Just wanted to highlight that for concentration (merger control) there is a third negative condition which is *unless each of the undertakings concerned achieves more than two-thirds of its aggregate Community-wide turnover within one and the same Member State. this condition is also applied cumulatively with the two conditions you mentioned.

Regarding concerted practices: behavior is not enough, there needs to be some contact- a meeting needs to be proved! Thats the difference with tacit collusion, where there is no contact between the undertakings! Tacit collusion is not caught by 101. Maybe under 102, if we follow the Court's doctrine of collective dominance

This video completely misunderstands the application of article 101! It is NOT only for cartels! NOT ALL anti-competitive agreements falling under article 101 will be considered cartels! In fact, most agreements under 101 are not cartels! 101 also covers agreements between levels in the supply chain (vertical agreements) and does not need to include agreements between competitors (horizontal agreements) at all. Article 101 prohibits anti-competitive behaviour. While this includes cartels, it is completely misleading to say that the primary focus of it is the prohibition of cartels - because that is simply incorrect! Parts about Article 102 and merger control were a completely fine basic intro to competition law, but the explanation of Article 101 is very flawed!
