Can you explain how in a problem question do i use the services directive 2006/123? For instance if it falls under the directive or is caught by the directive then what is the outcome?

Can compensation measures be derived from primary law? I assume that if it is necessary for a member state to impose compensation measures, they are obliged to do so. But in a case where the directive does not apply, what happens then? As it follows from Dreessen C-31/00 that "It is not the purpose of those directives to make recognition of such diplomas, certificates and other evidence of formal qualifications more difficult in situations falling outside their scope". In Case C-104/91 and C-234/97, the candidate was required to show that the knowledge and qualifications were acquired, by passing an exam. This would be the same as an "aptitude test". However, do the candidates have a right to be imposed compensation measures, in order to be recognized, or can the host member state simply choose not to impose these measures and reject the application all-together? That would seem counter to art 4 "The Member States shall take any appropriate measure, general or particular, to ensure fulfilment of the obligations arising out of the Treaties or resulting from the acts of the institutions of the Union." The question was asked in case 166/20 "should Articles 45 and 49 TFEU and Article 15 of the Charter be interpreted as obliging the competent authorities of the host Member State to (...) if necessary, to apply compensation measures? The ECJ unfortunately did not answer whether this was an obligation. They quite simply said "If that comparative examination reveals substantial differences between the education and training undertaken by the applicant and the education and training required in the host Member State, the competent authorities may set compensation measures to make up for those differences."

What rights does an individual have (pre brexit) if they wanted to have a job in an Eu member state but that country had laws requiring the individual to have worked in that said country for a certain amount of years. Are there any cases similar to this? Any help would be greatly appreciated

So If I have a company based in the UK, let say is a property agency service. If I want to set up a branch in France to expand my business in the summer time only. What company law do I follow? for example, if France need to have certain amount of asset in France in order for me to setup a branch? also, if I am not running the business through out the year, but just the few months of summer time?
