Its not out of tune its just on a other frequency Its completely different

The album is in tune, it's just that it's somewhere between 425-433 Hz instead of 440.

Dave was credited on The Four Horsemen, and The Mechanix was completely his song anyway so there was no real need for legal action. Only Dave could have sued if he wanted to

Metallica can't sue for copyright infringement they are the ones who took the song BUT they did give Dave credit and it was free publicity for Megadeth since Metallica was becoming really massive and the debate was always brought up.
