Per incurium judgment of SLP is not binding on lower court but is it binding on the parties? Will respondent be liable to contempt of court if he does not obey per incurium judgment?

It seems, in absence of judgement of Supreme Court and even own High Court, on any law point, the lower courts of that High Court are not bound to follow the judgement of other High Court as recently taken on the same law point.
