Arizona attorney here. The order of deportation restrictions are highly dependent on due process rights. If GOP Congress is successful in overturning the rulings that gave immigrants due process they will have not have this protection. The GOP is planning on overturning the birth rule and the revising Naturalisation laws, and will do this either by statute or executive order. Then it will up to the SCOTUS whether they protect these rights. Based on recent rulings we may see a complete breakdown on these protections. Please note the new Border czar has stated that anyone here illegally IS a criminal by definition. So you won’t have to be a convicted criminal to fall into this category. Buckle up.

Asylum seekers will only be allowed to seek asylum from outside the country, and if they have never entered the country illegally before. Anyone deported from being in the country illegally, cannot apply for asylum. This is the law that is currently on the books.

my son is married to a young woman from mexico who is here legally she's married to a citizen and has a green card. last spring they went to juarez to work on her citizenship. they made her spend an entire day at the american consulate apparently checking for tattoos and gang signs. she is a nice quiet young woman who is not a gang member and who has no tattoos. she has a good job doing payroll for a portland oregon contracting company. they were married in 2016 about the time trump was elected. they found an immigration attorney, but Trump had shut down the entire process. last spring my son called me very early one morning with the news that his brother-in-law had been murdered the night before while walking in his own neighborhood, which is a portland suburb. my husband and I attended the service and it was heartbreaking. I've posted this elsewhere and several people made extremely hateful comments about how he was probab;y murdered by another illegal. except he was here legally. I can't quite wrap my mind around how people can be both so ugly and mistaken at the same time. So anyone who reads this if you have hateful comments please keep them to yourself.

Everyone is entitled to due process under the laws of the United States, regardless of Citizenship status. That means they have the right to fight their case in Court, what happens in Court is a whole different story and likely to change over the next 4 years. Right to due process is covered by the Constitution, what are you talking about? Maybe you are confused about what Due Process is. Legal immigration is what my channel is all about. Have you ever had a lapse in your registration for your vehicle, forgot to get it inspected when the year was up? Due Process rights allow you to appear for the ticket you recieve in these situations instead of having your car repossessed and sent to jail for breaking the law of driving without an inspected vehicle, that would be extreme don't you agree? Sometimes people enter the country illegally, and then stay and assimilate for years, paying taxes, marrying US Citizens, having children, volunteering at church. Those people have to work very hard to fix thier status legally. This is who you are talking about removing due process rights for. They can be sent to Court like everyone else, and a Judge can order them deported, just like sentencing in a traffic or criminal court, and afterward physically removed from the Country, that is Due Process. They cannot be removed without first having the order of deportation, similar to conviction. Imagine, you are walking down the street without your ID because you are just walking across the street to a neighbors home and the police arbitrarily pick you up say you are "Illegal" and deport you to the nearest country willing to accept you, that would be an example of failure to comply with your due process rights to argue that you are not "Illegal" and actually a Citizen or Permanent Resident or entitled under the current law to adjust your status to a permanent resident or Citizen. It will not happen in the US, because it is ludicrous and goes against the US Constitutional Law.

If a person is inside the borders of America without lawful permission, there is no need for a court hearing. They can be arrested and immediately deported. Hearings must be applied for when a person is residing in their home country. However, if that person has ever been inside America without lawful permission, they cannot apply to enter America under any circumstances. You're confusing Obama and Biden's choice to ignore and not enforce the law, as actually being the law. Due process isn't afforded to someone from another country, while outside the country. If we ignore the laws on the books and pretend that hearings were required, then we would just expand the courts needed for efficient processing. Though there is no need for this.

That's easy to say behind a computer screen to a general public. How would you feel saying this to your waiter? Your friend? Your family member's spouse? I understand when a person is a criminal delinquent with a history of breaking laws, but a person whose only crime is entering the country to avoid starvation, or violence, and does nothing wrong, helps the Country's economy, pays taxes and has a family of US Citizens living here for over 10 years, probably shouldn't be forced to leave, it's more harmful for the US Citizen family members, and the economy. my DIL is Mexican and is here legally. She has a good job doing payroll for a contracting business in Portland Oregon. She works hard and pays taxes. Spreading hate and misinformation is never the right choice but it appears to be reflection of the educational level of many commenters here. Try doing actual research. you know use the skills that you learned in the research methods classes that you took in college.
