Who cares what happened first. The officer used excessive force when detaining the suspect. He deserves to be suspended and charged for the alleged offence.

The law cares bro - it's called mitigation. It could be argued that the armed officers showed restraint in not drawing their guns, There are certain cities in Europe where behavior like this could have resulted in the perpetrators being shot dead.
