She broke the lease. At the very least she should lose the deposit. Plus, if she didn't give him the exact date she was moving out (before the baby is born isn't enough as it's a large time frame), he couldn't really find someone since he wouldn't be able to give them a date they can move in. Legally he can claim the deposit as the fee for breaking the lease.

I think he is just a sleazy guy in general; he took her security deposit, cleaned three rooms and wanted her to pay rent that she wasn't there for. It's really that simple. Kind of hard to date if you got to be always pg13 in your apartment. So I don't think that unreasonable, what's unreasonable is his expectations of a pregnant lady that he's evicting after 5 months. A normal person would say congratulations , be understanding and say I will look for a new person in the meantime, if you can help that would be great, but I understand you have other health priorities right now.

He is not the landlord, he is the primary renter. The rent is $1500 total, his friend pays $500, he got her to pay $550. That means he only pays $450 for his part of the rent.

I agree with the judge -- the plaintiff was given 5 months notice before the defendant moved into the townhouse that she was pregnant and that she would need to move out before the baby was born. He said that he didn't post an ad because the defendant said she would find someone?! NO!!! You NEVER leave it up to the tenant to find someone, unless it's stated in the lease agreement. Otherwise, that's HIS responsibility to find someone, not her. She has other things on her mind, not to mention that she was in the middle of the creation of a complex human being. Again, LAZY!

The difference here is that he would not allow a baby to live there. That releases her from the lease by default due to a birth being a natural occurrence and his refusal to allow it. Her giving him 5 months notice put the burden to find a new roommate on him.

IMO it’s a bad decision from JJ. Why is it his responsibility to find a replacement? The lease is a written agreement where she clearly agreed to pay for the full term. It’s her responsibility to find a replacement if she’s breaking her part of the lease. Let’s say the guy gave enough notice to the land lord and left 2 months before the lease ended. will the guy be left off the hook? Heck no. The landlord will come after him and make him pay for the entire term. Because it is written contract!! I can’t believe she got the sympathy vote for her pregnancy. I feel bad for the guy 🐠💨

Some landlords just are greedy. Our last landlord before we bought our home, after hiking rent up twice in as many years might I add, kept our deposit. His only reason given was because he had to replace a cheap blind for one window. We had taken all of his blindes down in favor of our curtains. He even liked them so much that he tried to talk me into leaving them in the apartment. I told him no as nicely as I could. When we moved out and cleaned behind us, we put all his blinds back up, only one we had accidentally broken when we took it down and never knew. We apologized for it and even offered to replace it before returning the keys, but he said not to worry. Then he kept out deposit. And blamed his "broken property" for it. It was a total insult, and I still say it was because I wouldn't just give him our curtains. So grateful not to have a landlord.

I don’t think JJ listened to his case. He tried to bring up pet deposit she did not pay at $300 which she owed landlord not him. That means he had to pay that money because clearly she had a cat. She also was added to the lease which means this guy and the other roommate were liable for her third of the rent which she clearly did not pay. She go pregnant and still lived there for several months. She decided to leave to live with mom. That does not mean he told her to leave. She owes the rent because she did not sublet but put her name on the lease with the landlord. The landlord withheld the deposit since she did not pay rent or pet deposit. This guy is just trying to recoup what he had to pay because she did not fulfill the lease. It is her responsibility to find a replacement not his.
