Every time I try to play it (ultra rt with ultra graphic _1080p), after a while I get an error while the game is running at 40 to 70 frames. " the game has crashed due to using more video memory" some people are getting the same error with 4090.

You'll gain FPS If you choose DLSS Balancead then you'll get more FPS with better image, better then native image.
