My open letter to CJP after his speech today is in a full court reference at the start of the new Judicial Year. Mr. Justice Qazi Faez Isa, Chief Justice of Pakistan, Constitution Ave, Islamabad My Lord, You just concluded your speech recounting SCP performance in the last judicial year. I could not help noticing that you did not refer to the letter written to you by the judges of IHC with respect to interference and dirty pressure tactics employed by various agencies to get judgements of their choice. This letter highlighted the most important and critical aspect of justice being denied in select cases, mostly of political nature. Being the head of an important pillar of the State, do you not think that you failed in your job as CJP by failing to address this extremely sensitive complaint? You talked about your efforts in ensuring the sanctity of fundamental rights but you omitted to comment on your dubious decision to make the exercise of a fundamental right by illiterate voters difficult by not allowing a political party their regular election symbol. This judgement of yours was wrongly interpreted by the Election Commission when they debarred a party from contesting elections as a party in the light of your decision to deprive that party of their election symbol. You have acknowledged time and again that this was a misinterpretation by ECP but I have the right to ask you, why did you not interfere promptly through a suo moto instead of taking the plea, that party did not approach you. I hold you directly responsible for this ommission on your part because I can not help but hold your directly responsible being a part of the greater scheme. All this turmoil, confusion, polarisation, and loss of face by Establishment today is because of your questionable decision and then your failure to correct a blatant misinterpretation in a timely manner. Commissioner Rawalpindi named two, you and CEC, who directly interfered in the conduct of elections on Feb 08. You, being the top judicial officer in the country, were named, and you conveniently brushed it under the carpet. Why did you not refer this matter to SJC? Why are the whereabouts of that Commissioner still unknown. Don't you consider that he is being deprived of his basic fundamental rights. What does all this prove as a common man to me? In simple terms, I do not consider you a fair judge, and the greatest misfortune of this country will be if the proposed clandestine amendment for enhancement of ages of judges is passed to facilitate you. This country does not have the capacity anymore to tolerate a biased judge as a top judicial officer to continue for a day more. Please also appreciate that this is my chargesheet against your personal conduct and NOT the institution of SCP. Thank you for taking the time to read my complaint.
