionals to decide whether their mental health has been treated and is under control, and whether patients can be trusted to continue their treatment on the outside and seek help if they notice changes in their mental health. That could be sooner than they would have served in prison or they could never reach that point and spend the rest of their lives in hospital. Whether or not this guy was or wasn't 'insane' I don't know, but the stigma surrounding mental illness and these sorts of assumptions about mental health facilities being a "soft option" make an already confusing area even more foggy.

A restraining order was denied. It doesn't even matter though because it's just a piece of paper. Abusers don't care about it. When I had my ex served with a restraining order he immediately left work and came straight to my house.

It’s absolutely terrifying dealing with a person I psychosis because there is no care or safety nets. In my state you can only hold someone 3-5-12 days. It’s so hard to get a person in psychosis help or in a safe place the laws need to change. Seems like with all the tech we have the system should be more effecting and step in before violence when it obviously a mental health crisis

My heart breaks 💔 for that poor lil 8yr old boy 😢 I saw alot of dv as a child from my so called dad to my mum n once saw him drag her from the bathroom by the hair and down the stairs when I was around 6/7. Thankfully she survived ❤ I'm now 52 and I can still see every detail of it 🥺 I hope and pray that lil boy can work his way through that awful situation 🙏❤

As a Christian, it always bothers me to see a perpetrator use Christianity as a defense for insanity. Nowhere in the Bible, does it ever say to use a human for a sacrifice. That is always pagan or demonic in nature. Also, real Christians know that the eternal sacrifice was made by Jesus Christ on a Roman cross. There is no more need of such sacrifice.

To be fair, all religions are very much aligned with enabling elements of psychosis (personally and or collectively). It’s not a mystery that’s exactly how they work and have evolved amongst humans where we find so many still swayed by or convinced by such ideas that ‘they’re’ in the right and others are wrong if they don’t follow whatever translation or interpretation that’s based on a specific or particular religious ideology. For example the flawed and contradictory statement about pagan, Roman and then demonic- while simultaneously implying a ‘real’ and ‘sacrifice’ that applies to your assumption that Christianity can be an identity. Take your time and don’t just dismiss that as if it’s offensive or not genuinely informative of realities, truths and phenomena that naturally will find it difficult to comprehend for many who similarly have become accustomed to relying on denial or ignoring things as that’s what is also prompted by many religious texts and dogmas. As far as using any religious idea as a defense for insanity, I noticed many confuse that as if it means not guilty or innocent. It’s not like that nor would it generally be interpreted as a reasonable argument in the US to claim Christian ideas as a means of insanity- even if it’s truth. Or possibly that the religious stuff is part of what fueled the flames a nuanced situation that led to or enabled that of an existing mental illness to be taken over the line- in other words lost his shit similar to how those involved with religious focused colonialism or imperialism enabled the death and destruction of so many over the course of history. Or things like the inquisition. Just some thoughts.

First off, the man who killed his wife was not insane and shouldn’t have gotten off. No way, no how. BUT I do believe that the insanity plea needs to be revised. I work in the prison system and see many miscarriages of justice. A person who knows the difference between right and wrong is not necessarily sane. A person can understand right and wrong but not understand that what they did is wrong. I had an inmate who had been to prison multiple times for fraud and drugs. He was so obviously mentally challenged. Child like. The fraud was depositing stolen, forged checks through his bank account. A friend asked him to cash his “paycheck” for him. It never occurred to him to decline. He had a bank account and the friend didn’t so he deposited it and gave the friend the cash. He did this several times. This was his buddy , of course he would help. Of course the “buddy “ denied knowledge when it was discovered. He knew right from wrong but he just wasn’t smart enough to question the request. I am smart enough to question his account but after spending considerable time with him it was so very obvious that this was a child in an adult body. His bills were paid by a caretaker he couldn’t even manage that on his own, but here he is in prison, being held accountable for a crime he was not even aware he was committing. Looking at his previous charges, they were all, except for the drug charges, just like that. This man needed to be held in a mental institution, not a prison. In regards to the man from Elsalvadore, I see that every day. No visa, no green card, no means of support, running from the law in the native country. Committing crime after crime. Are they deported, no. Thayer are paroled to go do it again. I used to regularly see deportation detainees on these guys but not any more. I haven’t seen an ICE detainer in months.

Calling somebody who has been legally judged psychotic a "clown" or a "monster" I find very offensive. Mental illness isn't a choice. We can only get folks the help they need if we stop perpetuating the stigma of seeking it, and being labeled clown or monster when one is sick is counterproductive. I hope the family sues the court system for refusing the restraining order (although psychosis means the husband might not have comprehended its meaning, it might have given her more confidence to call the police yet one more time...) The young boy may well indeed have become a victim -- instead, he's a survivor. Good job! This case reminds me of my next door neighbor, clearly mentally ill, who took a knife to her teen daughter's neck to release the demons infesting her because she watched horror movies. This chronically homeless woman had convinced CPS to give her custody of her daughter. According to her Bible she was doing the right thing by letting out the demons. Fortunately the girl made it to my apartment and police were called. Mom was clearly schizophrenic but our culture respects Christianity so very much that they thought she was pious and god-fearing, not nuts.

If more people (including people who call themselves Christian) actually knew God and the Bible personally they would be able to discern doctrine and behaviors that are not of God. If it is immoral and hurts people in any way it is not from Jesus. The devil loves to use counterfeits and mentally ill people are easily tricked.

4:34 this guy alleges to be a *police expert* , yet states “domestic violence can be mental, or emotional”.. That statement is so far from the truth, it shouldn’t have been said…There’s no law to charge someone with in ant state under mental or emotional abuse. Domestic violence is (unlawful touching in anyway of another human). It’s violence against your significant other… The way this so called expert makes it seem is that every time you call your significant other “FaT” it’s against the law….😂 I had no idea the laws now charge people with emotional crimes !! 😂

As Domestic Violence is defined “a violent or aggressive behavior within the home, typically involving the violent abuse of a spouse or partner.” You being “an expert” should know there’s no statute in any state that would criminally charge a person with “domestic violence” for (isolating, coerce, blame, frighten, manipulate, intimidate, psychological, economically, and certainly NOT going to charge anyone for emotionally being abusive)”.. Mica Millers’ husband John Paul Miller did (isolate, frighten, manipulate, intimidate her, was verbally abusive, intimidated her, economically ruined her, so why isn’t he being charged ? Why ? is because those are not arrestable offenses… You should look up the definition of battery..
