Mercury Grand Marquis pursuit - Driver takes Arkansas State Police to Grandma's House

Trooper's Report: On 11/26/2024, around 14:36, I was patrolling eastbound on East Ninth Street (U.S. Highway 82) near the intersection with Pinehurst Street in Texarkana, AR, when I observed a white Mercury Grand Marquis approaching me westbound on East Ninth Street. The driver made an abrupt stop and turned right, north, onto California Street and accelerated quickly. When the car turned, I noticed its tail lamps were tinted and reduced their visibility, a violation of Arkansas Traffic Code 27-36-224, and his side windows were tinted below the legal limit of 25%, a violation of Arkansas Traffic Code 27-36-306. I then turned and began to try to catch up to the vehicle on California Street to initiate a traffic stop for the violations. The vehicle turned right, east onto East 13th Street from California Street and I followed. As we approached the intersection with Ray Street, I notified dispatch of the traffic stop and activated my emergency lights. The suspect disregarded the stop sign at the intersection, turned left, north onto Ray Street and accelerated. I notified dispatch that I was in pursuit. We reached speeds of about 49 miles per hour in the 30 mile per hour zone. When we approached the intersection with East 15th Street the suspect failed to obey a second stop sign while another vehicle was stopped at the intersection. The suspect crossed the opposite lane of travel and parked his car on the left, west side of the road facing north in front of 1507 Ray Street. The driver immediately opened his door and began to exit. I was able to exit my vehicle with my duty pistol drawn before the suspect exited his vehicle. I retreated to the rear of my vehicle for cover and began to provide instructions for the high risk stop to the driver, Dailon Cheatham. While telling Cheatham to stand at the rear of his vehicle with his hands on his trunk, he decided to turn, face me, and jump up to sit on the trunk. The passenger in the front right seat, Takary Wright Jr., opened his door and stood up multiple times with me instructing him to stay seated to ensure he didn't flee. When additional law enforcement officers arrived, we continued with the procedures of a high risk stop. A Texarkana PD Officer called Cheatham back and took him into custody, and then we tried to call back Wright, but he wouldn't listen. The Officer giving directions to Wright then approached Wright and I followed to place him in handcuffs. Other Texarkana Officers approached the vehicle to ensure there weren't any additional occupants in the vehicle. Officers located a small bag of marijuana in Wright's pocket when they searched him. Wright and Cheatham both had the odor of alcohol emitting from them. While performing a probable cause search of the vehicle, we located additional bags of marijuana in the glove compartment. I located a 24 ounce can of Twisted Hard Iced tea in the brown paper bag, upright, in the floor near the driver's seat. The can was less than half full, and the contents were still cold. I tested the front right window's tint and the tint applied to the window only allowed 2% light transmission. The vehicle was towed by Neeley's Wrecker Service. I transported Cheatham to the Miller County Jail and conducted Standardized Field Sobriety Testing. I began the testing with the Horizontal Gaze Nystagmus. I observed clues in each eye on the Lack of Smooth Pursuit, Distinct and Sustained Nystagmus at Maximum Deviation, and the Onset of Nystagmus Prior to 45 Degrees. On the walk and turn, I only observed an improper turn. I didn't observe any clues on the one leg stand. At 15:49 Cheatham provided a breath sample of .06. A person's blood alcohol content drops at a rate of about .015 per hour, and there was about an hour and 13 minutes between the time Cheatham fled from my traffic stop, and the time he provided a breath sample. Cheatham was booked on the charges of: Fleeing - Vehicle or Conveyance - Exceeding the Speed Limit, No Drivers License, Reckless Driving, Drinking on the Highway, Possession of a Controlled Substance Schedule VI less than 4 ounces, and cited for Display of Lighting Devices and Driving a Vehicle with Improper Window Tint. Wright was arrested for Possession of a Controlled Substance Schedule VI less than 4 ounces and Obstructing Governmental Operations. When I read Wright his charges, he explained he was scared because my gun was drawn and he was shot seven times by an unknown person earlier this year, and another time in the head prior to that. Wright proceeded to show me scars from gunshots on his head and chest.

I have seizures (Severe Frontal Lobe Epilepsy) and when I was first diagnosed, I was not even allowed to ride a bicycle much less operate a car. So, I am surprised how many folks in Arkansas are allowed to cruise down the road with a seizure disorder bad enough that requires them to carry meds on them at all times. If I were ASP and someone told me they had seizures, my first question would be, "Who is your neurologist?"
