I agree that the woman was at fault, but the train guard shouldn't have dispatched the train either. I think the solution is to remove the guard's duty of care to passengers. The guard's duty to protect the passengers should not come before the passenger's duty to protect themselves.

I feel sorry for the parents but the fact that the parents are solely blaming the guard is disgraceful. The girl was being a nuisance and putting herself (knowingly) in a situation that seriously risked her life. Eventually something like that is inevitable.

I wouldn't go that far, you can blame the Heroin and Alcohol that she took not knowing the consequences of it. The result of this is ironically the US backed War On Drugs, this incident proves that this drug war in not only ineffective, but even adds fuel to the fire if 16 year old girls are able to easily get hold of Heroin and end up dead like this. I agree. This is tragic for all involved, and clearly whilst the guard has the responsibility of conducting his duties, people also need to take some personal responsibility for their own safety. This doesn't just apply to rail, it applies to all aspects of life whether driving a car, or crossing the road.

I was Security at the the time on these trains. She was also, jumping off and on stations prior to James Street and appeared to be more than just alcohol intoxicated. The train guard was just a fall guy to blame, to not give Merseyrail bad press, so they had to put the blame on somebody. It was completley her own fault, not the guard. Been in his cab many of times and he gave the 2 ding signal properly at the correct time (she was away from the train doors (step) but then decided to grab the doors as the train moved off after the driver got the 2 dings, resulting in her foot being caught and dragged under the train.

It puts you, themselves or others at risk of danger. If someone does push someone who is drunk or toxicated could easily have a accident and hurt themselves, for example banging their heads. In my opinion, people who are drunk or toxicated should be rufused travelling on railway stations or travelling on trains because some people who are drunk or toxicated have no control by what they're doing. They could easily put themselves or others at risk of danger. People should always be sensible or behave on railway stations because people need to have control and awareness of themselves and others. Personally, people need to be careful if they have been drinking or going out for a good night out. Honestly, the girl's friends make me angry and disgusted because the poor girl who lost her life was alone at the time of incident. As a dispatcher myself, it is extremely frustrating that people do this alot and I want to send the train out regardless, but I cannot. Every dispatcher knows this is a regular occurrence and we have to deal with it. I understand the man's annoyance at her stupid, drunken, immature behaviour, but he has to perform his duties as taught. She is incredibly stupid, but he is more so for what he done.

The Merseyrail Guard shouldn’t have been blamed for an accident he had no control over. While he sort of DID breach safety rules, the drunk girl should not have even been leaning on the train. A lot of victim blaming in this comment chain which is disappointing but people into trains are more likely to have empathy (if they have such a thing) for the guard than the girl and don't want to consider the wider ramifications The fact is, a human life is more important than dispatching your train on time. You might have a smug "well, she'll move when the train moves" attitude, but the truly responsible thing to do would be to not move that train until she was back behind the yellow line. Doesn't matter if the train is late, doesn't matter if you have to keep sounding the horn or asking her to move, even requesting help from the station staff, whatever. Do not move that train with a human being leaning on it. It wasn't the drink that killed her that night, it was the train moving.

But the fact that someone is a nuisance doesn’t mean that you should let a train go when a person or thing has contact with the train. How is the train guard not at fault here? He neglected her safety. He signalled for the train to go when it was not safe to do so. Of course she was drunk, high and unaware of her surroundings. But that doesn’t mean the guard isn’t responsible here. At the end of the day, it was his signal for departure when it was clearly not safe that caused a death here. Had the guard not gave the right away, she would not have lost her life that day.

I do understand both sides of the debate, in fact, I think it was both of them. The guard sent the train off and honestly yes she might have been a pain but you don't kill her! She was leaning on the train as well and the fact that the mum is trying to defend her actions is stupid. She was out in town celebrating her friend's birthday party, she took a drug called Mephedrone or M-CAT at the party as well as being 3x over the drink drive limit. It says that in the official court release. While the guard was partly at fault she should've been well away from the train when the doors were closing, the guard was screaming at her to stand away from the train but she would not budge. Yes, he was partly at fault but blaming it entirely on him is disgusting.

Death sentence seems unfair especially considering the girl was: 1. Underage and drunk 2. Repeatedly acting irresponsibly at multiple stations 3. What looks like she is messing around with the doors on the train So both the guard and the girl are at fault, the guard for failing to safely dispatch the train and instead relying on the girl's common sense (which she had little of due to her being drunk), and the girl should've been charged from underage drinking and acting irresponsibly.

In court it is not simply the letter of the law or the protocol that is taken as the bottom line, but it is also important why those protocols exist, and if those protocols are more than should be expected from the guard. Most people here in the comments argue that he may have broken protocol, but maybe that was not a good protocol. Everyone agrees that the guard did not do what the protocol said, what they are debating is whether the guard should have to follow that protocol given the actions of the person. They are debating the very nature of the rules. You are looking at this from a very legalistic perspective. And ultimately if most people agree that the girl was to blame, then how can it be said that she isn't to blame? Protocols mean nothing against the reasonable expectation and judgements of general society. Maybe if so many people disagree with the rules, then the rules should be changed. In other words they believe a guard should not be expected to hold a train for someone who is putting themselves and only themselves in danger.
