If everything was the same, every detail, except lets say Drejka was a uniformed cop, the gf was arguing with the cop and drejka/cop gets laid out and shoots. Would the state be prosecuting this case?

I’ve thought the exact same thing. It’s hard to say but considering it took public pressure and like a month to arrest this guy, it’s hard to see an officer getting charged.

defendant wanted so hard to be the "good guy with a gun" that he had to be the bad guy with a gun to force the opportunity to arise. By which point the situation needed a good guy with a gun to stop anyway. but as is often the case that never happened and a man is dead and the killer is still alive

This defense attorney is going too far. It was XTC that the victim still had traces of in his blood. And what does this defense attorney make of it: crystal meth. So UNTRUE. All the objections and side benches asked by prosecution were well deserved. It is a common courtesy to not do that during statements and arguments, but this defense attorney did the same to prosecution during the full trial. The interruptions during this closing were well deserved:)

Horrible defense team. The video itself clearly shows what happened. Drejka didn't have to shoot him. As the guy was backing up, he could've easily got into his car and left. There was no threat. Drejka was looking for a fight.

Watch the tape.. you see the victim with his “hands inside his pockets” when he leaves the store. Nobody ever brings this up during the trial. His hands leave his pockets as he approaches the car, when he “observes” figures out what’s going on: - his girlfriend is getting out of the car (because she sees him coming and now feels safe) - the Defendant is so focus on arguing that in his peripheral vision, he doesn’t see the victim approaching WTF 😳 here comes the blindside The Victim is absolutely guilty of ASSAULT and deserved to be charged accordingly. However, when the Defendant pulled out his gun, the power shifted to his favor, as the unarmed Victim immediately started retreating. People pay attention when your pointing a gun at them 👈 The Defendant’s account to the police came across as righteous and arrogant. Even after they tell him that they watched the surveillance tape and it shows the Victim retreating, after assaulting him. He further incriminates himself. And finally when they inform him that the Victim had died. His response was “Thank you for informing me” that is expressing remorse. Not “OMG.. I didn’t mean to kill him. I was in fear for my life. OMG, those 2 poor little girls in the back of car” As he was unaware of the son left inside the store or that the girlfriend was pregnant. Later, the Defendant is crying on camera, during an in-house jail interview, about how much he misses his 2 girls. I later find out he’s talking about 2 dogs 🐶 🐶

You don’t “have to,” but you actually can, which facilitates the human and civil right to self defense, and saves far more lives than it takes, anywhere from 500,000 to 2,000,000 defensive uses that could be saving one or more lives every year according to the CDC. Putting aside obvious occurrences of vigilante assholes, places that have ablated this right grant their citizens inherently less liberty. That’s an automatic disqualification for “best.”

The prosecution are absolutely brilliant and incredibly competent, whereas the defense team are very amateur. They don't have much to work with though, I'll give them that.

@@leongibson1210 Actually that's exactly what they're saying. When the defense suggested had McGlockton not been shot, he would have been arrested for assault, the prosecutor disagreed. He said it wasn't assault because he was "coming to the defense of others." The prosecutor is a joke.

All throughout the trial the defense was talking about the camera’s quality as if that just refuted all the evidence. They’re like “as you can see the camera is old, we don’t know how old, but it’s grainy. In fact we don’t even know if this is Mr. Drejka firing the weapon. That could be John Cena for all we know. I therefore move to dismiss these charges against my client.” 1:02:25

Carrying a 45 gun seems a bit much for a regular civilian to carry for 22 yrs on a regular basis. He needed two hands because he couldn’t hold a 45 one handed and shoot accurately and handle the recoil. I would guess he has practiced in the past, shooting from that shooting position. I think defendant even said that in his police interview. IMO, if he did practice this in the past, it would encourage him to use what he learned when given any chance whether it was warranted or not.

Yes! It's interesting you say that bc the detectives asked him about shooting from that position and the murderer said it was his "training". They were like "Oh? Training? You in law enforcement? military? ...." These detectives REALLY zero in the truth over a few hours, exposing that Drejka is not "retired" at age 48, but unemployed for years, is packing to move out of long term rental with no where to go, can't afford to buy a house, has ZERO hobbies, etc... but they seemed interested in what you are saying here and this was noted.

The victims response to Mr. Drejka was not normal. 0-60 violence. A normal person doesn't just shove somebody. He could've just been asking for directions, panhandling, ask for a light etc.

So he got found guilty. I now see why you are not allowed to start deliberating until you have heard all the evidence. Just listening to this defense argument makes you think the guy should soon be in his own bed in a day or two. I have mentioned this before but the main question is where do you draw the line. Was that shove enough provocation to kill a man. The jury decided it was not and I have to agree, otherwise there would be bodies all over. He could not honestly say he thought his life was in danger. Yes pull the gun but get him to back off or better still if you don't need that parking space, just go to the shop and mind your own business. Years ago christmas shopping I was almost fighting over a parking space. I was waiting to park in a space of a car that was leaving. The way the car pulled out allowed another man to pull in the space before me. Obviously I was fuming as it was obvious I was waiting first. I approached the car, the man was driving but his wife was the mouthy one. Eventually I dared him to leave his car and get out. His wife was willing to leave the car but the man decided to pull out and let me have the space. I would have fought him for the parking space, but the main point is no-one would have ended up dead.

The thing is the defendant carried a gun and regularly picked on people who parked there. He told at the interview that he “usually” took pictures of the cars. He picked on people and didn’t mind starting arguments but unlike you he felt sure that if someone would try to fight him he could pull out his gun. He was too coward to fight. He only felt safe to argue because he didn’t mind using his gun and use it.

This case is a hard one to call, but from the shooter's perception, I might have done the same thing in that situation. You never know what people might be carrying, for all I know this dude who just shoved me could have a MAC-10 in his oversize shorts. And I might also feel like I had three people coming at me now since they're all moving in my direction. Really, the best thing to have done was to not have the confrontation in the first place.

After hearing 37 mins of this argument, it's looking like a justifiable killing. 1 shot, the victim as already been violent, and he is on drugs which will have an effect on the juries thinking. His partner gets out of the car, and there is a 3rd person approaching too.

I watch a LOT of trials, this is a really good defense team. I think it’s clear why he was found guilty, and in all candor, this is perhaps the only time in my life I have stated a case is a “travesty of Justice”. This is.
